COMMITTEE AMENDMENT NO. 1By: Armbrister

Amend H.B. 2631 by striking Section 1 and substituting the following:

SECTION1.Section 140.004, Local Government code, is amended by adding Subsections (f), (g), (h), and (i) to read as follows:

(f)A budget required by Subsection (b) shall not increase the expenditure of county funds from the prior fiscal year by more than the percentage increase in the caseload of the adult probation department during the most recent 12 month period as reported to the Community Justice Assistance Division of the Texas Department of Criminal Justice, without the approval of the commissioners court.

(g)A budget required by Subsection (b) shall not increase the expenditure of county funds from the prior fiscal year by more than the percentage increase in the delinquent referrals to the juvenile probation department during the most recent 12 month period as reported to the Texas Juvenile Probation Commission, without the approval of the commissioners court.

(h)A county may deny an increase in funds determined by Subsection (f) if the county certifies to the district judge or judges that it does not have adequate funds to meet the increase.

(i)If the commissioners court grants an increase above the amount provided by Subsection (f) or Subsection (g), the tax rate necessary to generate the increased expenditure above the amount provided by Subsection (f) or Subsection (g) shall be excluded from the calculation of the Rollback Rate under Section 26.04 of the Tax Code.

A BILL TO BE ENTITLED

AN ACT

relating to commissioners court approval of certain budgets.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION1.Section 140.004, Local Government Code, is amended by adding Subsection (f) to read as follows:

(f)The budget required by Subsection (b) shall not increase the expenditure of county funds unless the increase is approved by the commissioners court.

SECTION2.This Act takes effect September 1, 1993.

SECTION3.The importance of this legislation and the crowded condition of the calendars in both houses create an emergency and an imperative public necessity that the constitutional rule requiring bills to be read on three several days in each house be suspended, and this rule is hereby suspended.
