Council Meeting – September 20, 2012

Mayor Thomas L. Hardesty called the regular council meeting to order at 6:30 p.m. with the following council members present: Alan Matthews, Donna Eaton, Jon Swindler, Shane Suttor, and Frank Page. Absent: Mike Zoeller

City Employees Present: Jennifer Herrell, Bryan Slone, Kevin Calvert, and Inez Harris.

City Attorney: Steven Gregory

Councilmember Eaton gave the invocation.

All present pledged allegiance to the flag.

Minutes – September 6, 2012

Councilmember Matthews moved to approve the minutes of the September 6, 2012 meeting as read by council members prior to the meeting. Seconded by Councilmember Page.

All voted “aye” and motion carried.

Ordinance No. 2012-09-20 – An Ordinance Annexing Property owned by Speedway LLC and located on Mt. Eden Road to the City of Shelbyville – 2nd Reading – Steven Gregory

Steven Gregory, City Attorney, read the summary of an ordinance annexing property owned by Speedway LLC into the city limits. This property is contiguous to the City of Shelbyville and is suitable for urban purposes without delay.

It was introduced for second reading by Councilmember Swindler. Seconded by Councilmember Matthews.

Upon roll call, the following council members voted “aye”: Page, Swindler, Suttor, Eaton, and Matthews. Absent: Councilmember Zoeller.

Ordinance No. 2012-09-20(A) – An Ordinance Amending Chapter 70 of the City of Shelbyville Code of Ordinances Relating to Building Permit Fees – 2nd Reading – Steven Gregory

Steven Gregory, City Attorney, read the summary of an ordinance amending Chapter 70 Relating to Building Permit Fees. This ordinance will increase R-3 and R-4 from $0.05 to $0.14 per square foot with a $50.00 minimum fee. It will also add swimming pool fees and a local permit fee.

It was introduced for second reading by Councilmember Suttor. Seconded by Councilmember Page.

Ordinance No. 2012-09-20(B) – An Ordinance Amending Chapter 32 of the City of Shelbyville Code of Ordinances providing for Post Development Stormwater Management – 2nd reading – Steven Gregory

Steven Gregory, City Attorney, read the summary of an ordinance amending Chapter 32 of the City of Shelbyville Code of Ordinances for Post Development Stormwater Management with additional provisions and gives the EPA authority to regulate storm water by the authority of the Clean Water Act.

It was introduced for second reading by Councilmember Page. Seconded by Councilmember Eaton.

Upon roll call, the following council members voted “aye”: Page, Swindler, Suttor, Eaton, and Matthews. Absent: Councilmember Zoeller.

Bid Approval – Street Paving

Mayor Hardesty read the bid results for the 2012 street re-surfacing project. The lowest bid was from Flynn Contracting with a bid of $142,226.20.

Councilmember Swindler moved to approve Flynn Contracting for the 2012 street re-surfacing project. Seconded by Councilmember Suttor.

All voted “aye” and motion carried.

This project will include West View Drive, Comanche Drive, 870 ft. of Seneca Road, Kentucky Street from the railroad to North 10th, Kentucky Street from Aspen Way, Third Street North of Washington, and Kentucky to Henry Clay.

Weather permitting this project should be completed by November 12, 2012.

Appointment/Wayne Long to the Triple S Board of Adjustments and Appeals for a 4 year term expiring October 1, 2016.

Mayor Hardesty recommended Wayne Long be appointed to the Triple S Board of Adjustments and Appeals for a 4 year term ending October 1, 2016.

Councilmember Matthews moved to approve the appointment. Seconded by Councilmember Page.

All voted “aye” and motion carried.

Public Comments

Mr. Carl Meyer, a resident of Brassfield Subdivision, addressed council asking if a traffic light could be installed at the intersection of Harrington Mill Road and Freedom Way. He had a friend that was badly injured by a car traveling nearly 60 m.p.h.

Mayor Hardesty will ask the city engineer to look at the intersection and will write the state regarding this situation.

Councilmember Matthews ask Mayor Hardesty to request the State to reduce the speed on Smithfield Road to 35 m.p.h.

Department Reports

Inez Harris, City Clerk/Treasurer, reported 2012 property tax bills have been mailed. Citizens have until November 30, 2012 to pay without penalty and interest.

Bryan Slone, Golf Pro, Weissinger Hills Golf Course, reported there will be a “Battle for Blake” Fundraiser on September 21st. The course is undergoing fall maintenance.

Mayor’s Report

Mayor Hardesty reported the Employee Banquet is September 25th at the Stratton Center. Red Orchard Park will have a grand opening of the new Fitness Trail at 4:30 p.m. on September 24th. Exercise equipment was donated. Great car show and band concert last weekend. It was the last concert of the season. A letter of appreciation regarding Officer Donahoe was received and will be placed in his personnel file.

Councilmember Page moved to adjourn the meeting at 7:05 p.m. Seconded by Councilmember Suttor.
