Please find enclosed the transfer guidelines in respect of Ministerial Staff, ACTOs, DCTOs, CTOs and A.Cs. You are requested to take necessary action to effect transfers in respect of ACTOs and Ministerial staff duly following guide lines issued for each category of employees scrupulously besides issuing a certificate to this office to that effect after completion of transfers.

In respect of C.Ps/I.C.Ps., you may effect transfers of the employees once in a year.

GUIDE LINES FOR THE TRANSFERS OF MINISTERIAL STAFF & CLASS-IV

CLASS-IV EMPLOYEES & RECORD ASSISTANTS

1) In respect of class-IV employees and Record Assistants, it is decided not to effect transfers except where there are specific administrative exigencies.

2) When transfers may be effected the reasons for effecting transfers are to be furnished to the office of Commissioner (CT).

DRIVERS:-

1) In respect of drivers, it is decided not to effect transfers except where there are specific administrative exigencies.

2) When transfers may be effected the reasons for effecting transfers are to be furnished to the office of Commissioner (CT).

MINISTERIAL STAFF - J.A/Typist/Jr.Steno/S.A/Senior Steno/ACTO

GENERAL GUIDE LINES

1) Ministerial staff who are going to complete 4 years of service by 31-08-2005 alone are to be transferred.

2) Ministerial staff who are shortly going to retire on or before 1-4-2006 may be retained at the same place as per GO Ms No.144 Finance (W&M) Department, dt. 7.6.2005.

3) Persons facing ACB enquiries/major disciplinary cases wherever they are working without being under suspension for any specific reasons, whatsoever, they should not be continued in focal posts and should be posted to non-focal post.

4) While effecting transfers, competent authorities shall give precedence to the employees seeking transfers on medical grounds for the diseases (either self or spouse or dependent children) of cancer, heart operations, neurosurgery, bone TB, kidney transplantation to places where such facilities are available as per G.O. Ms.No. 144 Finance (W&M) Department, dt. 7-6-2005.

5) Transfers shall be done by counselling. All the employees seeking transfer will be asked for three preferences and accommodated as far as possible subject to performance. When more than one employee opts a particular place, the preference shall be given to the senior most employee subject to the employee not having charges pending against him and subject to his work performance.

6) Spouse cases may be considered subject to availability of clear vacancies as per their request . ( GO Ms.No.767, Dt: 21-8-2002)

7) No employee who has put in less than four years of service shall be transferred. Service in all cadres at a station will be counted while calculating period of stay.

8) If the employee who have put in more than 4 years of service, constitute more than 25% of the total strength, the employees who have put in longer service at a particular station shall be transferred without exceeding the overall ceiling of 25%.

9) Regarding transfers of office bearers of the recognised service associations, transfers should be made as per existing government instructions as contained in Government Circular Memo No.596/Ser..Wel.94-2, dated 25-8-95 and Memo No.55158/CT.III(2)/2002, dated 13-12-2002.

10) The transfer guidelines are relaxed with regard to persons working in computerisation . To ensure on going computerisation, notwithstanding the tenure put in, the existing persons can be continued if no alternatives are available.

11) All the transfers by the competent authroties as defined shall be completed before 30-6-2005 and all the persons transferred shall report at the new place of posting before 10-7-2005 subject to joining time provision. Any violation of this condition shall be viewed seriously.

12) However, if willingness is received to work in the computerisation programme, in relaxation of the length of service, such persons can be accommodated in relaxation of transfer policy.

13) Whenever it is felt that the transfer of an employee is necessary on administrative grounds, the Deputy Commissioner’s may transfer the employee even if he has not completed four years of service. However the specific reasons & grounds for foing so must be informed to this office.

14) In respect of Checkposts and Integrated Checkposts, transfers of the employees may be effected once in a year.

SPECIFIC GUIDE LINES

JuniorAssistant/Typist/Junior Steno

In addition to the above general guide lines, the following specific guidelines have to be followed while affecting transfers.

1) District is the unit for effecting transfer.

2) Employees who have completed four years by 31-08-2005 at one circle may be shifted to another circle.

Senior Assistant/Senior Stenographer

In addition to the above general guide lines, the following specific guidelines have to be followed while effecting transfers.

1) Employees who have completed four years by 31-08-2005 alone are to be transferred.

2) The District where a person is presently working will normally be the unit for effecting transfer.

3) However transfers within the Nodal Division and across districts can be considered in the following cases

(i). Administrative grounds (ii) Disciplinary cases

(iii). Promotion / Medical / Spouse cases and

(iv). Employees request.

4) In respect of twin cities, employees who have completed six years of continuous service in one division may be transferred to other divisions without affecting six point formula.

5) The DCs shall take care as far as possible not to post back persons to the same offices where they have worked in the immediate past.

ASSISTANT COMMERCIAL TAX OFFICERS

In addition to the above general guide lines, the following specific guidelines have to be followed while effecting transfers.

1) Nodal Division is a unit for effecting transfer.

2) Employees who have completed four years by 31-08-2005 alone are to be transferred.

3) The Employees who have also completed six years of continuous service in one district may be posted to neighbouring district, within the nodal division . However no employee is to be posted to native district.

4) Where there is only one district in nodal division they may be transferred to other divisions.

5) The performance indicators have to be taken as the criteria for effecting transfers.

6) As per performance indicators those who have faired badly should not be posted to focal post.

7) The DCs to take care not to post back persons to the same offices where they have worked in the immediate past.

DEPUTY COMMERCIAL TAX OFFICER ( PROPOSALS TO BE SUBMITTED TO COMMISSIONER OF COMMERCIAL TAXES BY THE DEPUTY COMMISSIONER).

1) DCTOs who are going to complete four years of service by 31-08-2005 alone are to be transferred.

2) DCTOs who are shortly going to retire within one year i.e. by 01-04-2006 may be retained at the same place as per G.O.Ms.No.144 Fin. (W&M) Department, dt. 7.6.2005.

3) DCTOs facing ACB enquiries/major disciplinary cases if they are not under suspension for any specific reasons whatsoever, they should not be continued in focal posts and should be posted to non-focal post.

4) With regard to medical cases warranting compassionate consideration, they have to be given priority in terms of G.O.Ms.No.127, F&P Dept., dt.24-8-99 for self, spouse or dependent children and as per G.O.Ms. 144 Fin. (W&M) Dept., dt. 7-6-2005.

5) Spouse cases may be considered as per their request, subject to availability of clear vacancies. (G.O.Ms.No.767, dt.21-8-2002 and as per G.O.Ms.144 Fin. (W&M) Department, dt. 7-6-2005)

6) The performance indicators have to be taken as the criteria for affecting transfers.

7) As per performance indicators those who have faired badly should not be posted to focal posts.

8) Due care will be taken to ensure that the DCTOs who have completed 4 years in one division are posted to other divisions. Persons should not be posted to native districts and also should not be posted back to offices where they have worked in the immediate past.

9) The D.Cs are permitted to propose transfers on administrative grounds in respect of even those who have not completed 4 years of service by duly indicating the reasons.

10) The D.Cs may obtain the options from the DCTOs by 23-6-2005 after duly indicating the stations and number of posts available and submit proposals immediately, at the latest by 25-6-2005 by 5.00 P.M. in complete shape.

11) DCTOs who are within the zone of transfers are permitted to submit three options.

12) In the options to be exercised, preferences are to be given to the stations but not in favour of a particular post.

13) The Committee comprising of the Deputy Commissioners of the zone will submit the proposals as per the transfer guidelines to the office of the Commissioner of Commercial Taxes by 25-6-2005. This will be recommendatory.

14) The four year transfer norm will not apply to those who are working in the CCT’s office and those who are willing to work in CCT’s office and DC’s office.

15) These guidelines will be adhered to subject to administrative exigencies.

16) The Committee has to furnish a certificate that all the guidelines are scrupulously followed without any deviations, while proposing transfers.

COMMERCIAL TAX OFFICERS:- ( PROPOSALS TO BE SUBMITTED TO COMMISSIONER OF COMMERCIAL TAXES BY THE DEPUTY COMMISSIONER).

1) CTOS who are going to completed 4 years of service by 31st August, 2005 are to be transferred.

2) CTOs who are shortly going to retire within one year i.e. by 01.04.2006 may be retained at the same place as per G.O.Ms.No.379,GAD, Dt.29.8.96 and if they are in focal post they will be retained subject to good performance.

3) CTOs facing ACB enquiries/major disciplinary cases if they are not under suspension for any reason whatsoever, they should not be continued in focal posts and should be posted to non-local post.

4) With regard to medical case warranting compassionate consideration, they have to be given priority in terms of G.O.Ms.No.127, F&P Dept.,Dt.24.8.99 for self, spouse or dependent children and in terms of G.O.Ms.No. 144 Fin. (W&M) Department, dt. 7.6.2005.

5) Spouse cases may be considered as per their requests, subject to availability of 0clear vacancies (G.O.Ms.No.767, dated.21.8.2002 and as per G.O.Ms.No. 144 Fin. (W&M) Department, dt. 7-6-2005).

8) An attempt will be made to ensure that CTOs who have completed four years in one zone are to be posted to other zone.

9) The CTOs are liable to transfer on administrative grounds even if they have not completed 4 years of service by duly indicating the reasons.

10) The DCs may obtain options from the CTOs by 23.6.2005 after duly indicating the stations/ places and submit them in a complete shape to this office by 25-06-2005.

11) Twin cities are taken as one station.

12) CTOs who are within the zone of transfers are permitted to submit 3 options. However, Commissioner(CT) reserves the right not to consider one or any of the options, subject to exigencies of work.

13) In the options to be exercised, preferences are to be given to a station but not in favour of a particular post,

14) The vacancy position of CTOs is enclosed at Annexure-A.

15) No CTO will be posted to native zone. CTOs should not be proposed to be posted back to same stations where they have worked previously,

16) The four year transfer norm will not apply to those who are working in the CCT’s office/DC’s office and those willing to work in CCT’s office/DC’s office further.

17) These guidelines will be adhered to subject to administrative exigencies.

ASSISTANT COMMISSIONERS:- ( PROPOSALS TO BE SUBMITTED TO COMMISSIONER OF COMMERCIAL TAXES BY THE DEPUTY COMMISSIONER).

1) A.C.s who are going to complete 4 years of service by 31st August, 2005 are to be transferred.

2) A.C. who are shortly going to retire within one year i.e. by 01.04.2006 may be retained at the same place as per G.O.Ms.No.379,GAD, Dt.29.8.96 and if they are in focal post they will be retained subject to good performance.
