NOTICE OF TEMPORARY ADOPTION
PROCUREMENT RULES

Pursuant to section 24-102-101, C.R.S. and the rulemaking provisions of the State Administrative Procedures Act, I hereby adopt and give NOTICE of the temporary adoption this 13th day of August, 2010 of amendments to the Colorado State Procurement Rules (1 C.C.R. 101-9) as follows :
New Amendment to Rule R-24-103-204-03 of the Colorado Procurement Rules is adopted as follows:
R-24-103-204-03 Documented Quotes
(a)Commodities costing between $10,000 and $150,000, services costing between $25,000 and $150,000, and construction projects between $25,000 and $150,000 may be purchased using a documented quote process. FOR CONSTRUCTION PROJECTS OVER $150,000 AND LESS THAN $500,000, AN AGENCY MAY SEEK APPROVAL FROM THE STATE BUILDINGS PROGRAM TO USE A DOCUMENTED QUOTE OR AN APPROVED STANDING ORDER PROCESS.
Such rule amendments are effective immediately. In accordance with section 24-4-103(6), C.R.S., attached is a statement of the findings of the Executive Director of the Department of Personnel and Administration justifying the adoption of this rule on an emergency basis.

Statement of Justification and Reasons for Adoption of Temporary Rules
Pursuant to section 24-4-103(6) C.R.S., the Department of Personnel and Administration and the State Purchasing Office finds that immediate adoption of the attached amendments to the State Procurement Rules is necessary to comply with state law section 24-92-102 (8)(b) C.R.S. (2010).
The emergency rule amends Rule-24-103-204-03 to provide for the use of the documented quote solicitation process for construction projects over $150,000 and less than $500,000 with the approval of the State Buildings Program.
The amendment to the existing procurement rule is immediately necessary for the proper administration of procurements associated with public projects as defined in section 24-92-108(a) C.R.S. The temporary adoption of this rule is necessary to clarify statutory language and to provide clear guidance regarding the acceptable procurement processes associated with public projects.
Therefore, the Executive Director of the Department of Personnel and Administration finds that the adoption of the amendment to the State Procurement Rules is imperatively necessary to comply with state law and that the rule does not conflict with other provisions of the law and that this rule is clearly and simply stated so that its meaning is understandable.
