Answers / A client recently finished a 4 story office NB done under 1968 Code in C4-2 zoning. He would like to change the upper floor offices into residential space. My questions are:
  1. The Open Space is not sufficient. Would that be enough to disqualify the proposal?
Answer:
Required open space for mix building residence portion shall comply with Zoning Resolution ZR 23-14as per ZR 35-10 & ZR 35-33.

  1. Could the residences and the offices share the same one & only exit stair and utilize the same elevator?
Answer:
Separate stair shall be provided as per BC 27-375 (i) (5)
  1. Why must every time we receive a Construction Update the question of an old open ALT II comes up? If we have an existing TCO and we are actively working on the final CO & signing off of the old applications why must we get a denial from the construction division regarding updating the existing construction sign-off?
This denial prevents the TCO from being renewed

When the construction desk updates an inspection they must review open applications that they inspected, such as PA, Alt-1, etc...
The person reviewing the PW-7 for TCO should review all the opened applications and make the necessary comments.
  1. As requested at past Industry Meetings, please schedule a person of authority to discuss and explain the energy requirements,including exemptions, controlled inspections, audits, etc.
Answer:
An Energy Code/Energy Audits Presentation was held in the Borough Industry Meeting November17th, 2011 by Deborah Taylor & Kenrick Chai-Hong of the Energy Code Unit who discussed the following:
“The 2011 NYCECC (New York City Energy Conservation Code) & the TR8 form”
  • PW1- Must state compliance
  • TR1- One person takes responsibility
  • TR8- Can be broken up into several individuals taking responsibility
  • 1 RCNY §5000-01
  • Progress Inspections on the Construction Drawings
  • Exemptions & Exceptions

A)Can the RA or PE sign the TR-8 Form? The Form does not specify this.
Answer:
If progress inspections are required due to Energy then “Yes” should be checked on the TR-8 Form. The PE/RA can sign the Form to identify the required Inspections. The Progress inspector signs to identify responsibility for the energy requirement and also certifies the necessary inspections were completed.
B) Is it possible to obtain a free version of the NYC Energy Code?
Answer:

C) Is it now possible to have our energy calculations be reviewed by an examiner?
Answer:
No, Plan Examiners are instructed to check for the completeness andgeneral energy compliance. It is the responsibility of the applicant of record to do aresearch on theapplicable codeand take a professional judgment to complete the calculation.
