ALVA, OKLAHOMA, CODE OF ORDINANCES --- ARTICLE II. – PEDDLERS AND SOLICITORS

Sec. 12-21. - License required.

It is unlawful for any person, either as principal or agent, or its servants or employees to conduct or carry on from door-to-door any trade, occupation, or business hereinafter enumerated without first having procured a license from the city clerk as provided in this article. Sec. 12-22. - Application, fee, issuance of license.

Every person desiring to engage in any trade, occupation or business on a door-to-door basis, as hereinafter enumerated shall first make application for a license to the city clerk on application forms furnished by the city clerk and shall pay to the city clerk a license examination and investigation fee which is on file in the city clerk's office. It is the duty of the city clerk, upon receipt of such application, and where required, such license examination and investigation fee, and if same is deemed satisfactory and acceptable, and upon fulfillment of any other requirements of the ordinances of the city if any, to issue a license to the applicant. Sec. 12-23. - Expiration date.

All annual licenses shall expire on June 30, following their issuance. (Prior Code, § 6-3; Code 1994, § 9-103)

Sec. 12-24. - Examination and investigation fee.

Every person desiring to engage in any trade, occupation or business, as set forth below, must first secure a license from the city clerk for the designated occupations or businesses, and in addition thereto a license examination and investigation fee for all persons from outside the city shall be paid. The fee for all hawkers, solicitors and peddlers of goods, wares or merchandise, on a door-to-door basis, including the sale of books, maps or magazines, and for the repair, alteration or renovation of any article shall be on file in the city clerk's office. Sec. 12-25. - License not to be used by others.

No license issued under the provisions of this article shall be used at any time by any person other than the one to whom it was issued. (Prior Code, § 6-5; Code 1994, § 9-105)

Sec. 12-26. - Hours of solicitation.

All solicitations made under license provisions shall not be earlier than 9:00 a.m. or later than 9:00 p.m. (Prior Code, § 6-6; Code 1994, § 9-106)

Sec. 12-27. - Persons under 16 years of age.

No license shall be issued to any person under the age of 16 years, and it is unlawful for any licensee to employ or allow any person under the age of 16 years to be employed as a huckster, peddler, hawker, helper or solicitor in connection with the business licensed thereunder. Sec. 12-28. - Exemptions.

All churches, civic organizations, charitable campaign fund drives and youth organizations are first required to notify the city police department of any house-to-house drive for funds to be undertaken within the city. (Prior Code, § 6-8; Code 1994, § 9-108)

Sec. 12-29. - Unlawful to sell from vehicle; wholesalers exempt.

(a)

It is unlawful for any person to sell or offer for sale, at retail, any commodity from any truck, trailer or other vehicle while such vehicle is parked on any street or alley of the city.

(b)

The provisions of this section shall not apply to wholesalers or wholesale distributors supplying their customers for resale at retail nor to the transportation and distribution, at wholesale or retail, of milk and dairy products, nor to the sale, in any zoned residential area, of vegetables and fruit by the producer or grower thereof.
