NC 1505-2.1 Confidentiality

The Secretary takes appropriate action, in accordance with section 444 of the GEPA, to ensure the protection of the confidentiality of any personally identifiable data, information, and records collected or maintained by the Secretary and by the SEA and LEAs pursuant to Part B of the IDEA, and consistent with NC 1505-2.2 through NC 1505-2.18.

The following Iredell-Statesville School (i.e., participating agency) personnel have full access rights to review confidential information under the Family Educational Rights and Privacy Act of 1974, 20 U.S.C. 1232g (FERPA).

All other parties/individuals are mandated to document the review of confidential information through disclosure of the following information on the Confidentiality of Student Records sheet provided in each student’s confidential record:

a)  The date the data was disclosed.

b)  The name of the party/individual to whom the data was disclosed.

c)  The specific data disclosed.

d)  The purpose of which the data was disclosed.

*Note: An LEA may presume that the parent has authority to inspect and review records relating to his or her child unless the LEA has been advised that the parent does not have the authority under applicable State law governing such matters as guardianship, separation, and divorce.

**Note: The student must, at a minimum, be 18 years of age and not having been declared incompetent by a court of law prior to reviewing records.

**** During the summer months when EC case managers are not working, the Powerschool Data manager or Guidance Department at the school can access EC records and process records requests.
