DEED OF DEDICATION OF RIGHT-OF-WAY

THIS CONVEYANCE is made on this ______day of , by and between INSERT_GRANTOR'S_NAME, heirs, executors, administrators, and assigns, all of which are hereinafter collectively referred to as Grantor, and CITY OF SHAWNEE, KANSAS, a Municipal Corporation of the State of Kansas, its successors, administrators, and assigns, all of which are hereinafter collectively referred to as Grantee.

IN CONSIDERATION of the sum of One Dollar and other valuable considerations, receipt and sufficiency of which is hereby acknowledged, Grantor does hereby grant and convey unto Grantee, a permanent, public Right-of-Way over, under and through the following described real estate lying and situated in the County of Johnson, State of Kansas, to-wit:

THIS DEED OF DEDICATION OF RIGHT-OF-WAY is executed, delivered, and granted upon the following conditions and considerations:

1.Grantor understands and agrees that Grantee shall use the described real estate as a permanent, public Right-of-Way for the City of Shawnee, Kansas, but should said Right-of-Way be vacated, then the vacated part shall revert to Grantor. Grantor and Grantee further agree this Right-of-Way shall be subject to regulation and management by the City of Shawnee, Kansas, and the right of the City, in its sole discretion, to demand the future relocation of any utility to be constructed and maintained in the future within this Right-of-Way, with the cost of such relocation to be paid by the utility.

2.Grantor hereby covenants, promises, and agrees to and with Grantee that Grantor lawfully owns and possesses the entire interest hereby conveyed; that the same are free and clear of and from all and every encumbrance whatsoever, except any right, title, easement, or encumbrance of record; and that Grantor will forever warrant and defend the same unto Grantee forever, against all claims of any and all persons.

3.Grantor hereby waives and releases Grantee from any and all claims for damages or compensation, either now or in the future, arising by reason of the use of the described real estate for the purposes herein described.

4.Grantor and Grantee hereby agree that Grantor shall pay any special assessments or installments thereof, matured or unmatured, on the interest hereby conveyed, or that the proper governing body may release the described real estate for any special assessment, and spread and attach such special assessment to Grantor’s remaining real estate.

5.This Right-of-Way shall apply to all interests in the described real estate, now owned or hereafter acquired or assigned by Grantor or Grantee; this covenant to run with the land.
