SCHEDULE

1.  TITLE

This Agreement shall be known as the Dawson AOC Water Services Pty Ltd Mechanical and Electrical Maintenance Enterprise Bargaining Agreement 1996 Amendment Agreement 2001(A) and shall be referred to in this document as the "Agreement".

3.  PRINCIPAL AGREEMENT

The Dawson AOC Water Services Pty Ltd Mechanical and Electrical Maintenance Enterprise Bargaining Agreement 1996, No AG115 of 1996, as amended by:

·  the Dawson AOC Water Services Pty Ltd Mechanical and Electrical Maintenance Enterprise Bargaining Agreement 1996 Amendment Agreement 1998, No AG100 of 1998;

and further amended by:

·  the Dawson AOC Water Services Pty Ltd Mechanical and Electrical Maintenance Enterprise Bargaining Agreement 1996 Amendment Agreement 1990, No AG 10 of 2000;

and further amended by;

·  the Dawson AOC Water Services Pty Ltd Mechanical and Electrical Maintenance Enterprise Bargaining Agreement 1996, Amendment Agreement 2001, No AG34 of 2001;

is referred to in this document as the "Principal Agreement".

4.  OBJECTIVES

(1)  The objectives of this Agreement are to replace nominated provisions of the Principal Agreement as specified in this Agreement.

(2)  The provisions of Clause 36, Grievance and Dispute Settling Procedure of the Principal Agreement are deemed to be incorporated into this Agreement for the purposes of Section 49A of the Industrial Relations Act 1979.

5.  AREA AND SCOPE

(1)  The Area and Scope of this Agreement shall be the same as that described by subclauses (1) to (4) inclusive of Clause 3. Area and Scope of the Principal Agreement.

(2)  At the date of registration of this Agreement, its terms and conditions will apply to approximately 60 employees.

6.  PARTIES BOUND

The parties bound by this Agreement are:

(1)  Dawson AOC Water Services Pty Ltd;

(2)  the Automotive, Foods, Metals, Engineering, Printing and Kindred Industries Union of Workers, Western Australian Branch;

(3)  the Australian Liquor, Hospitality and Miscellaneous Workers Union, Western Australian Branch; and

(4)  the Communications, Electrical, Electronics, Energy, Information, Postal, Plumbing and Allied Workers Union of Australia, Engineering and Electrical Division, Western Australian Branch.

7.  TERM

Clause 5, Term of the Principal Agreement is amended by adding the following subclause:

"(5) Notwithstanding the term of the Principal Agreement, the provisions of Clause 17, Travelling Time and Travel Allowances contained in this Agreement shall be applied from the beginning of the first pay period commencing on or after the date of registration of this Agreement."

8. TRAVELLING TIME AND TRAVEL ALLOWANCES

Clause 17, Travelling Time and Travel Allowances of the Principal Agreement is replaced by the following:

"(1)  Except as provided by this Clause, employees shall start work at a depot, workshop or other location nominated by the Company at the time of engagement as the employee's permanent work location.

(2)  An employee shall start and cease work at the permanent work location at the usual commencing and finishing times.

(3)  (a) The Company may require an employee to start and cease work at a temporary work location at the usual commencing and finishing times.

(b)  An employee who is not provided with a home garaged vehicle shall be paid ordinary wages for any extra time that is spent in travelling to or from his or her home and the temporary work location.

(c)  An employee who is provided with a home garaged vehicle shall not be paid ordinary wages for any extra time that is spent in travelling to or from his or her home and the temporary work location unless:

(i)  The employee is temporarily assigned to another Depot;

(ii)  The employee is temporarily assigned to a temporary work location normally serviced by another Depot;

(iii)  The extra time spent in travelling to or from the temporary work location is greater than 15 minutes; or

(iv)  The number of days on which an employee is assigned to a temporary work location and undertakes extra travelling time in any two consecutive fortnightly pay periods exceeds 9, irrespective of whether the extra travelling time is undertaken on the outward or return journey, or both.

(d) Extra time shall be any additional time the employee spends in travel to or from his or her home and the temporary work location compared to the time the employee spends in travelling to or from the employee’s home and his or her permanent work location. In the case of subparagraph (c) (iii), payment shall only be made for the extra travel time over 15 minutes in either direction. In the case of subparagraph (c) (iv), payment shall only be made for the extra travel time on the tenth and subsequent days it occurs in the four week period.

(4)  When an employee is required to start and cease work at a temporary work location, the employee shall be:

(a)  provided with a home garaged vehicle for the duration of the assignment to the temporary work location; or

(b)  paid the kilometre allowance contained in Sub Clause (6).

(5)  Employees who are required to transport other employees and/or materials are performing work.

(6)  Where an employee is required to use his or her own vehicle for business purposes he or she shall be paid an allowance as per the following table:
