Release and Waiver of Liability, Assumption of Risk and Indemnification Agreement (“Agreement”)

In consideration of being permitted to participate in any way in sponsored ChristianCycling – Twin Cities Spokeactivities (“Activity”):
1. I understand and acknowledge that biking involves certain risks and danger of serious injury or death, and these risks and dangers may be caused by my own actions and/or inactions, the condition of my bicycle or the bicycle of another, the actions or inactions of other participants and members or leaders, weather, lightning, or other conditions; and other known and unknown conditions or hazards. I further acknowledge the Activity will be conducted over public roads and facilities open to the public. I agree if at any time I believe the activity or conditions are unsafe, I will discontinue my participation in the Activity.
2. I understand and acknowledge that I alone am responsible for my own safety and health while participating in ChristianCycling – Twin Cities Spoke activities. I fully accept and assume all risks and all responsibility for any losses, costs, and damages, known or unknown that I incur as a result of my participation, in any ChristianCycling – Twin Cities Spoke activity, whether biking-related or not.
3. I agree and represent that I am in good health and adequate physical condition to participate in ChristianCycling – Twin Cities Spoke activities.
4. I release, discharge, and covenant not to sue, now or in the future, ChristianCycling – Twin Cities Spoke, their sponsors, organizers, leaders, agents, members, or participants, and if applicable, owners and lessors of premises on which a ChristianCycling – Twin Cities Spoke activity takes place (“Releasees”), from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the Releasees, including negligent rescue operations. I further agree that if despite this Agreement I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify, save, and hold harmless each of the Releasees from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as the result of such claim.
5. I am 18 years of age or older, have read and understand the terms of this Agreement, fully understand that I am giving up substantial rights by signing this Agreement, have signed it voluntarily and without any inducement or assurance of any kind and I intend it to be a full, complete, unconditional release of all liability to the greatest extent allowed by law. I agree that if any portion of this Agreement is held to be invalid, the balance shall continue in full force and effect.
6. I agree and understand that this waiver remains in effect until revoked by me in writing and delivered to the Organizer of ChristianCycling – Twin Cities Spoke.

I believe the minor to be qualified, in good health, and proper physical condition to participate in ChristianCycling – Twin Cities Spoke activities. I understand that I am entirely responsible for the minor while the minor is participating in ChristianCycling – Twin Cities Spoke activities, and not the ChristianCycling – Twin Cities Spoke participants or leaders.
