-Notification by the Czech Republic

Dear Mr Director-General,

In accordance with Article34(2) of Council Framework Decision2002/584/JHA of 13June2002 on the European arrest warrant and the surrender procedures between Member States (Official Journal of the EU, L 190, 18July2002), I would inform you that the Czech Republic has implemented the above Framework Decision in its national law.

The provisions of the Framework Decision have been transposed by Act No104/2013 on international judicial cooperation in criminal matters, which entered into force on 1January2014.

In connection with the abovementioned notification I enclose:

the text of the Czech Republic's notification (notification pursuant to Article7(1), notification pursuant to Article 25(2) and notification pursuant to Article31 of the above Framework Decision (Annex No1);

the text of the annex to the Czech Republic's notification (Annex No2);

the text of the Czech Republic's declaration - declaration pursuant to Article8(2) of the above Framework Decision (Annex No3);

implementation table;

the text of the national transposing provisions.

ANNEX 1

Notification by the Czech Republic regarding the Council Framework Decision of 13June2002 on the European arrest warrant and the surrender procedures between Member States (2002/584/JHA)

Notification on Article 6(3)

1)The bodies authorised to issue a European arrest warrant in the Czech Republic are local, district, regional and high courts, Prague Municipal Court, Brno Municipal Court and the Supreme Court of the Czech Republic.

2) The bodies authorised to execute a European arrest warrant in the Czech Republic are the regional public prosecutors, the Prague Municipal Public Prosecutor, regional courts, high courts and the Prague Municipal Court.

The bodies competent to accept a European arrest warrant issued by a Member State are the regional public prosecutors and the Prague Municipal Public Prosecutor. The contact details are given in Annex No2.

Notification on Article 7(1)

The Ministry of Justice of the Czech Republic, the Chief Public Prosecutor of the Czech Republic and the Police Presidium of the Czech Republic are the central authorities designated to assist the judicial authorities. The contact details are given in Annex No2.

Notification on Article 25(2)

The body in the Czech Republic competent to receive transit requests, including the necessary documents relating to transit requests, is the Ministry of Justice. The contact details are given in Annex No 2.

Notification on Article 31

The Czech Republic will henceforth implement in full the European Convention on Extradition of 13December1957, its additional protocol of 15October1975, its second additional protocol of 17March1978, and the relevant provisions of PartIII Chapter4 of the Convention of 19June1990 implementing the Schengen Agreements of 14June1985 on the gradual abolition of checks at common borders that are binding on it and applicable to it. The Czech Republic will proceed thus until notifying the SecretaryGeneral of the Council of Europe under Article28(3) of the European Convention on Extradition.
