EXPLANATORY STATEMENT
Defence Determination 2010/29
This Determination amends Defence Determination 2005/15, Conditions of Service (the Principal Determination), made under section 58B of the Defence Act 1903 (the Act). Chapter9 of the Principal Determination sets out provisions dealing with travel within Australia for members of the Australian Defence Force (ADF).
The purpose of this Determination is to adjust travelling and meal allowance rates. The adjustments are in line with:
- Rates published by the Department of Education, Employment and Workplace Relations, used extensively throughout the Australian Public Service. Accommodation rates are set following a survey conducted by the Department of Education, Employment and Workplace Relations.
- Rates provided by a contract between the Commonwealth and a service provider, to provide accommodation to members at contracted rates. This service provider is the Lido Group Pty Ltd (Lido).
Clause 1 of this Determination sets out the manner in which this Determination may be cited.
Clause 2 of this Determination provides that clauses 4, 5, 6 and 14 of the Determination commence on 2 September 2010 and the remaining clauses commence on 4 July 2010.
Clause 3 specifies that the amendment is made to the Principal Determination, as amended.
Clause 4 amends the table in clause 4.5.9 of the Principal Determination, which sets out the rates of meal allowance payable to ADF members in certain circumstances where Service-provided meals are unavailable.The amendments increase the meal allowance rates by an average of 3.5% for breakfast, lunch and for lunches where the member's normal place of duty is in a capital city, under paragraph 4.5.6.1.d of the Principal Determination.
Clauses 5 and 6 amend the rates of part-day travelling allowance in subclause 9.5.10.2 of the Principal Determination. The new rates have been derived from travelling allowance rates provided by the Department of Education, Employment and Workplace Relations, and areincreased by 3.5%.
Clause 7 amends the table in subclause 9.5.18.2 of the Principal Determination. The table sets out the maximum amount of travel costs that can be paid for a member living in. It permits the member to use their travel card to pay for incidentals for each day of a journey over 21days. The amendment increases that incidentals amount by 2.5%.
Clause 8 amends the table in subclause 9.5.20.2 of the Principal Determination, which sets out the maximum amount of travel costs that a member can use the travel card to pay for when they are living out on a journey longer than 21 days.The member can use their travel card to pay for incidentals for each day of a journey over 21 days. The amendment increases that incidentals amount by 2.5%.
Clause 9 amends the table in subclause 9.5.37.2 of the Principal Determination, which sets out the maximum amount of travelling allowance that may be paid to a member living in.The amendment increases the incidental component of the allowance by 2.5%.
Clause 10 amends the table in subclause 9.5.39.2 of the Principal Determination, which provides a maximum amount of travelling allowance that a member is entitled to when living out on a journey longer than 21 days.The amendments increase the incidental component of the allowance by 2.5%.
Clause 11substitutes Annex 9.5.A of the Principal Determination.
Part 1 of Annex 9.5.A sets out the maximum rates that may be paid for accommodation, meals and incidentals, for a full day travelling, for ADF members with the rank of Brigadier or higher who do not use accommodation supplied by Lido. Part 2 of Annex9.5.A gives the equivalent maximum rates for members ranked Colonel or lower.
These amendments:
- Decrease the accommodation amounts that may be paid for most centres with the maximum decrease of 9% for Perth.
- Increase the accommodation amounts forAdelaide (1.2%) and Darwin (40%).
- The accommodation amount for Canberra remains unchanged.
- Decrease the medium-cost country centres accommodation amounts by approximately 1.5%.
- Increase the meal rates that may be paid by approximately 3.5%.
- Increase the incidental rates that may be paid by approximately 2.5%.
Part 3 of Annex 9.5.A sets out the maximum amounts that may be paid for accommodation in high cost country centres. The amendments to Part 3 vary the accommodation amounts by between +34% (Christmas Island) and -9% (Jabiru and Yulara), based on changes in local accommodation markets. Fifteen towns have entered the high cost category in this review, and two have dropped to a lower category.
Part 4 of Annex 9.5.A lists the locations classified as medium-cost country centres. Nineteen new locations have been added to this list.Seven of the locations have been removed because they have been included as high cost country centres in the amended Part 3 of Annex 9.5.A.
Clause 12 substitutes Annex 9.5.B to the Principal Determination, which provides travelling allowance rates, for members who choose accommodation supplied through Lido.The rate for Darwin has been split into two rates, to provide for seasonal variations in the local accommodation market.
These amendments:
- Add eight new locations to the list.
- Increase the accommodation rates for Adelaide (1%), Canberra (4.5%) and Darwin – peak season (17.5%) for member ranked Brigadier or higher.
- Decrease the accommodation rate for Darwin – low season by 10%for member ranked Brigadier or higher.
- Increase the accommodation rates for Adelaide (1.5%), Canberra and Darwin – peak season (6%) for members ranked Colonel or lower.
- Decrease the accommodation rate for Darwin – low season by 12% for members ranked Colonel or lower.
- The accommodation rates for the remaining centres remain unchanged.
- Meals and incidental rates in this Annex are equivalent to those in Annex 9.5.A.
Clause 13 amends Part 2 of Annex 9.5.C to the Principal Determination.Part 2 provides for a maximum amount of the meals component of travel costs, for a member living out on a journey longer than 21 days. The rates have increased by 3.5%.
Clause 14 amends the formula in subclause 15.2.37.2 of the Principal Determination. This updates the figure used to calculate meal allowance for members performing additional duty while on long-term posting overseas. The figure increases from $24.95 to $25.80,an increase of approximately3.5%.
Criteria are provided for the exercise of discretions under the Principal Determination, as amended by this Determination. Adverse decisions are subject to merits review under the ADF redress of grievance system, including an appeal to the Defence Force Ombudsman.
