CAUCUS MEETING

JUNE 8, 2011

6:30 P.M.

Members Present: Present were Mayor William Henfey, President of Council Patrick Rosenello, Councilpersons Robert McCullion, Edwin Koehler, Margaret Bishop, and Richard Ogen. Councilpersons Kellyann Tolomeo and Salvatore Zampirri were not present. Also present were Acting City Administrator Louis Belasco, Solicitor James Cafiero and Engineer Ralph Petrella.

COUNCIL PRESIDENT ROSENELLO asked for discussion on the issuance of a new license to Olde New Jersey Tavern LLC, which was a pocketed license but was not renewed for the license period 2010-2011. Rosenello stated if Council desires to issue a new license it must be according to paperwork received from the State regarding this license. Solicitor Kaufmann has informed Rosenello that Council is able to place special conditions on this new license if they desire. The establishment involved is Keenan’s who placed this license in pocket when they made the purchase of 2nd Street Annie’s property. Rosenello state that the Master Plan recommends liquor establishments to be contained in the BB District, the Entertainment area, 17th Avenue between Central and New Jersey and south on New Jersey Avenue from 17th to Woody’s block and also on the Boardwalk. All existing liquor establishments are grandfathered in at their current locations. The State Division of ABC has forwarded a Special Ruling authorizing the Governing Body of North Wildwood to consider a new license for the 2010-2011 license term and to grant or deny said application in the reasonable exercise of its discretion. Rosenello stated he feels the City should issue this license with conditions. Rosenello also noted this is not Keenan’s current license as this is a 2nd license that was purchased with the adjoining property and was to be transferred to Big River Fish Co. on West Spruce Avenue. Administrator Belasco stated it is not needed to know the exact address of this pocketed license. It was stated this license is currently valued at approximately $250,000.00. Mr. Keenan failed to renew this license by the end of June 2010 and the license eventually went back to the State. Keenan’s attorney filed and received from the State a Special Ruling for this license to be re-issued as a new license by the City. Solicitor Cafiero stated Council can kill this license if you want to by not issuing. Councilman Koehler noted if we do nothing, the license dies. It was noted that Keenan’s had paid for this license when purchasing the adjoining property with the license included in that sale. Rosenello stated it would be an extreme measure to not issue this license but should be issued in regards to our Master Plan conditions. Mayor Henfey noted this will make the Walnut Avenue neighbors happy by not transferring this license to Big River Fish. Deputy Clerk Jett noted that Scott Keenan had paid all fees in February or March of 2011 for this license. Mayor Henfey asked if anyone has any problems? Rosenello gave direction to the City Clerk to advise the applicant’s attorney to attend the next Council meeting on June 21, 2011 at 10:00 AM and for the Clerk to work with the Solicitor to get the wording correct. Mayor Henfey noted these special conditions do not hurt Keenan’s. Also decided to have the Clerk notify Solicitor Kaufman for him to draft a letter to Keenan’s attorney.

MAYOR HENFEY noted he will be appointing David Lindsay to the NW Beach Patrol Pension Board at this meeting. Chief Cavalier recommended someone else but that person holds a Philadelphia address and the Mayor feels it should be a North Wildwood resident on this Board. The current Pension Fund is $250,000.00.

MAYOR HENFEY announced he has received a $1.5 (just short of $1.6) million in FEMA funds in reference to our beach restoration. Henfey noted this is not enough. Henfey stated Ralph Johnson is “bird dogging” FEMA and will file appeals. Paperwork (PW’s) was asked to be sent to the City to review what we did get paid for or didn’t.

MAYOR HENFEY stated the Surf Avenue restoration is horrible from 11th to 18th and will be resurfaced from gutter to gutter with all new striping. Next week they will raise the manhole covers and the following week re-surface. Mayor stated we cannot leave it the way it is now with Administrator Belasco stating it is like a roller coaster. After the repaving it will look like a brand new street. Mayor is negotiating for use of the contingency monies as we must spend the grant money or lose it as we must use the loan money first.

CAUCUS MEETING

The new FMBA (Fire Department) contract has been reviewed by Attorney Pepper and he has assured us the language in the contract has been corrected to a $2,000.00 medical buyout for employees.

ADMINISTRATOR BELASCO noted he has spoken to Solicitor Kaufmann and he is working on language for an agreement with Atlantic City Electric for the encroachment of our Fire House on New Jersey Avenue. Currently this agreement will include a 20-year licensing agreement between the two parties. Kaufmann is changing this to wording for an easement and will continue to move forward for a permanent solution. Mayor Henfey asked to have permission to sign this lease immediately with all members noting they approved to move forward with Atlantic City Electric. An additional resolution will be added to the agenda this evening authorizing the Mayor to enter into a licensing and easement agreement with Atlantic City Electric.

MAYOR HENFEY will be working with Treasurer Versaggi about our Clean Communities Grant for use of that money to subsidize keeping our beaches clean.

BOARDWALK SHELTERS will be re-bid in the fall but the City will enter into a one year agreement with the previous contractor.

COUNCILMAN McCULLION asked for information about resolution #8 – 8th Street Field. The City is currently obtaining appraisals along with the Camden Diocese.

A regular meeting of the North Wildwood City Council was held on the evening of the above date in the City Hall. The President of Council stated, “The meeting is now open. Adequate notice of this meeting has been provided by posting a copy of the notice of the time and place of this meeting on the City Clerk’s bulletin board and by mailing a copy of the same to The Herald, The Press and Wildwood Leader on January 5, 2011.”
