ORDINANCE NO. 13-001

AN ORDINANCE ADDING SECTION 30-2-19 AND AMENDING SECTIONS OF CHAPTER 30 TO THE VILLAGE CODE OF THE VILLAGE OF PLEASANT PLAINS, ILLINOIS.

BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLEASANT PLAINS, ILLINOIS.

SECTION 1: Section 30 – 2 – 8, 30 – 2 – 37 and 38 are hereby repealed, and Section 30 – 2 – 36 is amended and Section 30 – 2 – 19 is added to the Village Code is hereby adopted to read as follows:

ARTICLE II - POLICE DEPARTMENT

DIVISION I - DEPARTMENT ESTABLISHED

30-2-19PART-TIME POLICE.

(A)Employment. The Village may employ part-time police officers from time to time as deemed necessary or desirable.

(B)Duties. A part-time police officer shall have all the responsibilities of a full-time police officer and such specific duties as delineated in the General Orders of the Pleasant Plains Police Department, but the number of hours a part-time officer may work within a calendar year is restricted. Part-time police officers shall not be assigned to supervise or direct fulltime police officers. Part-time police officers shall be trained in accordance with the Illinois Police Training Act (50 ILCS 705/1 et. seq.) and the rules and requirements of the ILETSB.

(C)Hiring Standards. Any person employed as a part-time police officer must meet the following standards:

1.Be of good moral character, of temperate habits, of sound health, and physically and mentally able to perform assigned duties.

2.Be at least twenty-one (21) years of age.

3.Pass a medical examination.

4.Possess a high school diploma or GED certificate.

5.Possess a valid State of Illinois driver's license.

6.Possess no prior felony convictions.

7.Any individual who has served in the U.S. military must have been honorably discharged.

(D) Discipline. Part-time officers shall be under the disciplinary jurisdiction of the chief of police. Part-time police officers serve at the discretion of the President of the Village and shall not have any property rights in said employment, and may be removed by the City/Village/Town authorities at any time. Part-time police officers shall comply with all applicable rules and General Orders issued by the Police Department.

DIVISION II - POLICE CODE

30-2-36RESTRICTIONS ON ACTION TAKEN.

(A)Except in case of the fresh pursuit of a person suspected of having committed a felony within the corporate limits of the Village, no officer shall perform any police duties or functions outside the corporate limits of the Village nor shall any vehicle be driven outside said limits except when in such fresh pursuit

(B)Notwithstanding the foregoing, an officer may respond to a request for assistance from another public police agency with whom the Village has a valid mutual aid agreement; provided however, that the officer should not so respond if the public safety and welfare of the residents of the Village shall be adversely affected thereby.

(C)An officer shall not otherwise perform any police duties or functions outside the corporate limits of the Village unless first specifically authorized by the President of the Board of Trustees.

SECTION 2: This Ordinance shall take effect upon its passage, approval and publication as provided by law.

Passed this 4th day of June, 2012, by the Village Board of Trustees of the Village of Pleasant Plains, Illinois and deposited and filed in the office of the Village Clerk in said Village on that date.
