VendoragreestoremittoEventFest,Inc.a concessionaire’sfeeof$1,500.00(Onethousandfive hundreddollars) PERLOCATIONagainst30%*of sales(whicheverisgreater). All insurance certificates indicating coverage as required per Item (5) of this contract shall be remitted at the time of original application. All fees should be remitted via cashier’s check or money order made payable to EventFest, Inc. and forwardedto:

Note: Location(s) cannot exceed10x20.Largerlocationswillrequireadditionalfees.

1.)EventFest,Inc.shall havetherighttoinventoryallconcessionproductssuppliedbyvendortoassistin accuratelydeterminingthe grossrevenueearnedbyVendor.Vendormustsupplyenoughproductstomaximize revenuesfortheevent.

2.)EventFest,Inc.reservestherighttoconducttherandom“spotaudits”ofVendorsinventory,cashreceipts,and

POSregisterreadings.

3.)Vendorsalesoutlet(s)willbelocatedonlywithinspacesspecificallydeterminedbyEventFest,Inc. management.Locationsaresubjecttochange,atanytime,atthediscretionofEventFest,Inc.the2017Children’s GasparillaExtravaganza,orGovernmentauthorities.Vendorshallnot setuporparkonCityRightofWayunless the RightofWayhasbeenclosedbythe CityMOT(MaintenanceofTraffic)fortheevent.

4.)Vendoragreestoexclusivelysell sponsorproductsifsorequiredbyEventFest,Inc.Vendorisresponsiblefor supplyingitsownpersonnel,tables,chairs,equipment,andsignage.Vendorshallberesponsiblefortheobtainment ofallhealthpermitsandoccupationallicensesrequired.Vendoragreestoabidebyallcity, stateand federalrules andregulationsapplicabletoitsactivitiesat the 2017Children’sGasparillaExtravaganza.

5.)Vendor,atitssolecostandexpense,shallprocure, maintain,andcarryinforcethroughoutthetermofthis Agreementthefollowinglevelsofinsurancecoverage.Thiscoverageneedstobewitha carrierlicensedintheState ofFlorida.CurrentcertificatesofinsurancemustbeprovidedtoEventFest,Inc. andmaintainedatalltimesduring thisAgreement.

Worker’s Compensation: VendorshallprovideWorker’sCompensationforallemployeesatthe sitelocation.Thelimitsshallbe statutoryforallWorkers’Compensation.

GeneralLiability,VehicleGeneralLiabilityComprehensiveCoverage,andProductLiability InsuranceCoverage:Vendorshallprovidecoverageforalloperationsincluding,butnotlimitedto, Contractual,andProducts andCompletedOperation.Thelimitsshall notbelessthan $1,000,000.00(Onemilliondollars)/claimandminimum of$2,000,000.00(Two milliondollars)aggregate,CombinedSingleLimit(CSL)personalinjuryand/orproperty damage,oritsequivalent.

Vendorshall,priortotheeventindicated,provide EventFest,Inc.witha certificateofinsuranceindicatingthatthe Vendorhasvehiclegeneralliabilitycomprehensivecoverage,as wellasproductandgeneralliabilityinsurance coveringanyandalldamagescausedbyVendoror hisemployees,equipment,orproductsinanamountequalto

$1,000,000perclaimandminimumof$2,000,000aggregate.Vendoragreestoindemnifyandholdharmless EventFestInc.,YeMysticKreweofGasparilla,CityofTampa,the2017 Children’sGasparillaExtravaganza,and anyandall “Title”and“Presenting”eventsponsorsfromanyandalllossordamagetoVendor,Vendor’s employees,customers,oranyotherperson(s)attributabletoanyactoromissionofVendor and list them as additional insureds.

6.)ThisAgreementshallbevoiduponassignmentorattemptedassignmentbyVendor.EventFest,Inc.

reservestherighttoterminatethisAgreementforanyofthefollowingreasons:Vendorsells,orattemptsto sell,any product,or serviceotherthanthosespecifiedabove,orbreachesanyofthetermsorconditionscontainedinsaid Agreement,ortherulesandregulationsoftheeventstated.IntheeventEventFest,Inc.terminatesthisAgreement, Vendorshallimmediatelyceaseanyactivitiesandremoveallequipment,personnel,andotherpropertyand forfeit anyfeespaidtoEventFest,Inc.hereunder.

7.)No vendorshallbepermittedto sellanystyrofoamor glassproducts,snap n’pops,sillystring,

or sprayurine.Sponsorproductsmustbe sold whereapplicable.Notentstaking,nocharcoaluse,andnooil dumping.Anoilcontainerwillbeonsiteforyour useatthe mainofficelocationoryoucantake withyou. SecurityDepositwillbewithheldforanyvendorsitewithoildumping.

8.)VendorsmayreceivefoodticketsissuedbyEventFest,Inc.for usebyCity workersand/orpoliceandcity officials.Theseticketswillhavea clearfacevalueandaretobeexchangedforfoodorbeverageitems accordingly. Nochangeshouldbeissuedif fullfoodticket valueisnotutilized.Vendorsshallturninallsuchfoodtickets collectedwithVendorSettlementSheetand%of salesduetoEventFest,Inc.
