Submission of CMP/SEMP

Please submit CMP/SEMP at least 40workingdayspriortostartingworks on site. The City Council will do it’s best to respond to your plan within 10 working daysi.e. 14 Calender days.

Fees associated with monitoring and compliance with COCP

Before the start of any works the payment of the full fee for the duration of the development will be required which will cover the cost and services of the Council in order to achieve compliance with the CoCP process the fee will vary dependent on the type of development and the duration of the project (see Appendix F).

The fee does not include cover costs such as highways licensing, building control, parking etc.

The next step after planning approval

The relevant Appendix A checklist must be signed and submitted along with either the Construction Management Plan (CMP) for basements or the Site Environmental Management Plan (SEMP) for level 1 and level 2 developments to . Appendix A, G and H can be used as a guideline on what to input into the CMP and SEMP.

These documents must be submitted a minimum of 40 working days in advance of the commencement of development works. The Council will endeavour to provide an initial response to the submitted document within 14 days. However please note some documents may require longer to review and assess and most development proposals will require site visits to enable the assessment.

Once the CMP/SEMP has been agreed an officer will be contact to finalise contact details of the applicant in order to finalise payment. The applicant will be invoiced for the full amount of the project.

For Level 1 and Level 2 documents, a Section 61 application under the Control of Pollution Act 1974 must be submitted a minimum of 28 days in advance of the commencement of the development, however early engagement with the Council is recommended.

Discharging of Planning Condition – Appendix A

Once the SEMP/CMP has been approved and payment fee agreed an officer will countersign Appendix A and send back to the applicant where they must apply to the planning department to discharge the relevant planning condition regarding the COCP.

How stakeholders can input on the CMP / SEMP for a construction project which has just been granted permission.

Anyconstruction projecthas to comply with Westminster’s new Code of Construction Practice.

If residents have raised concern regarding the development during the planning process we expect the developer to engage with the stakeholders in the local area and illustrate to the City Council how they have dealt with the concerns raised and how they have engaged with key stakeholders in preparation for the development.

The SEMP/CMP has to be approved by the City Council and will be reviewed thoroughly with regards to minimising the impact to stakeholders.

Planning permission prior to the adoption of the COCP & compliance with the new CoCP

You are required to comply with the environmental requirements within the code, even in cases where the attached fee is not applicable. However, you may still have commitments or agreements under other mechanisms, such as the Section 106 agreement which may require the submission of documents and/or fee payments and these will still apply. You are advised to carefully check the terms of your planning consent to understand what applies to your development.

For a Level 1 or Level 2 developments:If the planning application was approved after the 01st September 2016 the project will fall under the new CoCP regime.

For basement developments:If the planning application was approved from 22ndJuly 2016 then it will fall under CoCP regime.

These works cannot take place on Saturdays, Sundays or public holidays.

S61 Consent for Basement Developments under the CoCP

TheCityCouncil may require a S61application for yourbasementdevelopmentproject. If this is the case you will be informed of this as soon as practicable upon receipt of your CMP. A S61 consent form can be found on our website. Link below

Quiet Periods

The definition of quiet periods are:

Cutting using power tools;

Breaking(including percussive breaking) or dismantling using power tools/machines/plant;

The use of impact fasteners;

The loading of heavy materials;

Other noisy activities, depending on the specific location of site and neighbours,

deemed unacceptable by Environmental Health Officers.

As part of the CoCP site do I require a licence for a temporary structure, road closure or crane licence?

You need a licence to put buildingapparatus or machinery on the public highway; this includes things likescaffolding, construction fencing, cranes and cherry pickers.

The type of licence you need depends on what you're putting on the highway and if you need a road closure.

The cost of the licence will vary based on whether you are working on a "major"or "minor"road.
