BOARD MEMBERS PRESENT:Jack Thomas, Randy Deere, Delane Simpson, and Ryan Dearbone.

BOARD MEMBERS NOT PRESENT: Jerry Wilder

STAFF PRESENT:Code Enforcement Board Clerk: Tabitha Joiner; Code Enforcement Coordinator: Teddy Webb; andCode Officials:James Napper, Tim Butts & Melissa Christerson.

  • APPROVAL OF MINUTES

October 22, 2013 – Simpson made a motion to uphold the minutes as written. Deereseconded motion which passed unanimously.

  • COMMENTS / ANNOUNCEMENTS

The December 24, 2013 meeting has been canceled. Deere made the motion Not to have a December 24, 2013 CEB meeting due to the Holiday. Dearbone seconded motion which passed unanimously.

Westside Ventures LLC – 310 Woodford Ave & 214 Gordon Ave – Category B

Category B - Have been issued a 3rd citation for the same violation on any properties.

Citations & Fee Amounts: $81.11 – Fees have been approved.

Citations & Fee Amounts: $156.11 – Fees have been approved.

Citations & Fee Amounts: $106.75 – Fees have been approved.

There was a brief discussion about the violations and citations that have been issuedit has been confirmed that the citations have been paid. After speaking to Jason Mills, the Board decided NOT to deem Westside Ventures LLC a Repeat Offender.

Simpson made the motion NOT to deem Westside Ventures LLC a Repeat Offender. Deere seconded motion which passed unanimously.

Richard & Susan Jones – 1223 Indianola St – Category B & Category C:

Category B - Have been issued a 3rd citation for the same violation on any properties.

Category C – Outstanding unpaid citations fines and/or remedy charges.

Citations & Fee Amounts: $81.11 – Fees have been approved.

Citations & Fee Amounts: $156.11 – Fees have been approved.

Citations & Fee Amounts: $306.11 – Fees have been approved.

Richard & Susan Jones were not present.

Webb stated that this property has had ongoing problems for a while. James Napper is the inspector and can go into more detail of what is currently going on with the property. Napper stated the citations have been issued for exterior violations at this time, but there are interior violations as well. A new citation is due to be issued tomorrow. The owners are aware of all violations, but are not making any attempt to correct them.

Simpson made a motion to deem Richard & Susan Jones Repeat Offenders with any future citation fees being no less than $600.00. Deere seconded motion which passed unanimously.

  • OLD BUSINESS

Case 2013-3416 – 605 Woodford Ave – Owner: Tommy Craft – Code Enforcement Officer: Melissa Christerson

Citation amount: $81.11 upheld in September 24, 2013

Christerson stated that no work has been completed, no permits have been pulled. The only contact our office has had with Craft was on October 7, 2013, which was a phone call from Tabitha. Joiner stated that the conversation was to remind Craft to come into the office and get with Teddy Webb on the interior violations. The conversation was not pleasant, Craft was very hateful and said we were harassing him so he would be getting an attorney. At that point Joiner ended the phone call.

Craft came to the podium and asked if he could get any more time to get the violations corrected. He presented a document from his electrician who said that there is nothing wrong with the electric. The board viewed the document which did not have a name of any electrician on it. The fine has not been paid nor appealed to district court. At this time, a new citation is due to be issued and Craft will have the right to appeal that citation. If he does not appeal the citation or comply within 10 days of the citation, a third citation will be issued. He would have the option to appeal that citation as well.

Deere asked Craft what he needs to get the property back into compliance. Craft’s response was he needed time to get his attorney and we’ll just go from there. Craft stated that “he has been mistreated”. He said if the city would just put the meter back in, he could get the rest of the work done. We have cost him millions of dollars due to the meter being pulled. He says his electric is grandfathered in.

Webb explained that the property is not grandfathered in and will need to be brought up to code.

After all business had been conducted, Simpson made the motion to adjourn at 5:30 PM.. Deere seconded the motion, which passed unanimously. The next scheduled meeting of the CEB will be on Tuesday,January 28, 2014 at 5:00 PM in the Commission Chambers at City Hall 1001 College Street.
