GENERAL TERMS & CONDITIONS
Sealed tenders are invited from the reputed transport agencies for undertaking the work of transportation of the materials by suitable vehicles (Trailers/Lorries) having Registration of 1995 and after model only. The tender is on two part basis - (1) Technical/Commercial and (2) Price Bid. The Technical/Commercial conditions are as per Annexure -B. The Price Bid format is as per Annexure-C. The tenderers should specifically confirm acceptance of all Technical/Commercial conditions.
¨ The Commercial/Technical and the Price Bid should kept in separate sealed covers. Both the sealed covers should be kept in a big envelope. The technical / commercial bid will be opened on 17.03.2007 at 14.30 Hrs. in CMM-Stores Conference Hall, 36/11 Building Ground Floor.
¨ After scrutiny of Technical Bid the price bid of only technically suitable tenderers will be opened.
¨ The date of Price Bid opening will be subsequently intimated.
Earnest Money Deposit : - An amount of (1) Rs.50,000/- (Rupees Fifty thousand only) for Lorries & Trailers combined, (2) Rs.30,000/- (Rupees Thirty thousand only) for Lorries only (3) Rs.20,000/- (Rupees Twenty thousand only) for Trailers only should be deposited as E.M.D. along with the Tender in the form of Demand Draft or Cash Receipt obtained from our BHEL Cash Office. Cheques or Bank Guarantees will not be accepted. No adjustments are accepted towards E.M.D. or Security Deposit.
The successful tenderer shall have to enter into a contract of agreement with BHEL for the period of contract. During the tenure of the contract, the quoted rates shall be firm and no change in the rate shall be entertained due to any revision in fuel price.
The cost of stamping of any for executing the contract if any, shall be borne and paid by the Contractor.
The Special conditions relating to this tender schedule is enclosed and the tenderer shall abide by it.
The BHEL reserves the right to reject/cancel any offer or any part of the offer or all the offers without assigning any reasons thereof.

TECHNICAL / COMMERCIAL CONDITIONS
Annexure-“B”
01. (a) The rates given in the attached schedule shall be firm and valid for the period as shown in the Tender Schedule-Annexure-D.
(b) The contractor should maintain good drivers. The contractor is responsible for all statutory requirements such as minimum wages Act etc.,
(c ) All the offers received will be scrutinized and only the technically qualified offers will be considered for opening the price bid.
(d) Technically not qualified offers will be rejected.
(e) BHEL reserves the right to use the vehicle any where in BHEL if need arises.
02. The contractor shall arrange vehicles with Driver, two labourers and one supervisor for each vehicle indented to despatch materials from various stores and preparatory shops to various sub-contractors situated in and around twin cities of Hyderabad, Secunderabad, BHEL Ancillaries and Patancheru area.
03. In case of breakdowns or failures, the contractor should be in a position to arrange alternative vehicle of same make and capacity for timely relief, otherwise recovery willbe made on actuals of alternative arrangement cost of the BHEL.
04. TENDER FINALISATION:
(a) All the tenderers should fill up the tender form Annexure-A,B,C,D fully including the price portion, and send along with Xerox copy of relevant documents duly signed on each page.
(b) The basic qualification of the vehicle should be the model of 1995 Year and after only.
05. Tender priority i.e, L1, L2, L3 etc., are arrived.
06. The L1 party will be called for price negotiation if required.
(a) The lowest (L1) rates quoted will be picked up separately. The L1 party will be called for price negotiation, in case, the lowest price offered by the party is found to be not reasonable, BHEL reserves the right to negotiate for further price reduction and in such case the negotiated price will be considered as L1 price for all purposes.
(b) BHEL requires five (5) lorries on daily basis. Out of which four (4) will be operated for CMM Stores Sub-Contract Cell and One (1) will be operated for T&C shop planning. Hence L1 will be given preference for placement of three (3) vehicles and L2 for two (2) vehicles. In case L1 fails to place the required No.of vehicles on a particular day due to unavoidable reason, then L2 will be given chance for placement of vehicles.
07. The awarded tenderer should be in a position to produce the vehicle for inspection immediately after opening the technical bid. In case any tenderer fails to proceduce the vehicle for inspection on the date specified by BHEL authority, their tender will be cancelled and EMD will be forfeited.
08. PENALTY: A penalty of Rs.500/- ( Rupees Five Hundred Only) per day will be levied and deducted from the running bills or from the security deposit without any prior intimation to the contractor, in case of the following reasons :-
a) If the contractor non-supply of vehicle and late arrivals without prior permission from Sr.Manager/Stores (CMM).
(b) If the Company also could not make an alternative arrangement in the event of failure of contractor under Clause No.03.
(c) If the driver of the contractor not following any other Motor Vehicle safety rules.
09. The contractor should have a minimum (3) three lorries / trucks owned or on Company’s name or (2) two trailers owned or on Company’s name. Copies of RC books to be furnished. The registration of the vehicles should be of model 1995 and after only. Original RC Books and vehicles shall be verified prior to Price Bid opening. To supply suitable vehicles whenever indented, one day advance information will be given to contractor in writing or overphone.
TRAILOR : Should be able to carry materials weighing upto 20 MT (Min.). Width upto 3.5 Meters and length upto 15 (Fifteen) Meters.
Proportionate payment will be made for the quantity over and above the minimum quantity indicated above as per BHEL weighment slip.
LORRY : Should be able to carry materials weighing upto 9 MT (Min.). Approx. width upto 2 meters and length upto 6 (Six) meters.

10. The contractor is responsible for taking and handingover the materials both at BHEL and at our Sub-Contractor's premises with the help of his Supervisor and labourers including loading and unloading. To this effect, the contractor must undertake an agreement with BHEL in writing that he and his men are responsible for safe delivery of the materials in correct quantity and good conditions. The supervisor should also keep records of what he is taking and handingover by maintaining trip sheets in 3 copies. This is important as the contractor should submit his bills with all the details of materials that have been moved on this basis.
11. When materials are taken for handingover to the Sub-Contractor, the transporter must deliver the materials to the sub-contractor on the same day. If, however, for whatever reasons the materials are not delivered to the Sub-Contractor on the same day, the transporter may handover the materials on the subsequent day. But that cannot be counted as load for extra day and payment cannot be effected for additional day.
12. Vehicles are tobe supplied within a day's notice. The requisitions for these vehicles will be communicated over phone or through the contractor's representative. Incase, the vehicles are not supplied intime as indented; BHEL has the right to procure vehicles through alternative sources and any extra expenditure incurred in this process will be recovered from the contractor.
13. The rate is paid on the working day basis (08.30 a.m. to 08.30 p.m) and the rates are inclusive of fuel, Supervisor, two labourers and Driver etc., when Supervisor/labourer are not supplied alongwith the vehicles, an amount of Rs.100/- per each person absent will be recovered from the contractor bills.
14. Parties who can supply the same specified vehicles only need apply. Vehicles should be fit in running condition and should give trouble free service. BHEL officials will physically see the vehicle conditions and verify the R C Book etc. The tenderer should indicate in their offer their vehicle's Registration Number.
15. Vehicles should be made available at BHEL, RC Puram at 08.30 a.m whenever they are indented. BHEL working hours are 06.45 a.m. to 03.15 p.m.
16. BHEL reserves its right to refuse to engage any vehicle even after arrival at the Factory, if the driver and the vehicle do not confirm to any of the regulations of MV act or and APMV Rules.
17. The contractor should be prepared to make more than one trip per day to city and ancillaries from BHEL depending on load conditions.
18. The company will not be in any way responsible for any injury or whatsoever nature, loss of life or any other loss during the course of such work entrusted to the contractor. Also, the company is not responsible for any damage or loss to the vehicles or materials.
19. The company reserves the right to enter into a parallel contract for the same work for the same period or for any period with one or more firms or any grounds whatsoever without assigning any reasons.
20. Arrangements will be made for issue of passes for Supervisor, labourers and the vehicles required for movement of materials employed by the Contractor.
21. The contractor shall submit his bills once in a month with details of trip sheets. Acknowledged documents from the Sub-Contractor along with trip sheets should be submitted twice a week.
22. The contractor shall indemnify and compensate the BHEL for any loss or damage to the property of BHEL occurring due to contractor/his workmen/representatives negligence or otherwise. The loss or damage so suffered by BHEL shall be adjusted from the Security Deposit by the Contractor or from the freight bills or any sum due to him by BHEL.

24. The contractor has to submit Income Tax clearance certificate at the time of entering into agreement.
25. Any other tax or dues leviable under any law or rules shall be paid by the contractor.
26. The successful tenderer shall be able to start the work immediately on receipt of intimation or award of work as per contract, failing which the EMD paid by the contractor stands forfeited.
27. (a) The successful tenderer shall pay a Security deposit of 10% on the over all contract value for One year period and the security deposit can be paid in any one of the following form
(i ) Cash (as permissible under the Income Tax act)
(ii) Pay Order or Demand Draft in favor of BHEL.
(iii) Security deposit can also be recovered at the rate of 10% from the running bills. However in such cases at least 50% of the security deposit should be collected before start of the work and the balance 50% may be recovered from; the running bills.
(b) (i) The successful tenderer EMD of Rs.5,000/- per vehicle paid, will be converted and adjusted against the security deposit as part payment.
(ii) The Security deposit shall not carry any interest.
28. The contractor shall abide by the BHEL security rules and provide/observe such safety requirements as per the Factories Act.
29. Any dispute arisingout of this contract shall be referred to General Manager/CMM of M/s.Bharat Heavy Electricals Limited, R.C.Puram, Hyderabad-502 032 or his authorised representatives and his decision shall be final and binding on both the parties.
30. When BHEL desires to send company's representative, the contractor should allow to travel along with the vehicle.
31. The contractor should be a PAN holder and furnish documentary proof of the same.
32. The Contractor must have "phone facility" at his office/residence for proper communication.
33. In case of any suit or legal proceedings arising under or relating to the contract to be entered into both the relation to the transportation of sub-contract materials, the jurisdiction of courts at will be Hyderabad, Secunderabad and Sangareddy (Medak Dist.,) only.
