Dinka Malual and Misseriya

Grassroots Peace Conference

19 to 21 February, 2012 Aweil Town,

Joint Communiqué

1-  Conscious of the present and of the future expectations and desire, by the Dinka-Malual and Misseriya Communities, for common and shared development projects and efforts to the attainment of peaceful co-existence and promotion of ‘shared natural heritages’ between the bordering communities;

2-  Recalling the long history of peaceful coexistence between Dinka-Malual and Misseriya somberness and compassion, respect of lives, fraternity that augment and brace us as two communities with mutual interest in socio-economic development and good neighborliness;

3-  Recalling the long history of suffering as a result of North-South war that has brought in a new geo-political reality which resulted to the birth of new nation of South Sudan.

4-  Cognizant of the significance of mutual recognition of each other’s cultures, values, beliefs and respect of each others’ rights

5-  Mindful of our shared desire to return the innocents abducted children and women as documented by the Committee for Eradication of Abduction of Women and Children (CEAWAC);

6-  Inspired and encouraged by the wisdom and good leadership and appreciative of diligence by members and the leadership of Joint Peace Committee, led by Chief Deng Luol Akuey and Ustaz Adam Abdurrahman Najem (Dugshum) ; we are indebted to South Sudan Peace Commission, and the AECOM, USAID for preparing and funding our Seasonal Migration Conference , and we urge the United States Agency for International Development (USAID), European Union (EU), United Nations (UN), International/ Local NGOs and both government of Sudan and of the Republic of South Sudan to timely respond to our needs of empowerment of our traditional authority ; we are also not forgetful of the role of traditional authorities in peaceful conflict resolution.

7-  We the conferees deplore war and we are committed to end the instability and destruction to our resources, and resulting in unjustified impediment of development, and therefore the two parties agreed on the following recommendations that emerged from our conference as per attached to be immediately implemented upon the date of signature;

8-  Thankful to the outstanding hospitality extended to this historic conference for peace organized by the Dinka-Malual, the administration and people of Aweil Town;

9-  We renew our confidence and urge the current leadership and membership of Joint Technical Committee (JTC) and Joint Steering Committee (JSC) to form gender balanced institution; which should also involve youth, faith and the religious institutions that includes Dinka-Malual and Misseriya communities inside or outside the Republic of Sudan and the republic of South Sudan to advocate for peace and development in the concerned areas;

10-  We the delegates, the representatives of the Dinka-Malual and Misseriya have deliberated and reached consensus and passed the above resolutions:

There has existed such courts and precedence on :

a)  Rape 15 cows

b)  Zina ( voluntary sexual act with another married woman) = 07 cows

c)  Zina (with married girl ) = 07 cows

d)  Rape for underage = Judiciary .

e)  Burning of homes = SDP 1000

It was agreed that taking of oath should follow Quran, the Bible and traditional swearing methods. The laws to be applied should be a blend of Sudan and South Sudan government besides the traditional customary laws of the two communities already implemented for years.
