CRIMINAL DEPUTY CLERK

SECTION I – Job Description

Summary: The Criminal Deputy is responsible for processing all pending and disposed criminal files and performing complex clerical assignments. The Criminal Deputy Clerk processes legal documents and other court records for the court, must be available to file and accept pleadings by attorneys, and perform any other clerical duties necessary for the efficient operation of the office. The Criminal Deputy Clerk is a non-supervisory position under the direction of the District Clerk.

ESSENTIAL FUNCTION

  1. Process cases where the defendant is sentenced to community supervision by disposing of the case in the Criminal Case Management System (CCM) sending copies of the judgment and bill of the cost to the Community Supervision Department.
  2. Processes cases disposed and/or dismissed by the District Courts in a timely and efficient manner.
  3. Processes requests for criminal case information and/or copies from attorneys, district courts, county departments, law enforcement agencies, and the general public.
  4. Prepares documentation to compile monthly statistical reports to be submitted to the Office of Court Administration for cases where the defendant is on Community Supervision, sentenced to TDCG-ID and the case is dismissed.
  5. Prepares documentation to compile monthly statistical reports to be submitted to the Office of Court Administration for filings with regards to Habeas Corpus, Motions to Revoke, Motions to Adjudicate, Warrants issues during the month, and the number of cases which remain unapprehended.
  6. Prepares electronic disposition transmission to DPS on cases disposed and/or dismissed by the District Courts.
  7. Prepares TDCJ-ID Pen Packet for the Bosque County Sheriff’s Department for those defendants sentenced and transferred from the Bosque County Jail to TDC.
  8. Files and dockets, in the Criminal Case Management (CCM) pleadings filed by attorneys, district attorneys, defendants, government agencies and the general public.
  9. Process indictments filed by the 220th Grand Jury, by researching for continuing jurisdiction in the District Courts, assigning Cause Numbers, designation of the Districts Courts, issuing precepts and/or Warrants of Arrest as ordered, mailing notices to defendants, preparing case files, and notifying the Bosque County Jail, the District Attorney’s Office , and the District Courts of case assignments.
  10. Processes daily complaints filed by the District Attorney’s Office, by researching for continuing jurisdiction in the District Courts, assigning Cause Numbers, designation of District Court, preparing case files.
  11. Processes Motions to Revoke/motions to Adjudicate, where the defendant fails to comply with the conditions of community supervision. By docketing filings into the CCM, creating new docket sheets for judges orders, re-activating cases in the CCM, issuing Warrants of Arrest as ordered by the Districts Courts.
  12. Process Bench Warrants ordered by the District Courts and forward to the Bosque County Sheriff’s Department for Service.
  13. Prepares Habeas Corpus.
  14. Process incoming mail by docketing into the CCM any pleadings and/or motions mailed by defendants, attorneys, government agencies, and or the general public.
  15. Process requests for Background Checks.
  16. Process Change of Venue from other counties and assign to the appropriate District Court.
  17. Issue and process subpoenas filed by the Bosque County District Attorney and Defense Attorneys and route to the Bosque County Sheriffs’ Department for service.
  18. Process general motions and orders signed by the District Courts by docketing into the CCM and routing to the Records Management System.
  19. Issue Warrants of Arrest on cases where the District Courts order an arrest for the failure of the defendant to appear in court, make appropriate docket entries in the CCM and on the Docket Sheet, sign and route warrants to the Bosque County Sheriffs’ Department for service.
  20. Process subpoena returns by verifying court settings in the CCM and forwarding to the appropriate District Court for verification of witness service trials.
  21. Process Warrant Returns by forwarding case files with warrants to the Appropriate District Courts for settings.
  22. Issue Warrants of Arrest on cases where the District Courts order an arrest on the Affidavits of Surety to Surrender, where the defendant fails to comply with the conditions required by the Bail Bond Company, make appropriate docket entries in the CCM and on the Docket Sheet, sign and route warrants to the Bosque County Sheriffs’ Department for service.
  23. Process requests for Confidential Juvenile Records, ensuring that approval from the District Court is granted before anyone is allowed access to view and/or copy any information.
  24. Any other duties as directed by the District Clerk.

Education and Experience:

  • High School education or equivalent.
  • Two (2) years of college education is preferred and/or two (2) to four (4) years experience in civil or criminal fields including at least one (1) year in a District Clerk’s Office; OR
  • Any equivalent combination of experience and training which provides the required knowledge, skills, and abilities.

Knowledge, Skills and Abilities:

Thorough knowledge of the clerical procedures involved in processing, recording and preparing complex legal documents, instruments, records and reports related to the operation of both the court(s) to which assigned; knowledge of the Texas Rules of Civil and Criminal Procedure and other related regulations and codes; knowledge of courtroom procedures; knowledge of legal terminology, ability to type accurately and rapidly (preferably at a speed of at least 50 words per minute with few or no errors); ability to operate office machines; knowledge of computers, ability to make complex arithmetic computations rapidly and accurately; ability to communicate effectively both orally and in writing; ability to establish and maintain effective working relationships with justices, members of the legal professions, and the general public.

SECTION III - Job Dimensions

Contacts

Employee utilizes tact when dealing with Elected/Appointed Officials, Division/Department Heads, county employees, attorneys, and the general public regarding departmental issues.

External Contacts

Employee will have frequent contact with the general public. Employee will have occasional contact with government agencies. Communication is primarily via telephone, written correspondence or in person.

Internal Contacts

Employee will have frequent contact with court personnel, community supervision department, attorneys and other county departments. Employee will have occasional contact with judges and district attorney’s office.

Responsibility

Job has critical impact on the Bookkeeping, Court Costs Collections and Criminal Department operations. Constant communication with attorneys, community supervision department, district courts, and the general public in required.

Difficulty

Judgment is required to ensure accuracy of primary responsibilities; initiative is constantly required to achieve work goals.

Guidance

Employee receives minimal direction to perform essential functions. Employee develops unique solutions for completing work assignments, working within bounds of common business practices of this office and County policy.
