2. Minutes of the meeting held 14 March 2013
The minutes were accepted as an accurate record of the previous meeting.
3. Matters arising
There were no matters arising.
4. Director’s update on key developments
AGL outlined some of the key pieces of legislation that CCPS is currently looking at:
a) Public Bodies (Joint Working) (Scotland) Bill
AGL distributed copies of CCPS’ briefing on the bill. AGL indicated that she had met this morning with the Bill Advisory group and that there was an awareness of a certain amount of frustration amongst Ministers relating to the delay in moving the integration agenda forward. AGL highlighted CCPS’ ambivalence towards the title of the bill given that ‘public bodies’ only accounted for a proportion of provision within the country.
CCPS had also highlighted that there was no mention on the face of the bill about independent scrutiny. She has been told that there will be a government amendment to address this and that mention of independent scrutiny will appear on the face of the Bill.
CCPS will copy members into its draft submission of evidence to the Health and Sport Committee and would invite members to submit their own evidence where appropriate.
Stage 1 of the Bill is scheduled for around Nov/Dec 2013 with stage 2 likely to take place late 2013 or early 2014. The ultimate goal for implementation is 2015. The Bill will address all Adult Services.
b) Children and Young People (Scotland) Bill
A CCPS briefing on this Bill is imminent and will be circulated to members in due course.
c) Procurement Reform Bill
This has been delayed until after the summer. It has to be drafted within the framework of the European Procurement Directive which has itself been delayed. In the interim, CCPS will be circulating a survey to members (by the beginning of July) to gather everyone’s thoughts about procurement. Mike Martin (former director of the Joint Improvement Team) who was involved in writing the guidance on procurement in the first place, will be working with CCPS to follow up with some of the respondents from this survey to carry out more detailed interviews /focus groups in order to tease out some of the issues. A report on this work will be due out in September 2013.
d) Self-directed Support Bill
This Bill was passed by the Scottish Parliament in January 2013. CCPS has organized a consultation event to look at the regulations and guidance for the Bill. We have been asked by the Scottish Government to work with SDSS on drawing up the guidance for providers and service users and we have engaged new staff member Kenny Pentland to work on this as part of the Providers & Personalisation team within CCPS.
In parallel with dealing with new legislation, CCPS is continuing to pursue various issues linked to funding cuts. We recently organized an event in conjunction with ADSW where CCPS providers were able to meet with commissioners from various local authorities. This was arranged as a follow up to CCPS’ earlier FOI report on hourly rates. CCPS recommended that Local Authorities might like to think about at what a ‘reasonable rate’ might look like. Only one Local Authority has stated a minimum they would be likely to pay – giving a ‘floor’ as well as a ‘ceiling’ for their rates of pay. CCPS is pressing for guidelines on a ‘compliant’ rate taking into account all the variables involved. We will be in touch with Scottish Care in connection with the work they have begun to identify and lobby for a ‘fair’ rate.
AGL also drew members’ attention to a recent short SCVO survey which is being circulated – prompted by a Conservative Party member who has highlighted the commitment to 3 year funding for providers contained in the 2009 Joint Statement between COSLA, Scottish Government and the third sector. . SCVO want to test whether this commitment is being kept. It’s unlikely that this is the case, however CCPS have asked for additional questions to be included i.e. if contracts include inflation year on year and whether there is any evidence of attempted claw-back of unspent funding.
5. Membership update
CS reported that Cairn Housing, Momentum, WRVS and YPeople would unfortunately not be continuing their membership in 2013. However, new members for the year included Royal Blind and Marie Curie. There had been further interest from additional organisations in joining CCPS.
6. CCPS representation on working groups/committees
NF reported that CCPS now had representation on two new groups:
- The joint Scottish Government and COSLA Reshaping Residential Care for Older People Task Force; and
- Integration of Health and Social Care – Clinical and Care Governance Group

7. AOCB
Edel Harris reported that Life Changes Trust (www.lifechangestrust.org.uk) has launched a £50 Million grant funding programme specifically set up to benefit young people leaving care and people with dementia and their carers. They are open for business!
NH congratulated all of the CCPS members who were winners or finalists at the Care Accolades.

Reviewing the National Care Standards
The members heard from Lindsay Liddle project manager, Scottish Government, and Heather Dall seconded from the Care Inspectorate, who discussed the consultation process and the government’s developing ideas in relation to the review of care standards and took some early soundings about the issues for CCPS members.
Scottish Government Chief Social Work Advisor
Alan Baird, the recently appointed Social Work Advisor to the Scottish Government outlined some if the key priorities in his work plan of relevance to the third sector providers and listened to providers’ views on current developments in social care provision.
