 Adult Diversion

The Adult Diversion Program will involve counseling, educational programs, restitution, community service and / or other requirements. All expenses of the program are the responsibility of the defendant.

To participate in this program, the following must be true:

Ø  The defendant has no other criminal convictions (or guilty pleas) or major (greater than 6 point or a charge that would revoke a driver’s license) traffic offense convictions, anywhere, within the last seven years (except juvenile, non-felony cases). This includes drinking and driving convictions.

Ø  The defendant has no pending criminal charges other than this case.

Ø  The defendant has not received a deferred judgment or deferred prosecution within the last seven years.

Ø  The defendant has no felony convictions, guilty pleas, or felony juvenile adjudications at any time.

*The defendant must call 720-913-8080 (Carrie Smart) within twenty-four hours of referral to set an appointment for an interview. You may leave a message with your telephone number if Ms. Smart is unavailable to take your call.

Interviews are held at the City Attorney's Office, 201 West Colfax (the Webb Municipal Office Building), Department 1207 (12th floor).

 Mediation

The defendant and complainant(s) will be interviewed. In order to resolve the case through the mediation process, the defendant must accept responsibility for his/ her actions as indicated by the complainant. The complainant must agree to mediate. While there are no requirements with respect to criminal record, if any party has a criminal record, that record may be disclosed to any potential participant in the mediation. If there is a mediated agreement and all components of the agreement are fulfilled, the case may be dismissed by the referring Assistant City Attorney.

By signing this form, I am declaring that I meet the minimum requirements for application to the Alternative Resolution Program. I understand that this program is voluntary and my participation is subject to investigation. New evidence in the case may result in the defendant’s disqualification. Confidentiality in this process is not guaranteed.
