Re: Public Road, Street, Footpath & Grass Verge Opening

and on such consent being granted, I/we do hereby covenant, promise and agree with Kildare County Council (hereinafter called the Council) to execute such work subject to the terms and conditions following, and to complete such works within a period of ______days from the date of receipt of permission to connect. The work is to be carried out without stoppages.

I hereby agree to pay any sums in relation to road restoration (if applicable).

PUBLIC ROADS OPENING CONDITIONS

1. To protect, light, watch and take every precaution against accidents and interruption of traffic from the commencement of the work until completion, and to be wholly responsible during the progress of said work for the safety of the public and of all traffic of every description along the roads where work is being done.

2. To indemnify and hold harmless the Council from all losses, actions, claims and demands whatsoever of all persons whomsoever to be in any way sustained or made for by reason or in consequence of said work.

3. The filling in of trenches and of surfaces shall be done in regular layers of not more than 150mm deep at a time-each layer to be well rammed. In the temporary restoration of travelling surface of any roadway, street or footpath the top layer of filling shall be 150mm deep of stone broken to 50mm gauge, finishing fair with existing surface adjoining, and to be attended from time to time afterwards as it may happen to sink or until the final restoration of the surface is completed by the Council. The surface of such temporary restoration shall be sealed with bitumen and chippings or by the use of bitumen macadam.

4. In the case of National and Regional Roads where the depth of the new pipe or service is less than 900mm, the temporary restoration shall be carried out with lean mix concrete to within 300mm of the final road surface. The final 300mm shall be backfilled in the manner described at Condition No. 3 above.

5. In filling trenches (except in the case of grass margins) no clay or other soft material shall be used in the top 120mm. Any road margins shall be restored to their previous condition, and if in grass the parts broken shall be sodded over.

6. The efficiency of any existing gully, pipe, drain, catch pit grating, outlet or any other underground work shall not be injured by any proposed trenches, manholes, pipes, conduits, cables etc. Electric cables and connections shall have at least 750mm cover when laid under road channels and at least 450mm when under footpaths. Electric cables or conduits shall be covered by means of suitable warning tile. Water pipes, gas pipes and drain pipes shall have at least 600mm cover when laid under road or channels and at least 450mm when laid under footpaths.

7. When an opening is made for the purpose of a connection with the Council’s watermain or sewer, the work shall be done in accordance with the Council’s Bye-Laws and Regulations.

8. Any paved channels or footpaths disturbed shall be restored in accordance with the directions of, and to the satisfaction of, the Senior Engineer, Road Maintenance.

9. To carry out any direction or requirement of the Senior Engineer in the execution of the said works to the satisfaction of the Senior Engineer. For the purpose of carrying out the final restoration of the road, street, footpath or grass verge surface, I/we hereby agree to lodge with the Council, a sum to cover the road restoration as may be required by the Senior Engineer. In the event of the payment being insufficient to meet the charges, I agree to pay such additional reasonable charges as may be determined.

10. Where damage is caused to any Kildare County Council service in connection with these works, I agree to pay in full the sum claimed by Kildare County Council to rectify this damage.

12.INSURANCE

Limited Companies or Contractors must produce written confirmation of their insurances from their Insurance Company or Broker (See Questionnaire on following page). A copy of their insurance policy may also be submitted.

13. Submit a Site Location Map (scale 1:2500) with the position of the proposed opening marked clearly in RED.

PLEASE NOTE THAT YOUR APPLICATION CANNOT BE DEALT WITH UNLESS ACCOMPANIED BY THE APPROPRIATE MAP.
