1.Judges

Judges assemble at rear of Court One and prepare to file into court in the order set

out in the seating plan.

2.Court Officer

On indication from Judges’ Lobby (three loud knocks) announces:

“SILENCE. ALL STAND AND REMAIN STANDING”.

3.Court Officer/Judges

Court Officer opens door at rear of Court One. Judges file in, bow and take their

seats. The Chief Justice will then indicate to the Court Officer that the formal opening

is to commence.

4.Court Officer announces:

“ALL PERSONS HAVING ANY BUSINESS BEFORE THE FEDERAL COURT

OF AUSTRALIA, SITTING IN ADMIRALTY, ARE COMMANDED NOW TO DRAW

NIGH AND GIVE THEIR ATTENDANCE AND THEY SHALL BE HEARD” - “BE

SEATED PLEASE”.

5.Chief Justice's Associate:

On indication from the Chief Justice announces:

“PRESENTATION OF AN OAR MACE OF ADMIRALTY TO THE FEDERAL COURT

OF AUSTRALIA”

6.The Chief Justice invites:

Mr Tom Broadmore, President of the Maritime Law Association of Australia and New Zealand, to address the Court.

“MR BROADMORE - DO YOU MOVE?”

7.The Chief Justice invites:

Commander Tim Wood RFD, RANR, to address the Court.

“COMMANDER WOOD - DO YOU MOVE?”

8.The Chief Justice invites:

Mr Bernie Shinners, partner, Mallesons Stephen Jaques, to address the Court.

“MR SHINNERS – DO YOU MOVE?”

9.The Chief Justice invites:

Lieutenant Stephen Harper RANR, partner, Norton and White, to address the Court.

“LIEUTENANT HARPER - DO YOU MOVE?”

10.The Chief Justice invites:

Mr David Curtain QC, Chairman of the Victorian Bar Council, to move the Court.

“MR CURTAIN - DO YOU MOVE?”

11.The Chief Justice invites:

Mr Andrew Scott, immediate past President of the Law Institute of Victoria, to move the Court.

“MR SCOTT - DO YOU MOVE?”

  1. Mr Broadmore then announces that as President of the Martime Law Association of Australia and New Zealand he invites Mr G. Vallely, President of the Victorian Branch of the Martime Law Association of Australia and New Zealand, to present to the Federal Court of Australia an Oar Mace of Admiralty.
  1. Mr Vallely then says:

“I now have the honour to to present to the Federal Court of Australia an Oar Mace of Admiralty which has been subscribed to by members of the Martime Law Association of Australia and New Zealand and others, in memory of the late Donald Latimer Brooker”.

14.The Chief Justice instructs the Admiralty Marshal to accept the oar mace into the custody of the Court.

15.Mr Vallely removes the cover from the oar mace and then passes it to the Admiralty Marshal who takes it from him.

16.The Associate to the Chief Justice removes the stand from the Bar Table and places it on the

bench to the right of the Chief Justice.

17.The Admiralty Marshal turns to face the bench, exchanges bows with the judges and places the oar mace on the stand.

18.The Chief Justice responds.

19.The Chief Justice invites Cooper J to reply also.

20.The Chief Justice says:

“THE COURT WILL NOW ADJOURN”

21.Court Officer moves to open door for Judges to file out.

22.Court Officer announces:

“SILENCE. ALL STAND AND REMAIN STANDING - THIS HONOURABLE COURT

NOW STANDS ADJOURNED”

  1. Court Officer opens door to bench and takes position behind the Chief Justice.

24.Admiralty Marshal rises, shoulders the oar mace, bows to the Chief Justice and moves to the designated position and waits for the judges.

25.Court Officer opens door at rear of Court One. Judges rise, exchange bows with the

Bar and file out in order of seniority behind the Admiralty Marshal.

26.Those present remain standing until the Judges have left the Court.
