TERMS AND CONDITIONS OF USE

1.Introduction

1.1TheJIBIndustrialInformationService,hereinaftercalled“theService”,isaweb sitewhichenablessubscriberstoverifytheparticularsofcurrentmembersofthe Electrotechnical Certification Scheme (ECS).

1.2The Service is limited to the following information:

  • The individual’s name
  • Photograph of the individual
  • Date of birth
  • JIB Grade
  • ECS roll number
  • ECS disciplines and qualifications
  • Date the current card was issued and when it expires

2.Cost

2.1TheServicewillbeamonthlysubscriptionservicecosting£184.00plusVATper calendar month (£2200 plus VAT per year), payable on the firstdayofeachmonth. The JIB will notify you of any increases.

2.2The cost of the Service is only applicable to one address. Subscribers wishing to use the Service for additional addresses will be required to register and pay a separate subscription for each address.

3.Use of Service and Data Protection

3.1The JIB will contact users by e-mail to notify them of their login details.

3.2Youagreetotreatalllogininformation such as Usernames and Passwords as confidentialandforusebyyourpersonnelonly.

3.3Using the Cloud Network, uptofiveuserscanaccesstheServiceat anyparticular time.

3.4Wewillnotverifycardholders’detailsbyanyothermeans than via the Service. The JIB or the ECS Department will not verify request by, for example,telephone, fax,e-mail, written communication etc. This is for data protection reasons.

3.5Only those individuals who have signed the consent form and agreed to their personal details being available are included on this service. An individual may opt for their information not to be shared and as such they will not appear on the system.

3.6Noattemptmustbe madetousetheinformationcontainedon theweb sitein any software application or documentation other than thatprovided bytheJIB.

3.7InformationontheServiceisupdated periodicallyand this will usually be on a weeklybasis between0000and 0800 Sunday GMTand the Service will be unavailable during this period.

3.8Only current ECS cardholder’s details are available. Those who possess a valid health and safety certificate, but do not have a valid ECS card, will not appear on the system.

3.9TheServiceisofferedwithoutanywarrantymadeorimplied.TheJIBwillunder nocircumstancesbeliablefordamageorlosses(whetherlosseswereforeseen, foreseeable,knownorotherwise) such aslossofdata, revenue or anticipated profits,business,opportunity, goodwillorinjurytoreputation, losses suffered by third parties or any indirect,consequential,specialorexemplarydamagesarisingfromtheuseofthe Service regardless oftheformofaction.

3.10Copy of the JIB’s data protection policy can be found on the JIB’s website.

4.JIB National Working Rule 17

4.1Any Employment Business (Agency) wishing to supply labour to a JIB member company must participate in the Service. JIB National Working Rule 17.2.2.3 states:

“To ensure that labour provided by an Employment Business meets the required standards and complies with the labour requested by a JIB Member Firm, an Employment Business used by a JIB Member Firm must participate in the JIB Industrial Information Service. A record of Employment Businesses currently participating in the scheme will be held at the Offices of the JIB.

Additionally an Employment Business must have an appropriate industrial relations policy and an agreement with Unite the Union compatible with the ethos of the JIB Agreement.”

4.2Those Employment Businesses who are participating in the Service and are up to date with their subscription are listed on the JIB website. This provides each Employment Business’ contact details and with a link to their website.

4.3An Employment Business must have an appropriate industrial relations policy and agreement with Unite the Union compatible with the ethos of the JIB Agreement prior to being registered onto the Service, as stated above.

Please include a copy of this agreement with your application.

5.Termination

5.1The JIB reserves the right to terminate the subscription of the user. Examples of possible reasons for termination are, but are not limited to:

(a)Non-payment of subscription(s)

(b)Arrears of payment

(c)Inappropriate use or abuse of the Service

5.2Any decision to terminate subscription of this Service will lead to removal of the Employment Business from the Industrial Information Service list of those eligible to provide labour to JIB Member companies.

6.Issues arising

6.1If any subscribers experience difficulties with the Service then:

(a)Administrative issues or questions about the Service can be dealt with by Karen Sulsh () or by phone on 01322 661605, and

(b)Technical issues, including problems with accessing the system, should be taken up with Selection Services () or by phone on 0844 874 1000.
