“To ask the Area Manager to say if he can improve the quality of the public lighting at Donaghmede Road as residents, particularly women, feel unsafe at night”.

Reply:

The upgrading of public lighting on Donaghmede Road was completed in December 2003. The wattage was increased and the public lighting in this area is considered to be acceptable.

Would the Manager request Bus Áth Clíath to install bus shelters at (Details supplied).

Reply:

Bus Átha Cliath state that the location at (details supplied) will be surveyed in the very near future to assess its suitability for a shelter. If the location is suitable a planning application will be made to the planning authorities and if this is successful a shelter will be erected shortly afterwards. The planning and building process takes 3-5 months to complete.

Q.4 Question in the name of Councillor Anthony Creevey.

To ask the Manager to refer to work being carried out at house as per details

attached and say:

(1) what enforcement action can be taken to ensure that the footpath, road and surrounding areas are kept clear of muck and builders rubble, etc., as residents complain that they cannot get to and from the shops without having to wade through muck, etc.

(2) if he will arrange to have the road and pathway cleaned/hosed down as soon as possible or else have the contractor working at (details supplied) do it

(3) what restrictions etc are builders (from the point of view of soiling roads and footpaths etc) supposed to adhere to when working on houses in residential areas such as at (details supplied) as regards the use of heavy machinery/dumper trucks etc

(4) if he will make a general comment on the procedures/enforcement actions etc which can be taken against such contractors/builders who create a mess and then fail to clean it up

(5) if he will give extra special attention to this cleaning up this area, particularly in the context of previous problems experienced by residents following last years flooding.

Reply:

1, 2 & 5 A litter warden called to (details supplied) on January 6th, and found the area to be in a satisfactory condition, therefore no enforcement action is required at this stage.

3 This development was not the subject of a planning application, and it is believed the work being carried out is post flooding refurbishment work. In cases where planning permissions are granted, detailed conditions in relation to all environmental issues, dust, hours of working, noise etc. are imposed. A sample copy of these conditions can be forwarded to the Councillor if desired.

4 A notice under section 9 (1) of the Litter Pollution Acts 1997-2003 can be served on the person responsible. Under this Act the offender must take every reasonable step to remove and legally dispose of the relevant materials, as this constitutes an offence under section 6 (2) of the Litter Acts 1997-2003. The offender is requested to remove the materials within 9 working days. Failure to comply may result in Dublin City Council removing the material and recovering all the costs from the offender with a prosecution for breach of the Litter Pollution Acts, 1997-2003, which may incur a penalty of up to €3,000 on summary conviction in the Dublin District Courts. The offender under section 9 (3) can make a submission in writing to the Waste Management Services, 68 – 71 Marrowbone Lane, Dublin 8, regarding the terms of the notice, within 12 hours of receipt.

To ask the manager to refer to footpath at details attached and say

(1) who/what utilities area responsible for the condition of the footpath

(2) if he will arrange to have same repaired as soon as possible as there is a serious danger here for pedestrians

(3) whether or not it is a problem with repairing the surface or if the problem is a more serious one as residents feel there is more to the job than just surface work

Reply:

(1) Not known

(2) & (3) There is a small utility opening (utility unknown) in the macadam portion of the path outside (details supplied). Arrangements will be made to have it permanently reinstated within the next 8 weeks. The remainder or the footpath is in a safe condition.

Q.6 Question in the name of Councillor Sean Paul Mahon.

“That a report be presented regarding the heating arrangements in place in a new senior citizens complex in the North Central Area (details supplied) having regard to a complaint by a tenant that the water is still not hot enough for a shower by 7.45am each morning. This tenant must leave his flat by 7.15am most mornings for a hospital appointment”.

Reply:

This new complex originally had extended Heating and Hot Water services as a temporary measure in order to service requirements for specific residents at the time of taking possession of the premises.

The services time schedules were eventually returned to the standard time schedule of 06.00 to 23.00

The residents subsequently requested an extension to the Heating time to 24.00. By agreement, the Heating time schedule was changed to 07.00 to 24.00 maintaining the same number of operational hours. However, the Hot Water time schedule was left unchanged.

This new arrangement exposed a defect in the system timing controls where the Hot Water system would not activate unless the Heating system was already on.

This defect has been rectified by the contractor and the systems are now working independently of each other.

The tenant at (details supplied) was contacted by the Mechanical Inspector, on Wednesday 14 January, and the tenant confirmed that he was now satisfied with the Hot Water arrangements

Q.7 Question in the name of Councillor Anthony Creevey.

To ask the Manager to refer to the front garden/railed in area of dwelling at (details supplied) which is strew with over flowing refuse sacks, bins and general rubbish and say

(1) If the owner/landlord is registered as a landlord with the City Council

(2)  What enforcement action can be taken against the owner/landlord in this instance as the area is now a health hazard with rubbish etc having been left there for over 4 months which is now falling out onto the public footpath

(3) If he can arrange to have the rubbish/refuse bags etc removed from (details supplied) as soon as possible due to the public health hazard it presently poses

(4) What action if any can be taken against the tenants of the dwelling to ensure that no further littering of the public pathway occurs.

Reply:

1)  The property at (details supplied) is not registered on the Private Rented Dwellings Register. Arrangements are being made to have the rented property inspected under the Housing (Standards for Rented Houses) Regulations 1993. Any appropriate action will follow this inspection. This matter is being dealt with by Marie McCaffrey, Environmental Health Officer Tel: 6723977

2) & 4) The Waste Management Division believe the problem relates to No. 30 (details supplied), and the litter is blowing into no. 29. Numerous efforts to contact the owner of this property have been made without success. The individual (details supplied) was contacted at the telephone number quoted and denied being the owner of the property. This matter is the subject of ongoing investigation with a view to taking appropriate legal action.

(3) Waste Management Services had the rubbish and refuse bags removed from the railed in area fronting (details supplied) on the 8th January 2004.

“Can the Manager say what assistance the city council can give the organisation.”

Reply:

Dublin City Council staff will provide assistance to any group involved in the Tidy Towns Competition by providing gloves, brushes and litter bins. Staff will also assist with “clean up” days and small quantities of flowers and shrubs can be provided to enhance the area. Extensive co-operation has taken place with (details supplied) over the recent years and will continue into the future.

Q.9 Question in the name of Councillor Ger Dorgan.

“To ask for an update on the laneway to the rere of 201-210 Clontarf Road, Clontarf, Dublin 3 and for a report on the implications of the proposed extinguishments? Is the manager aware of objections to this plan?”

Reply:

Progress on the above application is as follows:

We are awaiting response from a small number of service checks.

We have not yet reached the final date for receipt of objections which is the 20th January 2004. We are also awaiting a (forthcoming) commitment from residents that 24 hour access will be provided to Utilities and that residents will undertake the maintenance and upkeep of the laneway following closure. There have been no extraordinary delays to date with this application.

The implication of closure would mean controlled access by way of gates for residents, i.e by means of a lockable gate with keys provided to users (residents) requiring access and Utilities/Services as required. The closure once effected should have the effect of severely limiting if not eliminating anti-social behaviour. An added implication is that it will require that residents undertake the upkeep and maintenance of the laneway once closure is effected.

Q.10 Question in the name of Councillor Ger Dorgan.

“To ask the City Manager and Housing Department to give the maximum advice, support and assistance to this person on the waiting list. (details supplied) and to make this case a priority issue?”

Reply:

The applicant at (details supplied) is on the Housing List with a total of 70 Points for Area H (Ballybough/Dorset Street/DominickStreet/East Wall/Sheriff Street) and 65 Points for Areas E (Ashtown/Santry/Whitehall/Finglas/Glasnevin) and B (Artane/Kilmore/Marino/Beaumont/Darndale/Donnycarney/Kilbarrack). At present the points awarded to the applicant for Areas B and E are not sufficient to be considered for an offer of accommodation in these areas.

The points awarded to the applicant for Area H are reasonable to be considered for an offer of accommodation in this area should a suitable vacancy arise. Perhaps the Councillor might wish to suggest to the applicant that he contacts the North West Inner City Office, Dorset Street – Telephone No: 8736500 in relation to his application for housing in this area. It should be noted however, that there are other applicants on the List with priority or with similar or higher points who would also have to be considered for an offer of accommodation in this area.

The Councillor may also wish to advise the applicant to call and discuss their housing application with one of our Housing Advisors who are available in the Civic Offices from Monday – Friday 9.30 -4 p.m. where every assistance and advice will be offered to the applicant.

“To ask the Manager and Dublin City Council for an update on any new

plans in 2004 for the Artane Area, Dublin, particularly in relation to:

(a) trees and plants

(b) re-cycling

(c) services for the elderly and

(d) traffic claming.”

Reply:

(a)  Parks and Landscape Services Division propose to carry out roadside tree replacement planting where required in the Artane area, in the period of the current tree planting season.
