Position Title: Associate General Counsel

The Lower Elwha Klallam Tribe seeks a full-time Associate General Counsel for its on-reservation Office of General Counsel. The Office was established in August 2008, and has taken on most of the workload formerly performed by outside counsel. The Associate serves under the supervision of the General Counsel and will have a significant opportunity to help shape the strategic legal planning of the Tribe. The Lower Elwha Klallam Tribe is involved in many important and fascinating issues.

Nature of Practice: The Associate General Counsel is one of two lawyers in the Office. As a salaried professional, the Associate General Counsel will generally have substantial latitude to work on projects directly with the Tribal Council, CEO, and tribal programs, to exercise independent professional judgment, and to contribute to the development of the Office. Duties include all matters pertaining to representation of the tribal government, as assigned or authorized, including: advice to and representation of the Tribe, its officers and staff; drafting of ordinances, regulations, and policies; representation of the Tribe and its entities in tribal, federal, and state courts, administrative tribunals, and before federal and state legislative bodies and agencies; negotiation and review of contracts and commercial transactions; drafting legal documents.

Qualifications:

  • Required: A law degree from an accredited law school and a license to practice law (lawyers licensed by a state other than Washington must acquire a Washington license ASAP); strong writing, research, negotiation, and interpersonal communication skills; litigation experience; and an ability to thrive in an interdisciplinary and cross-cultural work environment.
  • Desired: A Washington State law license with 5–8 years as a practicing attorney; civil litigation experience in federal, tribal, and state courts; experience in Indian law and tribal-government representation, including ordinance drafting and basic governmental processes such as Self-Governance compacting, grants, contracts, etc.; experience working with federal and state agencies; economic development, gaming, and commercial transaction experience; exceptional writing and research skills.

Location: The Office of General Counsel is located in the Elwha Tribal Center on the Lower Elwha Reservation, about five miles west of Port Angeles, Washington. Port Angeles is a small, historic town located on the Strait of Juan de Fuca and just a few miles from Olympic National Park. The office is approximately 85 miles west of Seattle.

Salary: Depends on experience. Full-time compensation includes medical and dental, retirement savings plan, and other fringe benefits.

The Director, Office of Hearings and Appeals exercises program management and administrative responsibilities with respect to the hearings and appeals functions of the Department, in accordance with existing policies, regulations, and procedures. These responsibilities include strategic planning, budget execution, performance management, human capital management, and information resources management. The Director serves as an ex officio member of the Appeals Boards of the Office, and he or she may participate in their decisions. The Director may assume jurisdiction of any case pending before any Appeals Board of the Office, review a decision of any Appeals Board, or direct reconsideration of a decision by any Appeals Board. As requested, the Director advises the Secretary, Deputy Secretary, and Assistant Secretaries on matters relating to administrative review functions within the Department. About the Office: The United States Attorney's Office (USAO) for the Western District of Washington is responsible for representing the federal government in virtually all litigation involving the United States in the Western District of Washington (WDWA). This includes criminal prosecutions for violations of federal law, civil lawsuits by and against the government, and actions to collect judgments and restitution on behalf of victims and taxpayers. WDWA has an authorized strength of approximately 74 Assistant United States Attorneys (AUSAs). The USAO is divided into two litigating Divisions (Criminal and Civil). The USAO's main office is in Seattle, Washington, with a branch office located in Tacoma, Washington.

Responsibilities and Opportunity Offered: One or more positions may be filled under this vacancy. The position will be located in the Criminal Division of the Western District of Washington. The applicant for this position will be assigned a variety of criminal matters involving various areas of federal law. The responsibilities may include work with the 25 Native American Tribes located in Western Washington. Candidates with prior experience in the areas of 1) Asset Forfeiture; 2) Cyber-Crimes/Electronic Evidence; 3) Gun or violent crime prosecutions; or 4) Indian Country are requested to describe their work in these areas in their cover letter and resume.

AUSAs in the Criminal Division prosecute federal criminal cases in the Western District of Washington. AUSAs in the Criminal Division advise federal law enforcement agents on criminal investigation, present criminal cases to the grand jury, try criminal cases before the United States District Court, and represent the United States in criminal appeals before the Ninth Circuit Court of Appeals.

Qualifications: The applicants must possess a J.D. Degree, be an active member of the bar (any jurisdiction), and have at least three years post-J.D. experience. Ideal qualifications include at least five years of post J.D. litigation experience.

Applicants must demonstrate a quick analytical ability and an ability to synthesize a wide range of data, help direct an investigation and have the ability to accurately and precisely articulate the critical issues in a case. Applicants must demonstrate superior oral and writing skills, strong research and interpersonal skills, and good judgment. Applicants must possess excellent communication and courtroom skills, and exhibit the ability to work in a supportive and professional manner with other attorneys, support staff and client agencies. Applicants must have a demonstrated capacity to function, with minimal guidance, in a highly demanding environment and in the highest ethical manner.

Applicants will be expected to do their own legal research and writing and will be substantially self-sufficient in preparing day-to-day correspondence and pleadings. OVERVIEW

The ACLU’S Racial Justice Program challenges racial discrimination and other practices and policies that have a direct or disparate impact on communities of color with a particular emphasis on education and criminal justice issues and with an emerging focus on economic issues. Among its other goals, RJP seeks to ensure that all children have access to equal, high quality educational opportunities, regardless of race or ethnicity. Likewise, the RJP is dedicated to exposing and eliminating discriminatory racial practices and policies which have a disproportionate impact on communities of color throughout the criminal justice system. RJP has worked to assure that persons of color have access to economic opportunities in the areas of government programs and access to home ownership. In furtherance of these goals, RJP, often working with the ACLU’s 53 affiliates nationwide, has filed lawsuits challenging disparate educational opportunities, pre- and post- 9/11 racial profiling, policies and practices which push children out of the education system into the juvenile justice and criminal justice systems, unfair lending practices and a range of police and criminal justice system practices which have a particularly adverse impact on communities of color.

RJP has also engaged in other innovative advocacy and public education efforts including the development of resource materials and web sites addressing a number of racial justice issues. RJP is part of the ACLU Equality Center, which also includes the ACLU’s work on immigrant’s rights, voting and disability rights.

ROLES AND RESPONSIBILITIES

Litigate in trial and appellate courts, both state and federal, including writing and reviewing briefs, motion papers, and affidavits, preparing witnesses and taking and defending depositions.

Conduct legal research and fact investigations to identify racial justice issues subject to legal challenge.

Develop new cases and identify and work with potential plaintiffs and witnesses.

Support and advise ACLU affiliates, coalition partners and racial justice bar on legal and policy issues.

Serve as a resource for, and, when needed, participate directly in ACLU legislative and policy work.

Advance ACLU goals through public education, advocacy and media.

Supervise student interns, legal fellows, and paralegals.

Work on funding proposals, reports and donor solicitations as requested.

EXPERIENCE AND QUALIFICATIONS

J.D. degree is required. A minimum of seven years of litigation experience preferred.

Ability to work independently as well as within a team.

Demonstrated commitment to racial justice issues and public interest law preferred.
