An Act to confirm the Temporary Reservation of certain Crown Land in the Township of Dandenong as a Site for Public Recreation, to confirm the Appointment of the corporation of the City of Dandenong as Committee of Management of the Land, to authorize the corporation to grant Leases of certain Land, and for other purposes.

Preamble
WHEREAS certain Crown land was by Order in Council dated the 23rd May, 1881[1], permanently reserved as a site for public purposes:
AND WHEREAS certain Crown land in the Township of Dandenong was by Order in Council dated the 5th April, 1949[2], temporarily reserved as a site for a public park:
AND WHEREAS certain Crown land in the Township of Dandenong was by Order in Council dated the 17th July, 1962[3], temporarily reserved as a site for public recreation:
AND WHEREAS certain Crown land in the Township of Dandenong was by Order in Council dated the 14th November, 1967[4], temporarily reserved as a site for public recreation:
AND WHEREAS part of the land temporarily reserved by the Order in Council dated the 17thJuly, 1962, was at the time of the making of that Order permanently reserved by the Order in Council dated the 23rd May, 1881:
AND WHEREAS the land delineated and shown hatched on the plan in the Schedule comprises parts of the lands permanently or temporarily reserved (as the case may be) by the Orders in Council dated the 23rd May, 1881, the 5th April, 1949, the 17th July, 1962, and the 14th November, 1967:
AND WHEREAS the corporation of the City of Dandenong is the committee of management of the land delineated and shown hatched on the plan in the Schedule[5]:
AND WHEREAS it is expedient—
(a)to revoke the Order in Council dated the 23rd May, 1881, permanently reserving certain lands as a site for public purposes insofar as it relates to the land temporarily reserved by the Order in Council dated the 17th July, 1962;
(b)to confirm the Order in Council dated the 17th July, 1962, temporarily reserving certain land as a site for public recreation;

(c)to confirm the appointment of the corporation of the City of Dandenong as the committee of management of the land temporarily reserved by the Order in Council dated the 17th July, 1962, as a site for public recreation;
(d)to authorize the corporation of the City of Dandenong as committee of management to grant leases of the whole or any part of the land delineated and shown hatched on the plan in the Schedule for the purposes of sport or recreation or social activities connected therewith; and
(e)to make other provision as hereinafter enacted:
BE IT THEREFORE ENACTED by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):
1.Short title, commencement and definition
s. 1
(1)This Act may be cited as the Dandenong (Shepley Oval) Land Act 1976.
(2)This Act shall come into operation on the day it receives the Royal Assent.
(3)In this Act "corporation" means the corporation of the City of Dandenong.
2.Partial revocation of permanent reservation
The Order in Council dated the 23rd May, 1881, permanently reserving certain Crown lands as a site for public purposes is hereby revoked insofar as it relates to the Crown land in the Township of Dandenong temporarily reserved by the Order in Council dated the 17th July, 1962, as a site for public recreation.
3.Confirmation of temporary reservation
The Order in Council dated the 17th July, 1962, temporarily reserving certain Crown land in the Township of Dandenong as a site for public recreation is hereby confirmed.
4.Confirmation of appointment of corporation as committee of management
The appointment of the corporation as committee of management of the Crown land in the Township of Dandenong temporarily reserved by the Order in Council dated the 17th July, 1962, as a site for public recreation is hereby confirmed.
5.Corporation may grant leases
s. 5
(1)Notwithstanding anything to the contrary in any Act, the corporation as committee of management may from time to time grant leases of the whole or any part of the land delineated and shown hatched on the plan in the Schedule for the purposes of sport or recreation or social activities connected therewith including the erection of buildings.
(2)A lease granted under this section—
(a)shall be subject to such covenants conditions exceptions and reservations as the corporation thinks fit;
(b)shall be for a term not exceeding 21 years; and
(c)shall be subject to approval by the Governor in Council.
(3)The moneys received by way of rent under any lease granted under this section shall be applied by the corporation towards the maintenance and improvement of any part of the land temporarily reserved by Order in Council dated the 17th July, 1962, as a site for public recreation and not leased under this section or for any other purpose approved by the Minister.
6.No compensation payable by Crown
No compensation shall be payable by the Crown in respect of any act matter or thing done under or arising out of this Act.
