I, ______, knowing the risks associated therewith, voluntarily agree to participate in the "CaliforniaFitness Challenge" (CalFit Challenge) competition, a weight loss/fitness program (“Event”) to take place at the following locations:

I, understanding the risks associated with the Event, hereby agree to waive and release Accenture and assume the risks associated with the Event, and agree to indemnify and hold Accenture harmless from any and all claims, suits, or other causes of action of any kind or nature, and any damages or other liabilities associated therewith. I acknowledge that I have been advised that prior to commencing any physical fitness program, including without limitation my participation in the Event, that I should consult with my physician. It is further understood and agreed that this release, which shall constitute a legally binding agreement, shall also apply to my heirs and assigns. This release is intended to discharge in advance Accenture and/or any other entity within or affiliated with Accenture from and against any and all claims and liabilities arising out of or connected in any way with the Event. I expressly and specifically waive all rights under the provisions of Section 1542 of the Civil Code of the State of California and any similar rights in any state or territory in the United States and any similar statute or regulation of the United States and or of its agencies. Section 1542 of the California Civil Code provides as follows:

“A general release does not extend to claims which the creditor does not know or expect to exist in his favor at the time of executing the release which, if know by him must have materially affected his settlement with the debtor.”

I understand that this release shall be governed by and construed in accordance with the laws of California. I hereby consent and submit to the exclusive jurisdiction of the Courts of California with regard to any dispute arising out of this release.

I understand that the information provided by me regarding my actual weight and body measurements will be kept confidential and only my name, participation in the Event, my percentage results (% of weight lost, % of inches lost) and my progress throughout the Event will be available to the competition’s coordinators and other participants.

To the extent a portion of this release is held to be unenforceable, the remainder will be deemed enforceable to the extent permitted by law.
