Policy Statement

Vehicle Rules and Regulations Policy

PURPOSE:

Vehicle Rules and Regulations are designed to manage the presence of vehicleswithin BearHollowVillage. The objective is to protectallowners, tenants, visitors and property as well as tomaintain the aesthetic values of the community and safety of all persons in BearHollowVillage.

AUTHORITY:

Vehicle Rules and Regulations exist under authority granted bythe Bear Hollow Village CC&Rsas recorded /amended the Development Agreement for the Bear Hollow Village Specially Planned Area.

These Vehicle Rules and Regulations apply within all areasof Bear HollowVillage as noted. This Policy may be supplemented with more-restrictive, but not less-restrictive, Vehicle Rules and Regulations issued by the individual Condominium Associations within Bear Hollow Village fortheir own properties.

DEFINITIONS:

Alleys/ Private Roads-

Private Roads-Lillehammer Lane, Luge Lane & Upper Luge Lane, Bear Cub Drive, Turn About road off Bobsled Blvd. by mail kiosk.

Public Roads- Bobsled Blvd and Oslo Lane - SummitCounty / State of Utah vehicle and

parking regulations are in effect for these roads.

Private Property- Units owned by individual members of BearHollowVillage as defined

in Article 1.17 of the CC&Rs

Common Areas-Real property owned in fractional share by all Owners in the community and

managed by the Association as defined in Article 1.5 and 3.9.1 of the CC&Rs.

Village Square - area on Lillehammer Lane from Bobsled Blvd. to the Clubhouse. The 61 parking spaces surrounding the Office Building, the Clubhouse and the live/work townhouses shall only be used by the Owner, tenants and invitees of the Office Building, persons permitted to use the Clubhouse and the residents of the live / work townhouse units facing Lillehammer Lane.

RULES AND REGULATIONS:

  • All portions of the Utah Code, Title 41, Motor Vehicle Act, as amended, are fully enforceable within Bear Hollow Village. All persons operating motor vehicles within Bear Hollow Village must adhere to all motor vehicle laws of the State of Utah.
  • All Summit County Vehicle and Parking Ordinances are fully applicable and enforceable in all areas of Bear Hollow Village.
  • Motorized vehiclesshall be operated within Bear Hollow Village only on improved roadways or driveways.
  • No snowmobiles, unregistered motorcycles, golf carts,ATVs or other such off road vehicles may be operated or parkedanywhere within Bear Hollow Village except during periods of actual loading or unloading for transport to or from a Unit. Vehicles described in this paragraph will not be repaired, maintained, kept or stored outside anywhere within Bear Hollow Village.
  • No water craft and/or their trailers can be stored or parkedoutside on any alleys, private roads or on Common Area within Bear Hollow Village other than for actual loading and unloading for transport to or from a Unit.
  • No motor homes, utility trailers, PODS, or dumpsters can be parked at any times on the private roads in Bear Hollow Village. Note – the Trustees may grant exceptions to this rule – on a case by case, short term basis for Owners wanting to service their motor home or for Owners moving or for Owners doing renovations to their unit/property.
  • Vehicle parking is not permitted at any timeon the roads designated as Alleys in Bear Hollow Village as required in the Summit County Development Agreement.
  • Vehicle parking is not permitted at any time on the WEST side of Lillehammer Lane between

Bobsled Blvd. and Luge Lane.

  • Vehicle parking is not permitted at any time on the EAST side of Lillehammer Lane between

Luge Lane and the Clubhouse.

  • Vehicle parking is permitted at all times within the bulb out (indented) parking areas on the EAST side of Lillehammer Lane between Bobsled Blvd. and Luge Lane.
  • Vehicle parking is not permitted at any time on the SOUTH side of Luge Lane.
  • Vehicle parking is not permitted at any time on the WEST side of Luge Lane between lots 30 -35 as marked.
  • Vehicle parking is permitted at all times within the bulb out (indented) parking areas on the NORTH side of Luge Lane between Bobsled Blvd. and Upper Luge Lane (by hydrant).
  • Vehicle parking is not permitted at any time on either side of Upper Luge Lane starting from the point where the parking extension cut out begins to the beginning of the driveway for Lot 36 (5429 N. Luge Lane) on Upper Luge Lane.
  • Vehicle parking is not permitted at any time on either side of the lower portion of

Upper Luge Lane from Luge Lane to the posted signs.

  • All vehicles parked on any public or private roads in Bear Hollow Village in accordance with this Policy must be parked parallel to the curb and facing in the correct direction of traffic flow for the side of the street on which the vehicle is parked. No vehicle can at any time block access

to a fire hydrant, no parking by red painted curb areas any time.

  • There is no parking of any type of vehicle within Bear Hollow Village on undeveloped private lots. Utah Code 41.6-116.1 allows for the removal of a vehicle on private property if the vehicle is considered “abandoned.” A vehicle is considered as “abandoned” if it is on the property for more than 7 days without the specific consent of the owner.
  • Inoperable motor vehicles shall not be parked anytime within BearHollow Village. Motor vehicles requiring emergency repair must be dealtwith immediately for removal off-site.No “unsightly” motor vehicles, or motor vehicles which cannot be legally operated on apublic road,shallbe parkedoutside at anytime or anywhere within Bear Hollow Village.
  • No commercial or other vehicle registered for greater than ½ ton vehicle weight can be parked overnight (10PM to 6 AM) on the private property roadsin Bear Hollow Village.
  • Construction trucks and/or trailers for remodeling of Units can be parked on the private property roads in Bear Hollow Village only during the period of remodelingas long as there is no safety concern or issue and safe passage of other vehicles is not impeded and then overnight only in the driveway of the Unit being remodeled.
  • Special one-time parking needs may be brought to the attention of the BearHollow Village Board of Trustees, and will be considered on a case-by-case basis.
  • Parking areas on Lillehammer Lane in the area designated as the Village Square shall only be used by the Owner, tenants and invitees of the Office Building, persons permitted to use the Clubhouse and the residents of the live / work townhouse units facing Lillehammer Lane.
  • There is no parking permitted at any time on either side of Bear Cub Drive.
  • There is no parking permitted in the turn about road area off Bobsled Blvd. by the mail kiosk; pick up and drop off short term parking only.

ENFORCEMENT:

The Board of Trustees shall have the right to promulgate reasonable parking rulesand regulations affecting the Common Area’s in Bear Hollow Village. The Board of Trustees canalso assess fines against any violator and/or have any such vehicle removed if in violation of promulgated rules and regulations. All fines for violations of the Vehicle Rules & Regulations and all expenses incurred by the Homeowners Assn. for enforcement actions will be assessed to the Unit owner associated with the vehicle in violation of the Vehicle Rules & Regulations Policyas a regular Dues Assessment and must be paid in full.

Unit owners are responsible for providing notification to property management agents, long term tenants or nightly rental tenants of the Vehicle Rules and Regulations Policy in BearHollowVillage.

Violations of these Vehicle Rules and Regulations may be reported by any person inBearHollowVillageto the Board of Trustees or their designee. The Board of Trustees will assess fines and/or tow the vehicle in violationof posted parking rules or violations made known by Notice or otherwise to vehicle owners / operators, depending on the specific violation and circumstances and at their sole discretion.

Any vehicle being operated in an unsafe manner or in violation of Utah motor vehicle laws will be identified to the Summit County Sheriff for appropriate and immediate enforcement action.

Alleys, Private Roads, & Common Area Violations:

A vehicle parked on Luge Lane, Upper Luge Lane, Lillehammer Lane, Bear Cub Drive in violation of the Bear Hollow VillageVehicle Rules & Regulations Policy and the posted No Parking signs will be towed at the expense of the vehicle owner.

A vehicle parked on any road designated as an Alley in BearHollowVillage in violation of the Bear Hollow Village Vehicle Rules & Regulations Policy and the posted No Parking signs will be towed at the expense of the vehicle owner.

Vehicles parked in the Village Square that are not the Owner, tenants and invitees of the Office Building, persons permitted to use the Clubhouse and the residents of the live / work townhouse units facing Lillehammer Lane will be towed away at the vehicle owners expense.

Vehicles parked unattended or for extended time periods in the turn about road area off Bobsled Blvd.

by the mail kiosk will be towed away at the vehicle owners expense.

A reasonable effort will be made to notify the owners of vehicles parked elsewhere in Bear Hollow Village in violation of the Vehicle Rules & Regulations Policy that removal of the vehicle from Bear Hollow Village by towing is about to occur.

Any vehicle blocking access to a fire hydrant will be towed immediately at vehicle owner’s expense.

Private Property Violations:

A vehicleon private propertyin violation of the Bear Hollow Village Vehicle Rules & Regulations Policy will have a Notice placed on it describing the violation and requesting an immediate resolution. If there is no resolution within 24 hours a written notice will be sent to the owner of the property requesting immediate action/s/ to resolve the violation cited. The property owner is responsible for correcting all violation/s/ occurring on their property regardless of the ownership of the vehicle on the property.

If the cited violation continues for 5 calendar days after the date of the written notice, the Homeowners Assn. will impose a fine of $50.00 a day, for each day the violation continues, on the property owner where the vehicle in violation is located. The property owner will be notified by the HOA in writing of the date fines commence and the date they are terminated (when the violation ceases). Fines will be added to regular Dues Assessments and must be paid in full.

County Roads Violations:

Bobsled Blvd. and Oslo Lane are designated as County Roads within Bear Hollow Village.

Community residents must obey the parking rules as posted on these roads.

Enforcement actions on these roadways is the responsibility of the Summit County Sheriff.

This Revised Policy is effective commencing August 1, 2015.
