In an effort to comply with DelDOT’s ultimate request to settle, please reference the attached table of DelDOT Settlements / Offers and MLS Fair Market Value Homes / Lands Sold to assist in preparing and returning a formal change of position.

Let us be perfectly clear - the suggested value for our property is based on published settlements ( already completed by DelDOT and justified by MLS Fair Market Value Homes / Lands Sold.The objective of our suggested value is to produce a credible result from DelDOT and MLS information; not “the right number”, not “an irrefutable conclusion.” The information used is fact not a Hypothetical Condition or based on an unrealistic and unsupported Highest and Best Use Theory. The information supports our suggestions and does not generate a hypothetical value.

This is not our opinion rather a suggestion derived from DelDOT’s Opinion of Value based on property settlements. If our logic is flawed, then provide us with a value DelDOT feels is justified based on the settlements and MLS Fair Market Homes / Land Sold.

We are prepared to meet with Representatives from the State of Delaware that are authorized to present and accept a final settlementdeveloped from a formal change of position.

As an aside, your second paragraph appears to confirm what we have been saying all along about the DelDOT Appraiser’s – They are bias! Unless this is something else you “really didn’t mean to say”.
