The meeting was called to order at 7:03 p.m. by Jerry Mullins, Chairperson, of the Community Redevelopment Agency.

II. APPROVAL OF MINUTES – March 23, 2010

MOTION was made by Councilman Butler and SECONDED by Councilman Taylor to APPROVE the minutes of March 23, 2010.

III. PUBLIC HEARING

All speakers, including staff, were sworn in prior to any testimony.

1.  CASE NO. CU 2010-06

CONSIDERATION OF AN EXPANSION TO AN EXISTING CONDITIONAL USE FOR A “CHURCH, TEMPLE OR SIMILAR RELIGIOUS INSTITUTION” WITHIN THE "MXD-2" MIXED USE DISTRICT, WITH WAIVERS TO CONDITIONAL USE REQUIREMENTS FOR LOT AREA, LOT WIDTH, BUILDING SETBACKS, AND FRONTAGE REQUIREMENTS. (CU 2010-06 Iglesia De Dios Pentecostal/Angelett Murray)

QUASI-JUDICIAL

The applicant is requesting approval for an expansion to an existing Conditional Use for a “church” on a 0.4 acre (MOL) parcel of land generally located at 7290 60th Street. This site is located within the "MXD-2" Zoning District and the Community Redevelopment District. A church is a "secondary use" within said District and is subject to the conditions of Section 18-1509, Conditional Uses, for "churches, temples or other religious institutions". The procedural requirement of this Section is not applicable (i.e. public hearing and notice to surrounding property owners). A Conditional Use, Case No CU 2001-14, was applied for and approved by the CRA in 2001 to establish the church and allow for an expansion but the actual construction work was never performed due to lack of funds. The expansion proposed now includes a new 1,728 square foot modular multipurpose building, paved and grass parking areas and landscaping.

Public Hearing was opened at 7:08 P.M.

COMMENTS:

Ms. Angelete Murray: 910 East Holland Avenue, Tampa, FL I am an agent for the pastor of the church. In regards to the fence, there has been some communications with the property owner behind on the western property line there. The pastor of the church, the church as a whole, and the property owner are coming to an agreement to replace the wooden fence because it is pretty worn out so the pastor is prepared to make that change so that there’s a boundary between the two.

Mr.Jerry Mullins: Is the homeowner here?

Ms. Angelete Murray: No.

Mr.Jerry Mullins: Ok. This is a pet peeve of mine; is to be able to look into somebody’s back yard. People don’t like that. Is there some way that we can…I know these are modulars and they’re probably temporary or are they going to be staying there?

Ms. Angelete Murray: The plan is for them to stay there.

Mr.Jerry Mullins: Would it be possible for you to block the windows off on that side of the modulars until the fence was up?

Ms. Angelete Murray: Yes.

Mr.Jerry Mullins: Ok. Anybody else in the audience have any questions or any presentations or anything else to say? Any proponents? Any opponents? Any City Council members?

Mr. Rick Butler: I’m going to try and do this by memory. I recall just driving by there and seeing four trailers pop on the lot. Is that about what happened?

Ms. Angelete Murray: I’m sorry what?

Mr. Rick Butler: I was driving by and noticed four portable modulars show up some where.

Ms. Angelete Murray: Right.

Mr. Rick Butler: Did they just figure they would just park them there and open up?

Ms. Angelete Murray: No, that wasn’t the thought at all. It was just not knowing that this was going to be an issue. That the zoning was an issue. The pastor, over the church, back in 2001is not the same pastor so it was just ignorance to put it bluntly.

Mr. Rick Butler: I look at the site plan here but realistically I guess I’m dealing with how large…we got a 180 foot by 97.

Ms. Angelete Murray: Right.

Mr. Rick Butler: Ok and I’m showing one, two, three, four, five, six, seven, eight…..sixteen parking spots that are grass in nature that look like concrete…

Ms. Angelete Murray: The stops?

Mr. Dean Neal: Wheel tread runners.

Mr. Rick Butler: Wheel tread runners…It just looks awful tight ok I’m not sure what I’m looking at here but it…it just umm..that use to be the old Pinellas Park News building. And I think we that we had approved something prior to this…on this site.

Mr. Dean Neal: Yeah, it was back in 2001 they approved the Conditional Use.

Mr. Rick Butler: For the existing site as it sits?

Mr.Dean Neal: As it was.

Ms. Angelete Murray: Actually, I think that there was an additional building that was proposed back in 2001 that was approved. I mean, if it matters I have that.

Mr.Dean Neal: Right, it just wasn’t constructed. They were tight of money, just getting started in.

Mr. Rick Butler: So this much square footage was approved in 2001 already?

Mr. Dean Neal: Right, it was like an 800 square ft. building. It’s a small building and they had grass parking. They also got a waiver to all landscaping requirements.

Mr.Rick Butler: What’s the difference in what we’re approving tonight?

Mr. Dean Neal: It’s just expanding by putting on those modulars. Put together you’ll end up with two.

Mr. Rick Butler: If we approved it, this area to be built on back then right?

Ms. Angelete Murray: Right.

Mr.Rick Butler: Well, it was 100 square ft. building back then?

Mr. Dean Neal: (PEOPLE TALKING TOGETHER????) – It was a square ft. building, concrete block building that was always there. They just moved into that building. Now they’re coming forward to add the modulars. So they’re expanding which has caused them to come back to this Conditional Use process. The modulars weren’t approved back then.

Mr. Rick Butler: The modulars that are there now, are not….I mean they look fairly used.

Ms. Angelete Murray: They are….they are used.

Mr.Rick Butler: because they are Quasi Judicial.

Ms. Angelete Murray: You can go buy them you just can’t go…speak.

Mr.Bill Mischler: Well one attorney will tell you one thing and then another attorney, Ed Foreman, use to tell us no way. So, I’ve been in that mess before.

Mr. Rick Butler: For the record, I didn’t drive by there to ….I didn’t even know this was coming before us.

Ms. Angelete Murray: Right.

Mr.Jerry Mullins: You’d seen this before.

Mr. Rick Butler: But for the record, driving by there I’m just wondering how four modular buildings can just end up on a lot. And for the record, I didn’t pick the phone up and call anybody or turn in anybody on this.

Ms. Angelete Murray: Right, but that was already in the works. There was an inspector out there that….and that’s….

Mr.Rick Butler: Did they pull a permit when they dropped them off?

Ms. Angelete Murray: No.

Mr.Rick Butler: Or did he pull them in and park them?

Ms. Angelete Murray: Well the person that he purchased them from…the pastor again….it goes back to him just not knowing. His intention was to pull them on there, get permits to set them up. But it turns out that when he came down to get the permits they told him no that he wasn’t able to do that. And around about the same time an inspector came out and said “hey you’ve got to do something with this”. He was already…the pastor was actually depending on the contractor or the company that he purchased the homes from to help him with this. It was a bit more than that gentleman could handle and then that’s how I got into the picture…to help him with the application process. His intention is to do the right thing obviously and to improve the site that he has there. In regards to the structures, they do look pretty worn right now but that’s because they’re not set up. I mean they’re just sitting on their wheels right now. With plastic to keep protecting them. He went through the process of talking to the congregation, letting them know, in order for them to get these units set up that they’re going to use as classrooms to enhance their congregations’ English speaking abilities because they’re pretty much all Spanish speaking. It’s a progressive plan. It is a tight fit but if there is any way we can see it through it’s for a good cause.

** A discussion ensued about how the modulars will have to meet the Florida Building Code, the timeframe they could actually stay on site and how many modulars there actually are. It was decided at the end to table this item

MOTION was made by Vice-Chair Bradbury and SECONDED by Mr. Taylor to TABLE Case No. CU 2010-06 a request for an expansion to a Conditional Use for “churches, temples and similar religious institutions” based on review of the criteria of Section 181509.4(B), and the requirements in Section 18-1509.6, with waivers to the Conditional Use requirements for lot area, lot width, building setbacks, and parcel frontage, subject to the following conditions:

1. A waiver by the City Engineer shall be required to allow a grass parking lot. Should grass parking be disallowed by the City Engineer, the parking lot shall be improved to standards outlined in Section 18-1714, Parking Regulations.

2.  The modular structure shall be no closer than 10 feet to the western property line with the stair allowed encroaching an additional 5 feet.

2.  CASE NO. MS 2010-28

CONSIDERATION OF A REQUEST FOR A CHANGE TO A PREVIOUSLY APPROVED PRELIMINARY SITE PLAN FOR A PARCEL OF LAND IN THE “P” PUBLIC ZONING DISTRICT TO ALLOW A NEW PARKING LOT TO BE INSTALLED. (MS 2010-28 Boys and Girls Club of the Suncoast, Inc./Jay Myers, Myers Architecture)

QUASI-JUDICIAL

The applicants are requesting a change to a previously approved Preliminary Site Plan for a 1.8 acre (MOL) parcel of land in the “P” Public Zoning District generally located at 7790 61st Street North, Boys and Girls Club of the Suncoast, Inc., to allow a new parking lot to be installed. There are no building expansions proposed with this use. The surrounding area consists of: to the north, Public Works Maintenance Facility; to the south, vacant City-owned property; to the east, Davis Field; and to the west, apartments. Section 18-1506.25 of the Land Development Code requires City Council approval of site plans for property located within the “P" Public Zoning District.

Public Hearing was opened at 7:26 P.M.

COMMENTS:

The applicant was not present; however, Rick Butler is a former member of the Board for the Girls & Boys Club and will abstain from voting on this item.

Received a Block Grant and will be receiving a Façade Grant. The building is now clean.

3.  CASE NO. MS 2009-37

CONSIDERATION OF A REQUEST FOR A CHANGE TO A PREVIOUSLY APPROVED PRELIMINARY SITE PLAN FOR A PARCEL OF LAND IN THE “P” PUBLIC ZONING DISTRICT FOR DEVELOPMENT OF A NEW PARKING LOT WITH A VARIANCE TO THE TWO-WAY DRIVE AISLE WIDTH REQUIREMENT. (MS 2009-37 – City of Pinellas Park)

PUBLIC HEARING (QUASI-JUDICIAL)

The proposed parking lot improvements to the Performing Arts Center property will provide structured parking areas with clearly delineated parking spaces and drive aisles in lieu of the current grass parking areas. Landscaping will be improved and will meet the Code requirements for buffering the new vehicular use areas from surrounding properties. A playing field utilized by the Classical Christian School of the Arts that is located in a portion of the area proposed for improvement will be relocated further west on the property.
