NRL FOOTY SHOW – LEAGUE OF THEIR OWN COMPETITION (“COMPETITION”)

These rules (as changed or supplemented by Nine from time to time in its discretion) will apply for the clips competition of League of their Own to be conducted by Nine and incorporated into the television program known as The Footy Show (Program).

CONDITIONS OF ENTRY (“THE RULES”)

1) Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions

2) By submitting an entry in the Program, all Entrants warrant to the Promoter that each visual entry media submitted is an original artistic work of the entrant which does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against any and all claims, loss, damage and costs arising from a breach of the warranty set out in this condition.

3) All entry media submitted becomes the property of Nine Network. As a condition of entering into this promotion, each entrant agrees to assign all of their present and future rights, title and interest (including copyright) in and to their entries to the Nine Network Australia Pty Ltd.

4) The Promoter will not be liable for any breach of copyright. The entrant will be solely responsible for their own entry and the consequences of submitting them. The entrant represents and warrants that:

Their entry is their own and:

a) they own or have all necessary licences, rights, consents and permissions to use and authorize the promoter to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all entries to enable inclusion and use of the entries in the manner contemplated by these terms and conditions; and

b) they have the written consent, release, and/or permission of each and every identifiable individual person in the entry (including if the individual is a child, the consent of the child’s parent or legal guardian) to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of the entry in the manner contemplated by these Terms and Conditions.

5) All decisions relating to the conduct of the Program and Promotion, including, but not limited to, the selection of any and all parts of an entry to be broadcast, and the awarding of prizes, are at the sole and exclusive discretion of Promoter and are final and not subject to appeal. The judge’s decision in relation to any aspect of the promotion is final and binding on every person who enters. No correspondence will be entered into.

6) Failure to comply with any term or condition may result in disqualification and/or forfeiture of Prizes at the Promoter’s sole discretion.

7) This is a game of skill and chance plays no part in determining the winner/s. Each entry of the Competition will be individually judged based on, but not limited, to talent, entertainment, creative merit and the number of votes that an entry receives from the public. Short-listed entries (as determined by the judges in accordance with term 28) will be open to online public voting through the Program’s competition tab which is accessed on the Program’s Facebook page. For the avoidance of doubt, the judges will only consider votes received as one of the criteria for judging the best entry. The public voting is not determinative of the winner.

8) The Competition entry can include but not limited to tries, goals, tackles or other moments during or involving an NRL match, training or activity that are deemed to be of high excellence, humour or general entertainment to viewers. All decisions made by the promoter will be deemed final.

9) The promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook.

ELIGIBILITY

10) Entry is open to all residents of Australia except employees of the Promoter and their immediate families, associated or otherwise connected with the prize suppliers. Entrants under 18 must seek parental or legal guardian consent to enter.

11) At the Promoters absolute discretion, any entries which have previously been broadcast on the Program prior to 2nd April 2015 are not eligible entries into the Promotion.

METHOD OF ENTRY

12) To enter, Participants must record a 90 second video for the League of their own competition. Entries must be submitted by either:

Entrants must include their full name, address, daytime telephone number with their entry.

Entries submitted online:

Entrants must go to and follow the prompts to the competition page and fill in the entry form including their full name, age group, address, daytime telephone number and upload their video where indicated and submit their entry as instructed.

All files must be in MP3, MP4 or Video format

Entries must be limited to 90 seconds maximum length video

AND must not be:

  • Late;
  • Delayed;
  • Incomplete;
  • Incomprehensible;
  • Unlawful;
  • Obscene;
  • Defamatory;
  • Libelous;
  • Threatening;
  • Pornographic;
  • Harassing;
  • Hateful;
  • Racially or ethnically offensive;
  • Capable of encouraging of conduct that would be considered a criminal offence;
  • Capable of violating any law; or
  • Capable of giving rise to civil liability.

13) The Promoter accepts no responsibility for late, lost or misdirected entries, or entries not received by the Promoter for any reason whatsoever.

14) Entrants should not send in original copies/master copy of their DVD's. No responsibility will be taken by the promoter in the event that the original entry is lost or damaged in editing. It is the entrant’s responsibility to ensure that they do not send in original copies/master copy of their DVD's as entries will not be returned.

15) Multiple entries are permitted, but each entry must be unique and submitted individually.

16) Entry is free, however postage fees may apply. Postage fees vary and are subject to the location of the sender and the Australia Post rate of postage at time of sending. Entrants are advised to contact Australia Post for rates of postage at the time of sending.

17) Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

18) The Entrant acknowledges that the Promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry. Any editing done (including but not limited to creative control) by the Promoter will be done at the complete discretion of the Promoter.

19) The Entrant acknowledges that their entry may be communicated on the internet and broadcast on the Nine Network together with the entrant’s name. The entrant acknowledges and agrees that the Promoter has the right to exploit the entry in any manner, in any media worldwide at any time.

20) The Entrant acknowledges that the Promoter will determine the time and date of broadcast of the entry, if any, at its absolute discretion.

PROMOTION PERIOD

21) The Promotion commences on Thursday 2nd April 2015 at 21:30 AEDT and final entries close Thursday 10th September 2015 at 15:00 AEST (Promotion Period). Judging will take place at the Nine Network’s premises at 24 Artarmon Road Willoughby, NSW 2068 throughout the Promotion Period. Winners will be notified by phone or mail and on-air.

22) No responsibility accepted for late, lost or misdirected entries. Incomplete, inaudible or indecipherable entries will be deemed invalid.

23) For the removal of doubt, entrants only need to submit their entry once for it to be considered for the entire Promotion Period.

24) Entries will be split into a junior category for entrants 12 years and below and a senior category for entrants 13 years and above. All entries received from the date that the Promotion commences until the closing date of the Promotion will be eligible to win the weekly prize. The Promotion judging periods are as follows:

a) Entries will be made available for public voting each Thursday from 17:00 AEST/ADEST (Voting Open Time) during the Promotion Period with the first public voting of entries to commence on Thursday 9th April 2014.

b) Public voting will close the following Thursday each week during the Promotion Period at 16:00 AEST/ADEST.

c) Judging will take place each Thursday during the Promotion Period at 17:00 AEST/ADEST. The first judging date will be on Thursday 16th April 2015 at 17:00 and each week thereafter until the close of the Promotion.

d) All weekly winners will be announced during the Program.

25) All entries received until 2 hours prior to the Voting Open Time each week will be eligible to be selected as the short-listed entries in accordance with term 28. For the removal of doubt, this includes any entries received in previous weeks but which were not selected as a weekly finalist. If you do not wish for your entry to be carried over into any judging period, please notify the Promoter in writing prior to your entry being broadcast.

26) In the event that the scheduled episode is not broadcast at all during a week, the Competition will not be commenced or announced to viewers and the prize for the Competition will not be awarded. In the event the broadcast time for a scheduled episode is changed, the Competition start and end times for those episodes will be moved in line with the new broadcast times for that episode. The total time available for viewers to enter will remain the same, with the close time being advised during the broadcast.

27) All entries are deemed to be received at the time of receipt by the Promoter and NOT at the time of being sent by the entrant.

JUDGING AND PRIZES

28) Prior to the Voting Open Time the judges will select a short list of four (4) entries which are deemed to be best entries based on entertainment, talent and creativity. These four (4) entries will be opened to public voting as per clause 24.

29) The best (1) valid entry, as per the criteria stipulated in clause 7, from each of the Junior (12 years and below) and Senior category (13 years and above) as determined by the judges will be deemed the weekly prize winners and will each win:

  • 1 x Xbox 360 4GB console valued at $188
  • Xbox LIVE 3 Month Gold Subscription valued at $29.95

The total prize pool for each individual draw is valued at $217.95 RRP. Prizes do not include any ancillary costs associated with redeeming the prize. These are the responsibility of the winner.

30) All weekly winners from the Junior and Senior categories will be entered into the Grand Final Judging. The best (1) valid entry as judged by the Promoter, as per the criteria stipulated in clause 7, from each of the Junior and Senior categories as determined by the judges will be deemed the grand final prize winners and will each win a cash prize of $20,000.

31) The Grand Final Judging will take place at 17:30 on 30th September 2015 and each grand final winner from the Junior and Senior category will be announced during the broadcast of the Program on the 1st October 2015.

32) The Promoter will broadcast at least two (2) weekly entries per episode of the Program.

33) Entries not completed in accordance with the Conditions of Entry or received after close of entry will not be considered. Incomplete entries will be disregarded. The judge’s decision in relation to any aspect of the Promotion is final and binding on every person who enters. No correspondence will be entered into.

34) Liability for any tax arising out of participation in this promotion (including acceptance of a prize) is the sole responsibility of the entrant. Entrants should seek independent financial advice in this regard.

35) It is a condition of accepting the prize that the winner may be required to sign a legal release in a form to be determined by the Promoter in its discretion Liability for any tax arising out of participation in this promotion (including acceptance of a prize) is the sole responsibility of the entrant. 36) Both grand final winners will be on on Monday, 5th October 2015.

GENERAL CONDITIONS

37) In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster)the Promoter reserves the right to subject to reference to all relevant state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.

38) It is a condition of entry that all entrants agree acknowledge that by virtue of participating, their recording, images, voices, and any or all part of their entry may be put live on air during the Program and consent to such recording and airing. Entrants acknowledge that although there is no obligation upon the Promoter to use such recording(s), images or footage, if the Promoter elects to do so, the winner consents to the Promoter using their name, image, likeness and/or voice in any media for the purpose of promoting this competition, (including any outcome), The Program or the Promoter itself, for an unlimited period of time without remuneration.

39) If in Promoter’s sole discretion an exigent circumstance has occurred, the Promoter reserves the right to reschedule a Weekly Winner to a future episode of the Program.

40) Any Entrant who provides incomplete or incorrect information may be disqualified.

41) Any person attempting to defraud or in any way tamper with the Program or any aspect thereof, will be disqualified and may be subject to both civil and criminal proceedings and may also be prosecuted to the full extent of the law.

42) If for any reason the Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of the Program, the Promoter may suspend or end the Promotion, and reserves the right to:

  1. disqualify any individual who tampers with the entry process; and
  2. re-do any part of the Program again.

43) All Participants acknowledge and agree that they have no claim against the Program in the event that (i) and/or (ii) occur.

44) The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process

45) Entry details remain the property of the Promoter. Entrants’ personal information will be collected by the Promoter for the purpose of conducting and promoting this Competition (including for the purpose of identifying and notifying winners). Without limiting the foregoing, the Promoter may disclose entrants’ personal information to other parties assisting in the administration of the Competition including to the Promoter’s related entities, prize suppliers, external service providers and authorities that regulate this Competition. If the entrant consents, the Promoter, its related entities and business partners (as applicable) may also use the entrant’s personal information for the purpose of sending direct marketing messages with respect to programs, products and services available through any or all of them. Nine will handle the entrants’ personal information in accordance with Nine’s Privacy Policy which is available on its website. 46) The promoter is not responsible for any error, omission, interruption, deletion, defect in operation or transmission, communications line failure, theft, destruction or unauthorized access to, or alteration of entries occurring in relation to the conduct of the Promotion.

47) Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these conditions of entry; (e) any tax liability incurred by a winner or entrant; (f) participation in the promotion and/or (g) redemption of the prize.

48) The Promoter reserves the right to review these Conditions of Entry at any given time and the Conditions of Entry for any given episode will be governed by the most recent version of these Conditions of Entry as available prior to recording and/or broadcast of that episode of the Program.
