PUPPY CONTRACT

and Seller(s), D. Diane Dotson and Kathleen Regan, agree to the purchase and sale respectively of the following dog:

Sire: CH Lil Paws Keawe AKC WP54068002

Dam: CH Galaxy’s Resistance is Futile AKC WS48508901 CHIC #120144

Under the following terms:

PRICE

Cash price of $2,500.00(cash or cashier’s check) to be paid in full before delivery of the dog, and the following reservations-

Because of this dog’s pedigree and the need to preserve the heritage of the Samoyed breed, the dog will be co-owned by the breeders, D. Diane Dotson and Kathleen Regan. Dog must be shown to at least AKC Champion title, and beyond as she is capable. This may or may not require the services of a professional handler.
Dog may be bred after age 2 if she remains in good health and passes CHIC health exams as recommended by the Samoyed Club of America.
Co-owners will have final say in decisions about showing and breeding. A separate contract/agreement will be written to list responsibilities and privileges regarding puppies and registrations from a planned breeding.

CONDITIONS

Dog must have, and when outdoors be kept in, a securely fenced yard with fence of adequate height with no areas of escape, and a locking gate. Provision must be provided for protection against summer sun and winter’s inclement weather with fresh water available at all times. AT NO TIME is dog to be allowed to roam freely, thereby not only endangering his/her own health and wellbeing but constituting a nuisance to the general public.

Buyer agrees to take this dog to his/her veterinarian for a health check within 72 hours of taking possession of this dog. Breeder’s responsibility for communicable diseases in the dog is void if not reported within this 72-hour period.

Routine care must include rabies shots as mandated by state law and other vaccinations as recommended by a Doctor of Veterinary Medicine. Dog is to be fed a premium food and maintained in good condition, neither overweight nor underweight. It is a medically accepted fact that an overweight condition damages physical condition in general, show/performance potential in particular, and can create a disposition toward hip dysplasia. Dog is to be kept free of parasites such as worms, fleas and ticks by methods recommended by a Doctor of Veterinary Medicine.

Seller cannot guarantee that this puppy will not develop health problems, but Seller certifies that all due care has been taken to breed a genetically healthy puppy. Sire, Dam, and All Grandparents (at a minimum) used to produce this puppy have had clear eye exams to OFA/CERF standards and OFA hip clearance numbers. Additional CHIC required tests have been done on living relatives as those tests have become available. Results of those tests are available at ofa.org

Buyer agrees to socialize and train the puppy by attending and completing a scheduled series of household manners or puppy training classes before the age of one year.

Galaxy and Lil Paws must be at the beginning of the registered name of this dog.

Careful and thoughtful consideration has preceded both the sale and purchase of this animal. It is the mutual understanding of both the Buyerand Seller and their families that this animal will be a part of the Buyer’s family for the length of its natural life. However, if circumstances should require that this dog can no longer remain in possession of the Buyer, it is agreed that the dog along with its AKC registration papers be returned to the breeder (Seller).

Buyer agrees that this animal shall not be transferred, sold, or given to another party without previous notification to Seller (D. Diane Dotson of Galaxy Samoyeds and Kathleen Regan of Lil Paws), at which time D. Diane Dotson of Galaxy Samoyeds and Kathleen Regan or their heirs shall have first right of refusal at half of the original sale price.

Buyer agrees this dog shall not be used in a breeding program to supply either directly, or to an agentthereof, who sells outright or consigns to a pet shop, kennel, or individual whose purpose is mass production, wholesaling or retailing of dogs.

Any breeding program involving this animal shall be conducted in a conscientious and ethical manner. Buyer agrees to abide by the CODE OF ETHICS OF THE SAMOYED CLUB OF AMERICA.

FORFEITURE

The Buyer agrees that any willful or flagrant violation of the articles of this agreement may result, at the sole and absolute discretion of the Seller, in the forfeiture of ownership and possession rights of the dog, and all claims on the dog by the Buyer, without refund of monies paid. If at any time, at the sole discretion of the Seller, the Seller feels the dog's care is inadequate, it will be considered a violation of the articles of this agreement and subject to forfeiture.

SCOPE AND AMENDMENTS

This agreement embodies the entire agreement between the parties hereto and supersedes any and all other agreements between the parties in connection with the dog described herein. This agreement may be amended at any time by the consent and signature of all parties in writing, provided the written document so states that the purpose of the document is to amend this agreement.

This agreement is hereby entered into and wholly executed in the State of Texas and litigation arising from any possible breach of this agreement shall be adjudicated in the County of Taylor, in the state of Texas, under Texas law. Should any provision of this agreement be held invalid, illegal or unenforceable, the remaining provisions shall not be affected.
