COMMUNITY RULES AND REGULATIONS OF

SOUTH PARK MOBILE HOME COMMUNITY

The Owners of the South Park Mobile Home Community (hereinafter the “Park”) have adopted the following Rules and Regulations concerning all residents’ use and occupancy of the Park to protect and preserve the Park from abusive use or deterioration, to ensure its residents a safe, convenient and attractive community in which to live, and to make a fair distribution of services and facilities held out for the residents generally. Enforcement of these rules is by Management, or authorized representatives, of the Park.

If you are an existing Resident of the South Park Mobile Home Community, these Amended Rules and Regulations Shall go into effect sixty (60) days from the date Notice of the Amendment. See C.R.S. Sec. 38-12-203(c)

FAILURE OF THE RESIDENT OR THE RESIDENT’S GUESTS TO COMPLY WITH PARK RULES AND REGULATIONS SHALL BE CAUSE FOR TERMINATION OF TENANCY

1. REGISTRATION. All residents and overnight guests must be registered at the Park office. This is necessary in case of an emergency, prompt delivery of mail, phone calls, etc., and to provide reasonable security for Park residents. An emergency contact for each resident is required to be on file at the Park office.

2.  VISITORS. Visitors’ length of stay should not be more than fourteen nights within any three-month period. Additional visitation time requires a written request and written Park approval. Any adult staying longer than 14 consecutive days is considered an unauthorized resident and needs to be placed on the lease (all such persons need to pass a criminal background check just as any other Park resident and will not be allowed to stay if they have felonies and certain misdemeanors on their record). Visiting children in the Community must be accompanied AT ALL TIMES by the sponsor or resident residing in Park. All overnight guests MUST be reported to the park office.

3. BUSINESSES. No commercial enterprises or businesses shall be conducted within the Park without prior written approval of Park management. Residents may not, under any circumstances, operate any kind of daycare or child care business within the park, whether for profit or volunteer.

4. SUBLETTING. No homeowner may sublet or rent his or her mobile home. All homes are to be occupied by the owner and persons specifically approved for residency in the Park by the management.

5. RENTS. Rent is based on a maximum of (2) persons per space, and shall be increased by $50.00 per month for each additional person. Failure to register additional persons with the Park office shall be considered a violation of these Rules and Regulations. Rent shall be pro-rated, upon moving in, to the first day of the following month. Rent is due by noon, the first day of each month, and is delinquent after 5:00 P.M. on the fifth day of the month.

6. CONDUCT. Drunkenness, obstructive or abusive conduct, loud radios, television, unannounced parties or any other excess noise is not allowed. Conduct which constitutes an annoyance to or harassment of other Residents or their guests, or which constitutes abuse or harassment of Park management or employees, or which interferes with Park management in the performance of its duties, shall be cause for termination of tenancy. Residents will be responsible for conduct of their guests, and for any damage caused by their guests. Conduct of any guests in violation of these rules or the lease will be a cause for termination of the Residents’ lease. Residents are expected to report incidents of inappropriate behavior, annoyance or harassment by other Residents or their guests to the Park’s managers and are not to take matters into their own hands. The Park cannot address issues not brought to the attention of its management.

PEACE AND QUIET: Residents are entitled to the peaceful enjoyment of their lot and all Park facilities. Radios, TV’s, stereos, musical instruments or any other conduct that may cause annoyance must be kept reasonably low, so as to be heard only in your own home. No large outside activities after 10:00 P.M. -NO EXCEPTIONS-

Loud parties, intoxication, fighting, immoral conduct, use or sale of illegal substance under Federal law will not be tolerated.

7. DEPARTURE. Advise the Park at least thirty (30) days in writing before moving, and check out at the office before leaving the community. When leaving the Park for an extended period for vacation, etc., inform the office so that emergency mail processing and rent payments may be properly handled.

8. TRAFFIC and SPEEDING. The speed limit in the park is 10 m.p.h. All Posted traffic signs and speed limits must be obeyed at all time. This applies to guests, as well as Residents. Actions of the guest are the responsibility of the host Resident and it is your responsibility to educate yours guests regarding the rules and regulations of the Park. Speeding fines of no less than $50 per violation may be assessed. Excessive speeding, careless or intoxicated driving activity within the Park is a serious safety concern and a single significant violation in the judgment of Park Management, or repeated lesser violations, may lead to termination of your lease.

Management will make all reasonable efforts to keep Park roads passable year-round. No tenant has the right to alter or obstruct the construction, repair, or clearing of the road. All roads are private roads for the use of residents and their invitees, and management only.

9. AUTOMOBILE REPAIRS. No major overhauls of vehicles are allowed. Minor repairs that can be completed in one day, and which will not result in oil spills or unsightliness while repairs are in progress, may be accomplished with prior written Park approval. Oil changes, transmission fluid changes, and/or antifreeze changes are not allowed.

10. SOLICITING. No soliciting, delivery of handbills, peddling, or any commercial enterprises are allowed without the permission of management.

11. SANITATION. We are cooperating with Tri-County Health Department to make the Community a clean, sanitary, and pleasant place to dwell. Trash and garbage will be disposed of in the dumpsters provided by the Park. Individual outdoor garbage containers are not allowed.

12. UTILITY CONNECTIONS. The Park shall provide proper water, sewer, electrical and gas connections to each occupied site. The Resident shall be responsible for proper, safe and complete installation of services from these connections to the home. Water connections must include proper freeze protection, such as heat tapes, which shall be installed and maintained by all residents of the Community, subject to approval by the Park. Do Not Tamper with any gas or electric utility connections. In the event of a utility connection malfunction, contact the Park office.

13. MAINTENANCE OF SPACE. It is the Responsibility of Each Resident to Maintain Their Lot. Lawns must be properly watered, mowed, trimmed, fertilized and weed controlled. Storage under the home must not create a fire hazard, nor can it interfere with access to the utility connections. Especially prohibited are construction items and vehicle parts. Changes to lots, such as additional shrubs, trees, plantings, exterior buildings, or any other improvements must be approved in writing by Management. All new plantings become the property of South Park.

Lots, including carports and porches must be kept clean and free of trash and clutter.

The resident is responsible to keep the parking area of his lot, sidewalks, etc., cleared of snow and ice.

14. DIGGING. No digging in yard can be done except with the prior written consent of the Park in its sole and absolute discretion, because damages can occur to utility lines and pipes. Notwithstanding such approval, any damage caused to the property of the Park, other residents, guests or otherwise shall be the sole responsibility of the Resident.

15. MAINTENANCE OF HOME. The exterior of the home and its surroundings shall be maintained on a continuing basis to ensure an attractive appearance. Notice of needed improvements will be issued by Management if necessary. Patio areas shall be kept clean and neat and storage of items other than lawn furniture shall be restricted around the home. Proper skirting shall be installed within thirty (30) days of moving a home into the Park.

INTERIOR HOME MAINTENANCE ISSUES: The Residents own and maintain their own homes. The Park’s managers are strictly prohibited from performing any maintenance or repair on the Residents homes. Park management may be able to provide you contact numbers for local service providers.

16 LAUNDRY. Hanging of clothes outside the home is not permitted. There is a clothesline area North of the laundry building. Those using the community laundry must remove clothing from washers and dryers as soon as processing has been completed. Washer and dryer must be cleaned after each use. The load limit is four. Report any machine malfunction to the office. No smoking or alcoholic beverages allowed in the laundry facilities, or ANY Park building.

17 PARKING. Parking is limited within our community; therefore, vehicles must be parked in assigned parking areas. All vehicles MUST have a valid parking pass issued by the park office (no exceptions). Each lot shall have at least one (1) parking site. Two (2) sites will be available where possible. Two (2) vehicles allowed per unit. Absolutely no recreational vehicles, boats, trailers, trucks, vehicles larger than pickups, or commercial vehicles shall be parked within the Park for longer than seventy-two (72) hours, or for any portion of more than three (3) days during any week, with Park Management’s written permission. The Park may grant limited exceptions to this Rule including, but not limited to, light-duty RV tow vehicles and car tow dollies, however, such approval must be obtained in writing from Park Management. Parking along the fence South of South Drive is restricted to Park approval. Improperly parked vehicles will be towed at owner expense!!!

18.  CARPORTS AND OTHER STRUCTURES. Carports, sheds and other structures cannot be constructed without the

specific written approval of Park management. Management will not approve the construction of carports which are fully enclosed on three sides. Designs and plans must be submitted for written approval. If approved, such structures must be constructed only according to the approved plans. Variance from the approved plans will be considered a violation of this lease. The Park allows absolutely no construction of room additions to be added on to any mobile home or recreational vehicle including, but not limited to, enclosed porches, gazebos, tents, canopies or similar structures.

19. GUEST PARKING. Guests are to park on streets, rather than in residents’ driveways.

20. PETS. No dogs, snakes or uncaged animals are permitted in the Park at any time. Cats are allowed if kept indoors at all times. Free roaming cats will be trapped and transported to an animal shelter. Any pet litter or waste must be disposed of in the trash and not into a toilet. If pet litter or waste is determined to be the cause of sewer line stoppage, the resident found responsible will be billed for the cleaning costs.

21. RECREATION HALL. The users of the recreation hall are responsible for cleaning up after use. Place trash in containers provided, wash and replace dishes and utensils, wipe up spills, and pick up items dropped. Vacuum is provided in hall closet. Children under eighteen (18) are not allowed on pool tables. Children and/or guests of residents must be accompanied by that resident when using the recreation hall. Absolutely no smoking or alcoholic beverages are allowed in this building. The Recreation Hall is for the use and enjoyment of all Residents and their guests and no Resident or guest has the right to to prohibit another’s use and enjoyment of the same.

22. UTILITIES. Any requirement of electricity or other utilities other than those provided by the park shall be installed at the resident’s expense and only with park approval. Such installations, materials or alterations shall be in accordance with park requirements and local codes and ordinances.

23. NOTICE OF RULES VIOLATIONS. Notice of any violations will be issued to residents, either verbal or in writing. Any violations cited must be corrected within a reasonable time frame. Failure to make these corrections may be just cause for termination. Sufficient opportunity for discussion of violation cited will be provided by Park Management.

24. COMPLAINTS. Any complaint that a Resident has either against another resident or against the Park shall be set forth in writing, with a copy delivered to the Park. Complaints about Park managers may be directed to: South Federal Park Associates, c/o Roger Van Wagner, P. O. Box 1630, Arvada, CO 80001.

25. WRITTEN APPROVAL. Whenever the Lease or Rules and Regulations of the Park require the approval or consent of the Park, said approval must be in writing and may be withheld in the sole and absolute discretion of the Park.

26. AMENDMENT OF RULES AND REGULATIONS. The Park may amend these Rules and Regulations upon such notice and in such a manner as is required by Colorado law at the time of such amendment.

27. ATTORNEY’S FEES AND COSTS. Attorney’s fees and costs in any action brought under this lease shall be awarded pursuant to C.R.S. §13-40-123.

RESIDENT CERTIFICATION

I/We have received, read and fully understand the foregoing Lease and Community Rules and Regulations which I/we find to be reasonable, and agree to abide by provisions thereof. I/we understand that any breach of the Lease or of the Rules and Regulations by me/us, any family members or guests may result in termination of tenancy upon written notice by Park Management.
