REQUEST FOR BID

The Cherokee Nation is accepting bids from interested parties to remove and replace a collapsed sewer line for the Talking Leaves Job Corps cafeteria located in Tahlequah, Oklahoma. Contractor shall bid to furnish all labor, equipment, tools, and insurance necessary to perform the work required thereof within the time specified after receipt of “NOTICE TO PROCEED”.

General Information – Instructions:

Bids will be accepted until 5:00 p.m. on June 30, 2011. Bidder can visit the job site and acquaint themselves with the exact nature of work to be performed. To schedule a site visit, contact Gary Gillum at (918) 822-0212.

MANDATORY SUBMITTAL INFORMATION: Bid submittal requirements must be followed. Each bid must be submitted on the prescribed, required form with all areas completed. Any and all costs to submit bids are the responsibility of the offeror. Bids must be submitted to the attention of Jeananna Hendricks. The bids may be faxed to Jeananna Hendricks at 918-458-7695, or by e-mail at or hand delivered to Cherokee Nation Acquisition Management, Financial Resources Building, Attn: Jeananna Hendricks, 17665 S. Muskogee Avenue, Tahlequah, Oklahoma 74464.

Interpretation of Bid Documents: All questions or requests for interpretation of this bid must be submitted in written format to Cherokee Nation Acquisition Management. Requests maybe e-mailed to . Bid Acceptance: Bids will be accepted from Indian and Non-Indian bidders. Cherokee Nation reserves the right to reject any and all bids. Cherokee Nation reserves the right to determine if a bid meets stated requirements, and to award a purchase order for the bid that is in the best interest of the Cherokee nation including but not limited to the total cost and capability of the bidder. To be considered, bids must be received by the specified date and time; any bid received after stipulated date and time will not be considered. No bidder may withdraw their bid within 30 days after proposal due date. Cherokee Nation reserves the right to waive any informalities or to reject any and all bids. Award of contract will be to the most responsible responsive bidder and will be subject to availability of funds.

Modification of Bid: Any responding party may modify their bid at any time prior to the scheduled closing time for receipt of bids, provided such communication is received in writing by the Cherokee Nation prior to the closing time.

TERO Certification: Indian preference will be given only to bidders who provide proof of current certification from the Cherokee Nation Tribal Employment Rights Office (TERO) located in Tahlequah, Oklahoma, telephone number (918) 456-0671. Proof of TERO certification must accompany and be included in bid submittal. Indian Preference applies to all Cherokee Nation requests for bids or proposals. To receive preference, bidder must be TERO certified through the Cherokee Nation Tribal Employment Rights Office; proof of certification must accompany bid submittals. Successful bidder will be obligated to comply with Tribal rules and regulations and TERO. To receive Indian Preference, certified company must control and perform at least 51% of the work in order to receive the Indian preference points.

Qualifications of Bidder: The Nation may make such investigations as deemed necessary to determine the ability of the bidder to perform the work, and the bidder shall furnish to the NATION all such information and data for this purpose as the NATION may request. The NATION reserves the right to reject any bid if the evidence submitted by, or investigation of, such bidder fails to satisfy the NATION such bidder is properly qualified to carry out the obligations of the contract and to complete the work contemplated therein. Conditional bids will not be accepted.

Debarment, Suspension, Proposed Debarment, and Other Responsibility Matters - The responding party certifies to the best of its knowledge and belief that the person, the firm, or any of its principals are not presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency or Indian tribe. The bidder will also certify they have not, within a three-year period preceding this Request for Proposal, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, Local or Tribal) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commissions of embezzlement, theft, forgery, bribery, falsifications or destruction of records, making false statements, and are not presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in this provision. The responding party certifies they have not, within a three-year period preceding this Request for Proposal, had one or more contracts terminated for default by a Federal, State, Local or Tribal agency. The responding party shall provide immediate written notice to the Cherokee Nation if, at any time prior to contract award, the person learns its certification was erroneous when submitted or has become erroneous by reason of changed circumstances

Contracts must be executed within (10) ten days of award or the bid will become null and void, and the next lowest most responsive bid will be considered.

Subcontracts – The Cherokee Nation will contract only with the Contractor. Should the Contractor propose to employ a Subcontractor, the request must be made in writing to the Director of Acquisition Management. The Nation must approve in writing any person, firm, or party proposed by the bidder to award a subcontract. The Cherokee Nation, in giving such acceptance, assumes no responsibility in connection with the terms of the subcontract and their performance will be the responsibility of the Contractor.

TALKING LEAVES JOB CORPS CAFETERIA – COLLAPSED SEWER LINE

DETAILS:

Ø  Contractor must remove and replace damaged sewer pipe sections as needed that has eroded away at the bottom of the cast iron pipe.

Ø  Contractor must open floor at drains and clean out pipe joints.

Ø  Contractor must replace sewer pipe with cast iron to match pipe, sizes 3” to 4” or 4” to 6”.

Ø  Schematics are available in out maintenance shop for inspection.

Ø  Contractor must make all necessary cuts to drain and weld back to new pipe.

Ø  Inspection will be performed by Maintenance Supervisor before pipe is covered.

Ø  Upon completion, Contractor must cover pipe with sand.

Ø  Contractor must include in bid any rebar, concrete, and tile to finish floor to specifications.
