About the course:
The issues to be covered include:
  • Brief Overview of the Professional Indemnity Scheme (the “Scheme”);
  • Provisions in the Solicitors (Professional Indemnity) Rules (the “Rules”) relating to coverage and exclusions;
  • Provisions in the Rules and the Hong Kong Solicitors’ Guide to Professional Conduct (the “Guide”) relating to notification obligations;
  • Parties involved in the claims handling process;
  • What happens after new notification is received by Managers;
  • What are the implications if a claim for indemnity under the Scheme is made;
  • Aggregation;
  • Duty not to admit liability and duty to co-operate;
  • Dispute resolution mechanism.

Course objective:
The seminar aims to:
  • impart knowledge on the operation of the Scheme, in particular its coverage and the exclusions set out in the Rules;
  • alert practitioners to the notification obligations under the Rules and the Guide, and the importance of complying with such obligations;
  • impart knowledge on how notifications/claims are handled under the Scheme;
  • alert practitioners to the implications if a claim for indemnity under the Scheme is made;
  • alert practitioners to some important provisions in the Rules relating to an Indemnified’s duties during the claims handling process and the dispute solution mechanism.

Fiona Stewart is Account Director and Legal Officer of Essar Insurance Services Limited (“Essar”). Fiona is a barrister admitted to practice in the UK (1981) and Hong Kong (1982). She was a civil litigation practitioner before joining Essar in 1991. She left in 1995 and re-joined Aon in 2006. Fiona is the head of Claims for Aon Specialty Broking across Asia. In addition to her claims handling work, Fiona has overseen a review of Scheme operations and claims handling procedures to bring a more efficient service to solicitors. Fiona sits on the Law Society’s Professional Indemnity Advisory Committee and other sub-committees advising on aspects of the Scheme.
Ming Chung was admitted as a solicitor in Hong Kong in 2003 and joined Essar Insurance Services Limited as a Legal Officer in 2012. Before joining Essar, she worked in private practice for Deacons specialising in commercial litigation and worked on a wide range of Professional Indemnity Scheme related matters. Ming is also a member of the Law Society of Hong Kong’s Risk Management Education Committee.
Katherine Forsyth joined Essar Insurance Services Limited as a Legal Officer in 2004. She manages potential and actual claims against the Hong Kong Solicitors Indemnity Fund Limited, including responding to notifications made by Indemnifieds, pro-actively settling claims within Managers' discretion, instructing and overseeing the work of Panel Solicitors and maintaining reserves and other claims data. Katherine was admitted as a solicitor in Australia in 1997, where she worked as a litigator, and she was admitted as a solicitor in Hong Kong in 2014.
Enrolment Conditions:
  1. Enrolments will be accepted on a first-come first-served basis. Priority will be given toMembers of the Law Society.
  2. Places cannot be reserved by facsimile. Registrations will only be accepted upon full payment of the course fee and receipt of the registration form.
  3. If you cannot attend a booked course, written notification must be received by the Academy at any time before the date of the booked course and then you may either: 1. transfer your booking to a replacement delegate; or 2. transfer, up to 3 times, your booking to another Academy course of same value within 6 months of your written notification. If you still cannot attend the booked course after you have utilised the 3 transfers of your booking, no further transfers will be allowed and the course fees paid will be forfeited unless notice of cancellation is received in accordance with the cancellation policy.
  4. Notice of cancellation of a booking must be given so that it reaches the Academy not less than seven (7) days before the date of the course and is subject to an administration fee. This fee is presently set at HK$100. Cancellations received after this time will not be accepted - the registration fee will remain payable and shall under no circumstances be refunded. Registrations are transferable to another person at any time before commencement of the course provided that the Academy is notified in advance.
  5. If the course becomes full and you wish to have your name entered onto the waiting list of this course, please complete the enrolment slip and return it to the Academy together with the payment of the appropriate course fee. You will be notified before the date of the course if we are able to offer you a place at the course. A registrant whose enrolment is unsuccessful will receive a refund of the appropriate course fee.
