CALL TO ORDER

The reconvened February 16, 2006 meeting of the Sussex County Board of Supervisors was called to order by Chairman Collins and led in prayer by Supervisor Jones.

Chairman Collins announced that Supervisor Harrell had surgery today and is recovering; therefore he will be absent tonight and that Supervisor Tyler will not be in attendance tonight. He also noted that since Supervisor Fly has not arrived and there is no quorum. However the members present will discuss items on the work session agenda.

Chairman Collins also announced that the Board is continuing to discuss the wage and salary study and Mr. Jerry L. Whitaker, Director of Finance will be meeting with various departments for further review.

BUDGET PRESENTATIONS BY DEPARTMENTS

CountyAdministration

CountyAdministrator Jones advised that a new clerical position is being requested. CountyAdministration is in need of a front desk receptionist/clerical assistant. Ms.

LaToya Parham, Housing Office Staff was assisting us, but since the Housing Programs Office’s relocation to the WaverlyOfficeBuilding, current staff is sharing the front desk tasks. The employee (should the position be approved) will serve as telephone and front desk receptionist, provide clerical assistance to the deputy county administrator, public safety coordinator, animal control officer and building and grounds. The proposed salary is $24,500.00.

In addition, there is a part time custodial position in Building & Grounds, but there is now a need to make that a full time position, especially because of the acquisition of the WaverlyOfficeBuilding. The proposed salary for that position is $24,121.00.

Historical Society

CountyAdministrator Jones advised that Mrs. Barbara Prince of the Sussex County Historical Society is in attendance and will make a presentation to the Board. Ms. Jones also advised that the former Circuit Court and witness room were previously used for storage and is now being cleaned.

Mrs. Prince addressed the Board and advised that since the Sussex County Historical Society’s formation four (4) years ago, it has grown to over one hundred (100) members. The members are interested in promoting and maintaining the community’s history. The Historic 1818 Courthouse remains as the visual symbol of the county government and as such must be preserved and maintained. When the SussexJudicialCenter was constructed, the former courtroom became obsolete and is basically unused. The Society envisions that the space, along with the witness room, be designated for the use of the Society for its meetings and for storage and display of any artifacts and historical documents. The Jamestown 2007 statewide event is fast approaching, which is the opportune time for considering opening this county jewel to the public. Mrs. Prince requested that the Board of Supervisors consider approving the restoration of the former circuit court room and witness room for the aforementioned purposes.

Deputy County Administrator, Jacqueline Macklin-Brown addressed the Board with a request for a 4 wheel drive vehicle for the public safety coordinator. She advised that

staff has reviewed the state contract and found a Ford Explored for $19,957; equipment costs would be approximately $2,100 and lettering would be approximately $1,800. It is possible to acquire a Ford Explorer from a local dealer for less.

Interim Resident Engineer William Richardson addressed the Board and requested that the Board rescind the resolution adopted on February 16, 2006 with regard to the abandonment of a portion of Route 35 and the adoption of three (3) resolutions.

ON MOTION OF SUPERVISOR CAPLE, seconded by SUPERVISOR JONES and carried: RESOLVED that the Virginia Department of Transportation has provided this Board with a sketch dated November 15, 2004; depicting the additions, discontinuances and abandonment required in the secondary system of State Highways, as a result of Project 0621-091-P47,M504;

WHEREAS, the new road serves the same citizens as those portions of old road identified to be abandoned and those segments no longer serve a public need; and

NOW THEREFORE BE IT RESOLVED this Board requests the Virginia Department of Transportation to add to the secondary system of State highways those portions of road identified by the sketch to be added, i.e. Sections 7, 8, 9, 10, 11, & 12, a total distance of 0.71 miles, pursuant to Section 33.1-229, Code or Virginia; and

BE IT FURTHER RESOLVED, this Board abandoned as part of the secondary system of State highways, those portions of roads identified by the sketch to be abandoned, i.e.,

Sections 1,2,3,4,5 and 6, a total distance of 0.73 miles, pursuant to Section 33.1-155, Code of Virginia;

ON MOTION OF SUPERVISOR CAPLE, seconded by SUPERVISOR FLY and carried: RESOLVED that the Virginia Department of Transportation has provided this Board with a sketch dated August 15, 2001, depicting the additions, discontinuances and abandonments required in the secondary system of State highways, as a result of Project 0602-091-189, M501;

WHEREAS, the new road serves the same citizens as those portions of old road identified to be abandoned and those segmentsno longer serve a public need; and

NOW THEREFORE BE IT RESOLVED, this Board requests the Virginia Department of Transportation to add to the secondary system of State highways those portions of road identified by the sketch to be added, i.e., Sections 3,4 and 5, pursuant to Section 33.1-229, Code of Virginia; and,

BE IT FURTHER RESOLVED, this Board abandons as part of the secondary system of State highways, those portions of road identified by the sketch to be abandoned, i.e. Sections 1 and 2, pursuant to Section 33.1-155, Code of Virginia:

BE IT FURTHER RESOLVED, that a certified copy of this resolution be forwarded to the Residency Administrator for the Virginia Department of Transportation.

Mr. Richardson also requested that the board rescind the resolution that was adopted last month regarding the abandonment of old Primary Route 35.

ON MOTION OF SUPERVISOR JONES, seconded by SUPERVISOR FLY and carried: RESOLVED that the resolution abandoning a portion of old Primary Route 35, a distance of 0.27 miles, adopted by the Sussex County Board of Supervisors on February 16, 2006, is hereby rescinded.

ON MOTION OF SUPERVISOR FLY, seconded by SUPERVISOR TYLER and carried: RESOLVED that a section of Primary 35 in Sussex County between Route 622 and Route 622 has been altered and a new road has been constructed and approved by the State Transportation Board which new road serves the same citizens as the old road so altered; and

WHEREAS, the road follows a new location, that being shown on the attached sketch titles “Changes in the Primary and Secondary Systems due to relocation and construction on Route 35, Project: 0035-0910104, M501,” dated February 15, 2006.

NOW THEREFORE BE IT RESOLVED that the Sussex County Board of Supervisors concurs with the recommendation of the Virginia Department of Transportation that the portion of old Primary Route 356 shown in yellow on the aforementioned sketch, a total distance of 0.27 miles, be discontinued as a public road, pursuant to Section 33.1-144 of the Code of Virginia, as amended.

County Administrator’s Report

CountyAdministrator Jones advised that representatives of Atlantic Waste Disposal are present to give their annual report to the Board.

Mr. Mike Kearns, District Manager and Mr. Lee Wilson, Atlantic Waste Disposal provided the annual report and activities.

Meadowview Biological Research Station

CountyAdministrator reminded the Board that this item was tabled from the February 16th meeting. She introduced Mr. Phil Sheridan, Director of Meadowview Biological Research Station.

Mr. Sheridan provided an overview of the agency. He explained that it is a non-profit 501(c)3 organization. The property that the agency owns in SussexCounty is basically a nature preserve and is managed in a similar fashion as the Nature Conservancy’s Piney Grove Preserve. An important part of the preserve is not only to lead occasional guided tours for the public, but also to provide significant educational events focused on preserving the natural biodiversity in SussexCounty. Mr. Sheridan’s requested that the real estate tax on their property in SussexCounty be exempted.

ON MOTION OF SUPERVISOR JONES, seconded by SUPERVISOR FLY and carried: RESOLVED that the Sussex County Board of Supervisors hereby authorizes staff to advertise a public hearing to be held on May 18, 2006, 8:00 p.m., to consider the tax relief request by Meadowview Biological Research Station.

Local Government Challenge Grant

CountyAdministrator Jones advised that there are three organizations that are interested in being part of an application by SussexCounty for funding under the Virginia Commission for the Arts 2007 Local Government Challenge Grants Program. The organizations are:

Rawls Museum Arts $1,000.00 (headquarters in Courtland)

The Local Government Challenge Grant provides a total of $5,000.00 with a required match of $5,000.00 by the locality. Deadline for application is April 3, 2006.

Bio-Solids Ordinance

CountyAdministrator Jones advised that enclosed in the Board’s packet is the proposed Bio-Solids Ordinance for SussexCounty. Staff recommends scheduling a public hearing for April 20th to consider the ordinance. The ordinance does provide for the employment of a Bio-Solids Monitor. A portion of the cost can be reimbursed from the state.

ON MOTION OF SUPERVISOR TYLER, seconded by SUPERVISOR CAPLE and carried: RESOLVED that the Sussex County Board of Supervisors hereby authorizes staff to advertise a public hearing for April 20, 2006, 8:00 p.m. to consider the proposed Bio-Solids Ordinance.

General Assembly Update

CountyAdministrator Jones advised the Board that included in their late agenda packet are copies of General Assembly Updates for their review. The General Assembly will reconvene March 27, 2006.

Chairman Collins stated that Senator Lucas and Delegate Tyler were very supportive of the County’s position on various issues.

Mr. Onnie L. Woodruff, Sussex County Treasurer was present. He advised the Board that his report is included in their packet and would entertain any questions that they had.

Invitation to Bids – Courthouse VFD Vehicle

CountyAdministrator Jones advised that Public Safety Coordinator, Eddie T. Vick is present and will present the bid results for the Courthouse Volunteer Fire Department pumper/tanker.

Mr. Vick reported that a committee composed of himself, Mr. Jerry L. Whitaker (Director Finance) and Mr. Wyatt Cox, (Chief, Courthouse VFD) reviewed and evaluated the bids. The bid results were as follows:

It is the recommendation of the committee to award the bid to Slagle Fire Equipment.

The Board requested that the Public Safety Coordinator bring supporting documentation to the March 23, 2006 work session.

Invitation to Bids – EMS/Western Sussex County

Deputy County Administrator Brown addressed the Board and advised that the EMS Advisory Committee met on March 15, 2006. Bids have been received for EMS services to be provided in the western part of SussexCounty. Lifestar Ambulance rates are $38.00 per hour, 12 hour work days, 6 days per week, for an annual contract amount of $142,272.00. Staff recommends that the Board authorize the contractual agreement with Lifestar at the price quoted.

ON MOTION OF SUPERVISOR TYLER, seconded by SUPERVISOR CAPLE and carried: RESOLVED to accept the recommendation of staff to contract with Lifestar Ambulance Services at a rate of are $38.00 per hour, 12 hour work days, 6 days per week, for an annual contract amount of $142,272.00, with the stipulation that the County Attorney define “emergency” and report to the Board at the March 23, 2006 meeting.

McGill Utility Project

SussexCounty applied for and received a grant award in the amount of $625,000 from the VA Department of Housing and Community Development (DCHD). On Monday, February 27, 2006, the required Contract Negotiation Meeting between representatives from the Virginia Department of Housing and Community, Sussex County representatives and McGill-Leprechaun took place.
