/ CERTIFICATION SCHEME OF EXPLOSIVE FOR CIVIL USES AND PYROTECHNIC ARTICLES /
1.INTRODUCTION
The purpose of these instructions is to clarify all details relating to the explosive materials certification process. The following products constitute explosive materials:
-explosives for civil uses,
-explosive material detonators,
-pyrotechnic articles,
-products filled with explosives and
-raw materials with explosive properties used in the manufacture of otherexplosive materials.
This procedure applies to the certification of explosives for civil uses based on the annexes of Directive 2014/28/EUon the harmonisation of the laws of the Member States relating to the making available on the market and supervision of explosives for civil usesand certification of pyrotechnic articles based on annexes of Directive 2013/29/EU on the harmonisation of the laws of the Member States relating to the making available on the market of pyrotechnic articles.
Harmonized European standards are used to evaluate compliance with the requirements in the above-mentioned Directives. If no harmonized European standards are available then the certification is performed in accordance with the Essential Safety Requirements of the Directives.
These instructions do not contain details of the procedure for evaluating the quality system of manufacturing and products according to modules C2, D, E and H, which are described in the instructions for Certification of the Quality System of Explosive Material Manufacturers (TU-PR-ekspl).
2.SUBMITTING AN APPLICATION
In order to initiate the certification procedure, the manufacturer or its authorized person must fill out and submit form C-3-5 (available on Ex-Agencija's website). Once received the application is evaluated, and if straightforward, the customer is sent an offer and Agreement (C-10-8-ekspl). The manufacturer confirms acceptance of the offer by submitting an order along with the Agreement (C-10-8-ekspl)signed by manufacturer, and certification documentation in accordance with Module B, Module F or Module G listed in the Directives under item 1. of these instructions.
Ex-Agencija will then confirm receipt of the order and initiation of the procedure.
The manufacturer or its authorized personcan use the same form to submit an application for an addendum (to expand the scope of the certificate) or to request a new issue of the certificate.
3.PRODUCT TYPE CERTIFICATION
Type Examination Certification is performed in accordance with module B of the Directive under item 1. of these instructions. If the results of the evaluation are satisfactory, Ex-Agencija issue the customer an EU-Type Examination Certificate marked 2465.EXP.gg.nnnn or 2465.PYR.gg.nnnn. The certificate is issued without an expiration date.
Procedure for Issuing EU-Type Examination Certificate
a)Evaluation of Certification Documentation
Ex-Agencija evaluates the conformity of the product documentation with the requirements of the Directives, applying either the harmonized standards or the Essential Safety Requirements if the manufacturer has not used the harmonized standards. The customer should prepare two copies of the certification documentation, either in Croatian or in English. Use of a third language can also be arranged if both parties agreed.
b)Type Testing
For each type of product Ex-Agencija specifies the number of samples and specific requirements with regard to the preparation of samples for testing, depending on the design and type of explosive materials, and the requirements of applicable standards. Repeating certain tests may not be necessary if they have already been performed and the results are acceptable for that product.
c)Test Evaluation and Certificate Issue
Ex-Agencija evaluates the test results, and if those results and the certification documentation are both satisfactory Ex-Agencija will issue the customer a EU Type Examination Certificate.
If the product type test results and/or certification documentation do not conform to the requirements, Ex-Agencija will notify the customer accordingly, citing the reasons for denying issue of the certificate.
However, this certificate alone does not enable the manufacturer to produce and place equipment on the market; the manufacturer must (in accordance with Directive requirements) also apply one of the modules relating to the quality system assessment (Module D, Module E, Module H) or conformity to type assessment (Module C2).
4.UNIT VERIFICATION
Unit verification of products is performed according to Module G of the Directives in item 1. of these instructions.If all of the evaluation results are satisfactory Ex-Agencija will issue the customer an Certificate of Conformity marked 2465.EXP.gg.nnnn or 2465.PYR.gg.nnnn.The certificate is issued without an expiration date.
Procedure for Issuing Certificate of Conformity
The certification procedure is carried out in three stages:
a)Evaluation of Certification Documentation

5.PRODUCT VERIFICATION (for explosive for civil uses only)
The product is checked in accordance with Module F of Directive 2014/28/EU. If all of the evaluation results are satisfactory Ex-Agencija will issue the customer an Certificate of Conformity marked 2465.EXP.gg.nnnn.The certificate is issued without an expiration date.
Procedure For Issuing Certificate of Conformity
The certification procedure is carried out in three stages:
a)Evaluation of Certification Documentation
Ex-Agencija evaluates the conformity of the product documentation with the approved certification documentation.
b)Product Testing
Ex-Agencija tests each product according to the requirements of applicable standards and EC/EU Type Examination Certificate. If certain tests cannot be performed on the product,
Ex-Agencija specifies the samples and method for preparation of the samples for testing.
c)Test Evaluation and Certificate Issue
Ex-Agencija evaluates the test results, and if those results and the certification documentation are both satisfactory Ex-Agencija will issue the customer an -Certificate of Conformity.
If the product test results and/or certification documentation do not conform to the requirements, Ex-Agencija will notify the customer accordingly, citing the reasons for denying issue of the certificate.
With receipt of this certificate the manufacturer can place the product on the market, issue a statement of conformity and place Ex-Agencija’s number alongside the CE symbol.
6.COMPLAINTS, OBJECTIONS, DISPUTES AND WITHDRAWAL OF CERTIFICATES
Any objections/complaints the client may have concerning the certificate issued, or any other unfavorable decision made by Ex-Agencija throughout the certification process, must be submitted to Ex-Agencija in writing. If the complaint is not in writing, Ex-Agencija will proceed in the manner it deems appropriate. Unfavorable decisions include:
-denial of applications,
-refusal to continue an assessment,
-denial, suspension or withdrawal of the certificate,
-any other activities that prevent the client from acquiring and/or maintaining certificate.
Ex-Agencija will process the objections/complaints according to procedure B-10-4, which can be provided on request.The complainant will be notified of Ex-Agencija’s position on the matter in writing. Ex-Agencija will attempt to resolve the issues by agreement within a reasonable time-frame, but no longer than 30 days. If the objection/complaint has not been resolved in a positive manner, the client may submit an appeal to the appropriate authority.
Before a decision is reached, the information in the complaint is reviewed and analyzed, and the client is informed of the results in writing. Records are kept on all complaints and actions implemented.
Any person or organization can express dissatisfaction to Ex-Agencija (where a response is expected) regarding its activities or the activities of the manufacturer whose product has been certified by Ex-Agencija.
Ex-Agencija will assess the significance of the complaintand, if the complaint is justified, undertake the appropriate actions needed. The procedure of handling complaints is considered to be strictly privileged information, for the protection of both the complainant and Ex-Agencija clients.
If the complaint is not in writing, or is received from an unidentified source, Ex-Agencija will proceed in the manner it deems appropriate. If such need is indicated, Ex-Agencija will (with the permission of the complainant and the client) stipulate the conditions under which the content and resolution of the complaint may become public information. Ex-Agencija will attempt to resolve the issues by agreement within a reasonable time-frame, but no longer than 30 days.
