Respected Sir,

Our organisation condemns the incident of killing of a Border Security Force jawan namely RashikulMondal. He was posted at Khalshi BOP BSF, Company-A, Battalion-144 under Swarupnagar Police Station, District-North 24 Parganas, West Bengal.

Reportedly On7.1.2015at about4 aman encounter took place between smugglers and BSF personnel at border area under Khalshi village, Police Station-Swarupnagar followed by exchange of gun fire. One Border Security Force jawan namely RashikulMondal sustained gunshot injury due to firing from the side of smugglers and alter he succumbed to his injuries.

Over the incident Swarupnagar Police Station registered one criminal case vide Swarupnagar Police Station Case no. 16/2015 dated8.1.2015under sections 147/148/149/186/ 188/353/302/307/413/414 of IPC and other penal charges under the Arms Act and Foreigners’ Act. The investigation of the case is still pending.

The incident of death of the BSF jawan was duly reported in several daily newspapers such as on AnandaBazarPatrika, Bartaman on9.1.2015.

Our organisation again condemns the indecent killing of the BSF jawan and demands an impartial enquiry into the matter so that the guilty personnel must be punished in accordance with the law.

In many occasions earlier I have reported to the Commission that thesmuggling throughout the border area has been escalating with the blessings of a section corrupt BSF, police, and local administration along with some corrupt political party leaders. The misery of the innocent villagers has not diminished but it is becoming very tough for them to survive with dignity.

Everyday, thousands of cattle are transported to Bangladesh by smuggling and lots of points at the bordering area calledGhatsused as channels for smuggling. Sometimes encounter took place at the border area resulting loss of life.

The smuggled cattle are driven through the farming lands located adjacent to the border area causing serious damage and harm to the agricultural land. The villagers could neither harvest nor cultivate crops in their farming lands. Most of the villagers belong to lower income group and had to cultivate crops taking loans. In this situation it became an impossible task for them to repay loans and survive and earn their livelihood. The small farmers of the area are to shoulder the loss of field crops daily due to smuggling of cattle.

In this regard I would like to refer that on8.1.2015Mr. D. K. Biswas, candidate of BhartiyaJanata Party at Bongaon on the Parliamentary Election, 2014, submitted a letter to Mr. Rajnath Singh, Hon’ble Minister, Govt. of India, Ministry of Home Affairs.

The subject matter of the said letter was “Thousands of Cows Buffaloes and Bulls are belief everyday sent to Bangladesh through Indian Bangladesh Border Road (IBBR) in connivance with by Battalion No.152, BSF with the help of Bangladesh and Indian smugglers. This is an anti-Indian activity. Praying for necessary action” A copy of the said letter is annexed herewith for your kind perusal.

I hope that the Commission would step forward to take proper action so that the intense situation prevailing at Indo-Bangladesh border area could be curbed down with adequate measures prevailing rule of law and human rights. The illegal activities in the bordering area are required to be stopped immediately with proper measures so that loss of life could be prevented.
