815.02Legislativeintent. TheLegislaturefindsanddeclaresthat:
(1)Computer-relatedcrimeisagrowingproblemingovernmentaswellasintheprivatesector.
(2)Computer-relatedcrimeoccursatgreatcosttothepublicsincelossesforeachincidentofcomputercrimetendtobefargreaterthanthelossesassociatedwitheachincidentofotherwhitecollarcrime.
(3)Theopportunitiesforcomputer-relatedcrimesinfinancialinstitutions,governmentprograms,governmentrecords,andotherbusinessenterprisesthroughtheintroductionoffraudulentrecordsintoacomputersystem,theunauthorizeduseofcomputerfacilities,thealterationordestructionofcomputerizedinformationorfiles,andthestealingoffinancialinstruments,data,andotherassetsaregreat.
(4)Whilevariousformsofcomputercrimemightpossiblybethesubjectofcriminalchargesbasedonotherprovisionsoflaw,itisappropriateanddesirablethatasupplementalandadditionalstatutebeprovidedwhichproscribesvariousformsofcomputerabuse.

815.03Definitions. Asusedinthischapter,unlessthecontextclearlyindicatesotherwise:
(1)"Access"meanstoapproach,instruct,communicatewith,storedatain,retrievedatafrom,orotherwisemakeuseofanyresourcesofa computer,computersystem,orcomputernetwork.
(2)"Computer"meansaninternallyprogrammed,automaticdevicethatperformsdataprocessing.
(3)“Computercontaminant”meansanysetofcomputerinstructionsdesignedtomodify,damage,destroy,record,ortransmitinformationwithinacomputer,computersystem,orcomputernetworkwithouttheintentorpermissionoftheowneroftheinformation. Thetermincludes,butisnotlimitedto,agroupofcomputerinstructionscommonlycalledvirusesorwormswhichareself-replicatingorself-propagatingandwhicharedesignedtocontaminantothercomputerprogramsorcomputerdata;consumecomputerresources;modify,destroy,record,ortransmitdata;orinsomeotherfashionusurpthenormaloperationofthecomputer,computersystem,orcomputernetwork.
(4)"Computernetwork"meansanysystemthatprovidescommunicationsbetweenoneormorecomputersystemsanditsinputoroutputdevices,including,butnotlimitedto,displayterminalsandprintersthatareconnectedby telecommunicationfacilities.
(5)"Computerprogramorcomputersoftware"meansasetofinstructionsorstatementsandrelateddatawhich,whenexecutedinactualormodifiedform,causeacomputer,computersystem,orcomputernetworktoperformspecifiedfunctions.
(6)"Computerservices"include,butarenotlimitedto,computertime;dataprocessingorstoragefunctions;orotherusesofacomputer,computersystem,orcomputernetwork.
(7)"Computersystem"meansadeviceorcollectionofdevices,includingsupportdevices,oneormoreofwhichcontaincomputerprograms,electronicinstructions,orinputdataandoutputdata,andwhichperformfunctions,including,butnotlimitedto,logic,arithmetic,datastorage,retrieval,communication,orcontrol. Thetermdoesnotincludecalculatorsthatarenotprogrammableandthatarenotcapableofbeingusedinconjunctionwithexternalfiles.
(8)“Data”meansarepresentationofinformation,knowledge,facts,concepts,computersoftware,computerprograms,orinstructions. Datamaybeinanyform,instoragemediaorstoredinthememoryofthecomputer,orintransitorpresentedonadisplaydevice.
(9)"Financialinstrument"meansanycheck,draft,moneyorder,certificateofdeposit,letterofcredit,billofexchange,creditcard,ormarketablesecurity.
(10)"Intellectualproperty"meansdata,includingprograms.
(11)"Property"meansanythingofvalueasdefinedin[Footnote1]s.812.011andincludes,butisnotlimitedto,financialinstruments,information,includingelectronicallyproduceddataandcomputersoftwareandprogramsineithermachine-readableorhuman-readableform,andanyothertangibleorintangibleitemofvalue.

(a) Personalinformationcontainedinamotorvehiclerecordthatidentifiesanindividualisconfidentialandexemptfroms.119.07(1)and
s.24(a),Art.IoftheStateConstitutionexceptasprovidedinthissubsection.Personalinformationincludes,butisnotlimitedto,anindividual'ssocialsecurity number,driveridentificationnumberoridentificationcardnumber,name,address,telephonenumber,medicalordisability information,andemergencycontactinformation.Forpurposesofthissubsection,personalinformationdoesnotincludeinformationrelatingtovehicularcrashes,drivingviolations,anddriver'sstatus.Forpurposesofthissubsection,theterm"motorvehiclerecord"meansanyrecordthatpertainstoamotorvehicleoperator'spermit,motorvehicletitle,motorvehicleregistration,oridentificationcardissuedbytheDepartmentofHighway Safety andMotorVehicles.
(b) Personalinformationcontainedinmotorvehiclerecordsmadeconfidentialandexemptbythissubsectionmaybereleasedbythedepartmentforanyofthefollowinguses:
1. Foruseinconnectionwithmattersofmotorvehicleordriversafetyandtheft;motorvehicleemissions;motorvehicleproductalterations,recalls,oradvisories;performancemonitoringofmotorvehiclesanddealersbymotorvehiclemanufacturers;andremovalofnonownerrecordsfromtheoriginalownerrecordsofmotorvehiclemanufacturers,tocarryoutthepurposesofTitlesIandIV oftheAntiCar TheftActof1992,theAutomobileInformationDisclosureAct(15U.S.C.ss.1231etseq.),theCleanAirAct(42U.S.C.ss.7401etseq.),andchapters301,305,and321-331ofTitle49,UnitedStatesCode.

b. Ifsuchinformationassosubmittedisnotcorrectorisnolongercorrect,toobtainthecorrectinformation,butonlyforthe
purposesofpreventingfraudby,pursuinglegalremediesagainst,orrecoveringonadebtorsecurityinterestagainst,theindividual.
5. Foruseinconnectionwithany civil,criminal,administrative,orarbitralproceedinginanycourtoragencyorbeforeany self-regulatorybodyfor:

a. Serviceofprocessbyanycertifiedprocessserver,specialprocessserver,orotherpersonauthorizedtoserveprocessinthis

9. Forusebyanylicensedprivateinvestigativeagencyorlicensedsecurity serviceforany purposepermittedunderthissubsection.Personalinformationobtainedbasedonanexemptdriver'srecordmay notbeprovidedtoaclientwhocannotdemonstrateaneedbasedona policereport,courtorder,orbusinessorpersonalrelationshipwiththesubjectoftheinvestigation.
10. Forusebyanemployeroritsagentorinsurertoobtainorverify informationrelatingtoaholderofacommercialdriver'slicensethatisrequiredunder49U.S.C.ss.31301etseq.
11. Foruseinconnectionwiththeoperationofprivatetolltransportationfacilities.
12. Forbulkdistributionforsurveys,marketing,orsolicitationswhenthedepartmenthasobtainedtheexpressconsentofthepersontowhomsuchpersonalinformationpertains.
13. Forany useiftherequestingpersondemonstratesthatheorshehasobtainedthewrittenconsentofthepersonwhoisthesubjectofthemotorvehiclerecord.
14. Forany otherusespecifically authorizedby statelaw,ifsuchuseisrelatedtotheoperationofamotorvehicleorpublicsafety.
15. Foranyotheruseifthepersontowhomtheinformationpertainshasgivenexpressconsentinaformatprescribedby thedepartment.Suchconsentshallremainineffectuntilitisrevokedbythepersononaformprescribedbythedepartment.
(c) Notwithstandingparagraph(b),withouttheexpressconsentofthepersontowhomsuchinformationapplies,thefollowinginformationcontainedinmotorvehiclerecordsmayonlybereleasedasspecifiedinthisparagraph:
1. Socialsecuritynumbersmaybereleasedonlyasprovidedinsubparagraphs(b)2.,5.,7.,and10.
2. Anindividual'sphotographorimagemaybereleasedonlyasprovidedins.322.142.
3. Medicaldisabilityinformationmaybereleasedonlyasprovidedinss.322.125and322.126.
4. Emergencycontactinformationmaybereleasedonlytolawenforcementagenciesforpurposesofcontactingthoselistedintheeventofanemergency.
(d) Therestrictionsondisclosureofpersonalinformationprovidedbythissubsectionshallnotinanywayaffecttheuseoforgandonationinformationonindividualdriverlicensesoraffecttheadministrationoforgandonationinitiativesinthisstate.
(e)1. Personalinformationmadeconfidentialandexemptmay bedisclosedbytheDepartmentofHighway Safety andMotorVehiclestoanindividual,firm,corporation,orsimilarbusinessentitywhoseprimary businessinterestistoresellorredisclosethepersonalinformationtopersonswhoareauthorizedtoreceivesuchinformation.Priortothedepartment'sdisclosureofpersonalinformation,suchindividual,firm,corporation,orsimilarbusinessentity mustfirstenterintoacontractwiththedepartmentregardingthecare,custody,andcontrolofthepersonalinformationtoensurecompliancewiththefederalDriver'sPrivacyProtectionActof1994andapplicablestatelaws.

2. Anauthorizedrecipientofpersonalinformationcontainedinamotorvehiclerecord,exceptarecipientundersubparagraph(b)12.,maycontractwiththeDepartmentofHighwaySafetyandMotorVehiclestoresellorredisclosetheinformationforanyusepermittedunderthissection.However,onlyauthorizedrecipientsofpersonalinformationundersubparagraph(b)12.mayresellorredisclosepersonalinformationpursuanttosubparagraph(b)12.
3. Any authorizedrecipient whoresellsorredisclosespersonalinformationshallmaintain,foraperiodof5years,recordsidentifyingeachpersonorentity thatreceivesthepersonalinformationandthepermittedpurposeforwhichitwillbeused.Suchrecordsshallbemadeavailableforinspectionuponrequestby thedepartment.
(f) ThedepartmentmayadoptrulestocarryoutthepurposesofthissubsectionandthefederalDriver'sPrivacyProtectionActof1994,
18U.S.C.ss.2721etseq.Rulesadoptedbythedepartmentmayprovideforthepaymentofapplicablefeesand,priortothedisclosureofpersonalinformationpursuanttothissubsection,may requirethemeetingofconditionsby therequestingpersonforthepurposesofobtainingreasonableassuranceconcerningtheidentityofsuchrequestingperson,and,totheextentrequired,assurancethattheusewillbeonlyasauthorizedorthattheconsentofthepersonwhoisthesubjectofthepersonalinformationhasbeenobtained.Suchconditionsmay include,butneednotbelimitedto,themakingandfilingofawrittenapplicationinsuchformandcontainingsuchinformationandcertificationrequirementsasthedepartmentrequires.
(g) ThissubsectionissubjecttotheOpenGovernmentSunsetReviewActinaccordancewiths.119.15andshallstandrepealed
