Sometimes Police and Managers view each other as apathetic.
Police feel Mgrs rent to anyone who will pay the rent
Mgrs feel police don’t care and just want to clear the call as soon as possible
The truth is there are Misconceptions about what the Police can and cannot do and there are misconceptions about what Managers can and cannot do.
Displacement Theory
Mgt can’t depend too heavily on Police to solve all their crime problems.
Police can have a tempory effect on a problem but if Management doesn’t follow-up the problem will return.
Displacing air in a balloon – example
Squeeze from one side and air will return – same effect as police on crime.
But if Police work with Management, Maintaince and tenants to squeeze from all sides you can pop the balloon or stop the problem for good.
There is strenght in numbers.
Police don’t have enough training in Civil laws and Management doesn’t have enough training in Criminal law.
Sometimes both sides expect too much from the other.
There is a lot of difference between civil law and criminal law.
CRIMINAL LAW
Police have to have Probable cause to arrest someone - Not just mere suspicion that a suspect committed a crime.
Have to read miranda rights to question
Can’t search an apartment without a warrant and need probable cause to get a warrant.
CIVIL LAW
Police don’t probable cause to question a tenant.
They don’t have to read them any rights.
Managers can enter an apartment without a warrant
Criminal vs. Civil Court
Criminal need proof behond a reasonable doubt
Civil just need a preponderance of the evidence.
In a lot of cases Managers are able to take a civil action against a resident much faster then Police can take criminal action.
DRUGS IN APARTMENT
Go by your company attorney’s legal advice on whether to confiscate
Notify the police
Drugs / Needles extremely dangerous – be careful handling them.
Also keep eye open on grounds for any discarded drug paraphenila
GENERAL DISTURBANCES
Music, parties, roudy behavior, etc. - Management has the most power to solve problem permenatly. Can give warning then serve eviction notice on second offense
