The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend theConveyancers (Qualifications, Experience andFees) Regulations 2008 to prescribe new competency qualifications for the purpose of section 12 of the Conveyancers Act 2006.

2Authorising provision

These Regulations are made under section 188 ofthe Conveyancers Act 2006.

3Prescribed qualifications for conveyancers

In regulation 5 of the Conveyancers (Qualifications, Experience and Fees) Regulations2008[1]—

(a)before paragraph (aa) insert—

"(aaa)successful completion of each of the following units of competency set outin the BSB - Business Services Training Package published on the website Training.gov.au maintained bythe Commonwealth as in force fromtime to time—

(i)BSBCNV501Take instructions inrelation to a transaction;

(ii)BSBCNV502 Read and interpret alegal document and provide advice;

(iii)BSBCNV503 Analyse and interpret legal requirements for atransaction;

(iv)BSBCNV504 Prepare legal documents;

(v)BSBCNV505 Finalise the conveyancing transaction;

(vi)BSBCNV506 Establish and manage a trust account;

(vii)BSBCNV601 Identify and conduct searches;

(viii)FNSORG601 Negotiate to achieve goals and manage disputes;";

(b)in paragraph (aa), after "successful completion" insert ", by 20 July 2016,";

(c)in paragraph (b), for "paragraph (aa)(vi) or(a)(iii)" substitute "paragraph (aaa)(vi), (aa)(vi) or (a)(iii)";

(d)in paragraph (d), for "paragraph (aa)(vi) or(a)(iii)" substitute "paragraph (aaa)(vi), (aa)(vi) or (a)(iii)".
