Section1. FloridaCoastalLawReview’smissionistopublishavisibleandforward-thinkingjournalthat influencesandengagesourlegalcommunity. Wechallengeoureditorstoseekpublicationandcultivateanenvironmentofpersonalandprofessionalachievement. LawReviewalsoencouragesscholarlyexcellenceandprovidesaforumfortheexchangeofcutting-edgelegalideas.

ArticleII—Offices

Section1. TheregisteredofficeofFloridaCoastalLawReviewwillbeatFloridaCoastalSchoolofLaw’scampusinJacksonville,Florida.

ArticleIII—Members

Section1. SubjecttotheprovisionsofArticlesIV,V,VI,VII, and VIII,theLawReviewEditorialStaffshall compriseofthosestudents,full-timeorpart-time,currentlyenrolledascandidatesforaJ.D.degreeatFloridaCoastalSchoolofLawwhohavebeenchosenformembershipinaccordancewiththeprovisionsofArticlesVandVI.

Section2. TheLawReviewshallbecomprisedofthreegroups: Candidates,StaffEditors,andtheEditorial Board. CandidatesarenotconsideredmembersofLawReviewuntiltheyhavecompletedtherequirementsinArticleVI. ArticlesIV,V,VI,andVII,and VIII governthevariousdutiesandrightsofeach group.

ArticleIV—EditorialBoard

Section1. TheEditorialBoardshallconsistofatleastnine (9)andnomorethanfifteen (15)members,oneofwhomshallbeEditor-in-Chief. TheothersshallbeapportionedastheoutgoingEditorialBoardseesfitamongthepositionsofExecutiveEditor(s),ManagingEditor,ResearchandWritingEditor,TechnicalEditor,ManuscriptEditor,Senior ArticlesEditor, Notes and Comments Editor,SubmissionsEditor, and such otherpositions as theoutgoingEditorialBoardmaycreate.

Section2. TheEditorialBoardshallconsistofthosememberschosenbytheEditorialBoardthenincumbent. SubjecttotheprovisionsofthisArticleandArticleVII,an EditorialBoard member’stermofofficeshallbeapproximatelyoneyear,officiallybeginninginthesummerterm,upontheterminationofthe previousEditorialBoard’stermofofficeoratsuchtimetheincumbentboardmembervacateshisorherposition. TheexactdatefortheturnoverislefttothediscretionoftheincumbentEditorialBoard. TheselectionformembershiptotheEditorialBoardshallbebyamajorityvoteofthosemembersoftheincumbentEditorial Boardpresent andvotingatameetingdulycalledforsuchpurposeinJanuaryor Februaryof eachyear, after aninterviewprocessastheincumbentEditorialBoardmaydeemappropriate.

Section3. ThemembersoftheEditorialBoardshallbeofequalrankandshallbeentitledtovotesofequal weightonanymatteronwhichtheEditorialBoardmayvote. AquorumoftheEditorialBoardshallconsistoftwo-thirds(2/3)ofitsmembers.

Section4. TheEditor-in-ChiefshallbechargedwiththegeneralresponsibilityofpreparingLawReviewforpublicationandshallhavethefollowingpowers:

(a)To allocate to and amongthemembersof theEditorialBoardsuch powersanddutiesasseemtohimorher appropriate andnecessary, provided,however,such allocation shall not beinconsistent withtheseBylaws;

(b)ToshapetheeditorialpolicyofLawReview,withinthebounds ofintellectualresponsibility,includingrequiringallmanuscriptsacknowledgeallsubstantialaspectsofanissue,regardlessoftheauthor’sultimateconclusion,andtoselectmanuscriptsinconjunctionwiththeSubmissionsEditor. ThisprovisionshallnotbeconstruedtoprecludeamanuscriptfromconsiderationforpublicationforfailureoftheEditor-in-Chieftosorecommend;

(c)Tocall,presideover,andorganizethemeetingsoftheEditorialBoard,providedthatmeetingsoftheEditorialBoardbeheldatleasttwiceeachmonthduringthefallandspringsemesterstodiscusstheprogressofworkbeingdoneandanyothermattersofgeneralinterest;

(d)TovoteonanymattersonwhichamemberoftheEditorialBoardmayvote. InsuchinstancestheEditor-in-Chiefshallbeentitledtoonevote;

(e)ToexecutedutiesnormallyreservedtotheEditorialBoard,whenthe Editorial Board authorizes him or hertodosobyamajorityvote;

(f)Tomanagethe entireoperationsofLaw Review;

(g)TocoordinateallLawReview activities;

(h)Toconductfinalreviewofeachjournaleditionbeforesendingtothepublisher;

(i)Toserveastheprimarycontactwiththepublisher—communicatewiththepublisherconcerningprintingofeachjournal andreview “blue-line”proofsfromthepublisherforcorrectionbeforefinal printingofeachedition;

(j)Tooverseethepublicationprocessandtimeframeforpublication;

(k)Todistributeallassignmentsanddetermineassignmentdeadlines,alongwiththeExecutiveEditor(s);

(l)Toactastheprimaryliaisonbetweenadministration,faculty,FacultyAdvisor(s),andthird parties;

(m)Todistribute complimentarycopiesofnewlyprintedjournalsto membersofFloridaCoastalSchoolofLawfaculty/deans;

(n)Tocomposeandcommunicate,inconjunctionwith theManagingEditor,announcements oftheLawReviewwiththestudentbodyandadministration—e.g.,memberachievements,journalpublication,newmembers,newboard,etc.;

(o)ToberesponsibleforenforcingLawReview’spoliciesandexecutingdisciplinaryproceedingswhenneededwiththeadviceandassistanceoftheEditorialBoard;

(p)TonotifystudentsofselectionasCandidates;

(q)TocoordinatewiththeFacultyAdvisor(s)andRegistrar’sofficeconcerninggrade-oneligibilityforCandidates;and

(r)To attendtheNational Conference of Law ReviewMeetings each spring (withanotheraccompanyingincumbentorincomingEditorialBoardmember).

Section 5. TheManagingEditorshall beprimarilychargedwith coordinationoftheproduction of LawReviewforsubmissiontotheprinter. Incarryingouttheseduties,heorsheshall:

(a)AssisttheEditor-in-ChiefincoordinatingactivitiesoftheLawReview;

(b)Organizeandschedulegeneralmeetingsandboardmeetings,includingpreparinganagendaandmeetingminutes;

(c)KeeppersonnelfilesoneachStaffEditorandCandidateforperformanceevaluation purposes;

(d)Collectmembertimesheetsandkeeptrackofmembers’hourswhenthese Bylaws require such;

(e)KeeptheEditor-in-Chiefinformedofmembers’hourstatusesthroughouteachsemesterandreport totalhoursforeachmembertotheEditor-in-ChiefandFacultyAdvisor(s)attheendofeachsemester,whentheseBylaws require such,orattherequestoftheEditor-in-ChieforFacultyAdvisor(s);

(f)WorkwiththeExecutiveEditor(s)toefficientlyassignStaffEditorsandCandidatesto articles;

(g)WorkwiththeNotesandCommentsEditorandtheSubmissionsEditorintheevaluationofthewrite-oncompetitionandselectionofCandidateNoteandStaffArticlesubmissionsforpublication;

(h)InformtheEditorialBoardifdisciplinaryactionneedstobetaken againstamember;

(i)Coordinateatleastthreesocialfunctionspersemester.

(j)Maintainanupdatedalumni list;

(k)CoordinatewiththeRegistrartoorderLawReviewcertificates andsendtorecentgraduates;

(l)Coordinateand aidintheplanningoftheannualHonorsReceptionwithallinvolved parties;

(m)Develop and update mastheads, tables of contents,andothertables,announcements,oradvertisementsneededforpublicationofeacheditionoftheLawReview;

(n)ServeasthecontactpointforupdatestotheLawReviewwebsite(“Website”). Thisconsists of:

i.Reviewing,atleastfourtimespersemester,thecontentoftheWebsiteandsuggestingareasforimprovementorupdatesthatshouldbemade;

ii.Collectingupdatedmaterials,includingdigitalcopiesofpublishedjournals,fromotherEditorialBoardmembersforpostingtothewebsite;

iii.BringingtotheEditorialBoardsuggestionsfromthemembershipforchangesorupdatestotheWebsite;and

iv.CommunicatingupdatedmaterialsandchangestotheWebsitetotheappropriatetechnicalstaffmember,andwhenappropriate,theFCSLInformationTechnologyDepartmentandFacultyAdvisor(s).

(o)Developandmanage,inconnectionwiththeFacultyAdvisor(s)andadministration,theLawReview budget;

(p)MaintainfinancialrecordsfortheLawReview;

(q)CollectreceiptsforexpendituresfrommembersandworkwithFloridaCoastalSchoolofLaw’sFinanceOfficetodistributereimbursementchecks;

(r)WorkwiththeFacultyAdvisor(s)andFloridaCoastalSchoolofLaw’sFinanceOfficetoobtainfinancingforLawReview’sprojects,supplies,andpublication;

(s)Submitpublisher’sinvoiceforeachjournaleditiontoFloridaCoastalSchoolofLaw’sFinanceOffice;

(t)CoordinatewithFloridaCoastalSchoolofLaw’sadministrationtoorderanddistributegraduationcordsforeachgraduatingmemberofLawReview;

(u)ServeasliaisonbetweenWestlawandLexisNexisforelectronicpublicationofjournals;

(v)RetrieveandmaintainphonemessagesandtheLawReview’sregularmail;

(w)Maintainaninventoryandorderofficesupplies;

(x)Obtainauthorreprintnumbers/addressesforeacheditionandsubmittothepublisherpriortoprinting;

(y)Serve astheprimarycontact withsubscribers,potentialsubscribers,and subscription agents (such asHeinandEbsco);

i.Solicitnewsubscribers,includingdevelopmentandimplementationofasubscriptionsolicitationplan;

ii.Keepcurrent subscribers and their agents awareofanythingpositive ornegativeconcerningtheupcomingissues(suchasnewissues,specialissues,ordelaysinissues);

iii.Communicatewithsubscriberstoensuretheirsubscriptionsareuptodateandsupplysubscriberswithanyissuesthattheymayhaveinadvertentlynotreceived;

iv.Ensurethatallsubscribersaresatisfiedwithourservices;and

v.Maintainandupdateacontactinformationdatabaseofallsubscribers.

(z)Workwiththepublishertocoordinatemailingofeacheditiontosubscribersormaileditionshim/herself;

(aa)ManagearchivedissuesofLawReview,e.g.,twohardcopiesofeachissueshallbemaintainedintheLawReview’sarchives; and

(bb)SolicitanonymousfeedbackfromStaffoncepersemester.

Section6. TheNotesandCommentsEditorshall:

(a)ReviewinternalsubmissionsofCandidatenotesandstaffarticlesforpotentialpublication;

i.OfferselectedStaffMembers/CandidatespublicationandforwardselectedarticlestotheSubmissionsEditor;

(b)Maintainalistofwritingcompetitionsthatmembersareeligibletoenter;

(c)DevelopandmanagetheLawReviewwrite-oncompetitioneachsemester;

i.AtthediscretionoftheNotesandCommentsEditor,heorsheshalloverseeaselectioncommitteethatanonymouslyselectsthewrite-onsubmissionsthatmeetLawReview’sstandards;

ii.TheNotesandCommentsEditorshallconferwiththeFacultyAdvisor(s)toensureeachselectedwrite-onsubmissionmeetsLawReview’sGPArequirements;and

iii.TheNotesandCommentsEditorshalltheninformthosewrite-onsubmissionsoftheirinvitationtojoinLawReview.

(d)WorkwiththeEditor-in-ChiefandFacultyAdvisor(s)intopicselectionforrequiredstaffarticlesubmissions;

(e)KeeptrackofCandidatenotesandstaffarticledeadlinesformembersandanswerquestionsofmembersconcerningtheirpapers;

(f)CommunicatewiththeTechnical,ResearchandWriting,andManuscriptEditorsconcerningtheeditingofLawReviewmemberpapers;and

(g)ConductCandidatenoteandstaffarticletrainingworkshopsatleastoncepersemester.

Section7. TheSubmissionsEditorshall:

(a)Coordinate withtheEditor-in-ChiefandExecutive Editor(s)onthetheme orsubstanceofeachissueofLawReview;

(b)Reviewandselectprofessionalarticles,essays,notes,comments,andbookreviewsforpublicationineachissueofLawReview;

(c)Offercontractstoauthors,handlecontractnegotiationswithauthors,inconsultationwiththeEditor-in-Chiefand/ortheFacultyAdvisor(s), and maintain records of author contracts;

(d)AlongwiththeExecutiveEditor(s),serveasaprimarycontacttoauthorsthroughouttheeditingprocess;

(e)Attendevents/symposiums/conferencesandnetworkswithlegalprofessionals/academiainordertobuildrelationshipstosolicitarticles;

(f)ManagetheLawReview’sExpressOe-mailaccountforonlinearticlesubmissions;

(g)ForwardacceptedarticlestotheExecutiveEditor(s)forincorporationintotheeditingprocess; and

(h)CoordinateandplantheFloridaCoastalLawReviewSpringSymposium,whenscheduled,whichshallinclude:

i.AtthediscretionoftheSubmissionsEditorandinconsultationwiththeEditorialBoard,selectingacommitteetoassistinplanning,coordinating,andrunningtheSymposium(the“SymposiumCommittee”);and

ii.ManagingtheSymposiumCommittee,ifoneisselected,incoordinating,planning,andrunningtheSymposium.

Section8. TheExecutiveEditor(s)shall:

(a)ServeasprimarycontactalongwiththeEditor-in-ChiefandSubmissionsEditorforallauthorsregardingarticles and editingandactastheliaisonforcommunicationbetweentheauthorsandtheLawReviewonarticleissues;

(b)Obtainauthorreprintinformation/addresses,createanExcelspreadsheetforsuchinformation,andsubmittothepublisherpriorto/inconjunctionwithsubmissionoftheentireissueforpublication;

(c)Overseeeditingprocessanddeadlinesforeachjournal;

(d)ConductafinalreviewofeacharticlefromtheStaffEditorsandrevieweachcompletejournal beforesubmittingtotheEditor-in-Chiefforfinalreview;

(e)WorkwiththeManagingEditortoefficientlyassignStaffEditorsandCandidatestoarticlesasthe articlesareacceptedforpublication. AftertheSubmissionsEditoracceptsanarticleforpublication,theSubmissionsEditorforwardsthearticletotheExecutiveEditor(s),whothenassignsthearticleandagroupofStaffEditorsandCandidatesforediting;

(f)ReviewworkofandprovidefeedbacktotheManuscript,Technical,andResearchandWritingEditorsonallwrittenworksbeingpublishedineachissue;

(g)CompileStaffEditor/Candidate“laundry”listsastoanyproblems,questions,orissuesonspecificarticles;and

(h)OrganizeandmeetwithStaffEditorsandCandidatesassignedtoindividualarticlestoreviewconsistentproblems,renumberfootnotes,answerquestions,etc.

Section9. TheSeniorArticlesEditorshall:

(a)BeresponsibleforplanningandorganizingtrainingactivitiesoftheentireLawReview;

(b)Organize,schedule,andfacilitateCandidatetraining;

(c)UpdateCandidatetrainingmanualforeachCandidatetraining;

(d)Conducttrainingupdatesandinformmembersaboutgeneraltrainingconcerns/consistentproblemsatgeneralmeetings;

(e)ProvidefeedbacktoStaffEditors/Candidatesoneditingassignments/memberperformanceatleast twicepersemester;

(f)ServeastheliaisonbetweenWestlawrepresentatives,LexisNexisrepresentatives,andFloridaCoastal School ofLawLibrarystaffwhenorganizingandschedulingStaff EditorandCandidatetraining activities;and

(g)PerformsuchotherEditorial Boarddutiesasthe Editor-in-Chiefmayassign.

Section10. TheManuscriptEditorshall:

(a)Collectcompletedediting assignmentsfromthe SeniorArticlesEditorandconsolidateworkofStaffEditors/Candidatesforeacharticle;

(b)Editthearticle’scontent,grammar,spelling,and punctuation;

(c)Formatarticlesintothepublisher’sshelldocumentbeforethe ExecutiveEditor(s)reviews the articles; and

(d)AssistExecutiveEditor(s)intheirdutiesas needed.

Section11. TheTechnicalEditorshall:

(a)BeresponsibleforreviewingallStaffEditor/Candidateworkthat the Manuscript Editor consolidatedandconductacomprehensiveeditofallBluebooking/citations,aswellasanyotherfootnoteelement containedineachwrittenworkselectedforpublication;

(b)SubmitcompletedtechnicaleditstotheExecutiveEditor(s);

(c)ProvidefeedbackastoindividualStaffEditor/CandidateperformanceoneditingissuesconcerningBluebooking,footnotestructure,andtext;

(d)CollaboratewiththeResearchandWritingandManuscriptEditorstocometoaconsensusonquestionableedits;

(e)AssistExecutiveEditor(s)intheirdutiesas needed; and

(f)Assist Senior Articles Editor with Bluebook Quiz administered during Candidate training.

Section12. TheResearchandWritingEditorshall:

(a)Beresponsibleforreviewingalledits that the Manuscript EditorconsolidatedandconductingacomprehensiveeditofcitecheckingofeachwrittenworktobepublishedinLawReview;

(b)Submit completed, comprehensive editingreviewsofthe articlesforthe entireissue totheExecutiveEditor(s). The Research and Writing Editor shall accompany thecompletededit withalistofremainingcite-checkingissues(e.g.,outstandingInterLibraryLoans). TheResearchandWritingEditorshallfollowupontheseremainingissuesuntiltheyareresolvedoruntilsuchatimetheauthor’sassistance(viatheExecutiveEditor(s))isrequired;

(c)ProvidefeedbackastoindividualStaffEditor/Candidateperformanceoneditingissuesconcerningcitechecking;

(d)CollaboratewiththeTechnical andManuscriptEditorstocometoaconsensusonquestionableedits; and

(e)AssistExecutiveEditor(s)intheirdutiesasneeded.

Section13. IfavacancyontheEditorialBoardarisesoriscreated,theEditorialBoardbymajorityvotemayelectamemberofLawReviewtofillsuchvacancy.

Section14. EachEditorialBoardmembershallbeprimarilychargedwithcarryingoutfinaleditingandrevisionofmanuscripts selectedforpublicationinLaw Review. He orshe shall also performsuch manuscriptscreeningandintermediateeditingastheEditor-in-Chiefshallassign. AlthoughproofreadingresponsibilitiesaretheprimaryresponsibilityoftheManuscriptEditorandExecutiveEditor(s),othermembersoftheEditorialBoardshallalsoperformsuchproofreadingtasksastheEditor-in-Chiefshallassign. AllEditorialBoardmembersshallattendatleasttwo(2)LawReviewsponsoredeventseachsemester. TheEditorialBoardisexpectedtohaveayear-roundcommitmenttothedutiesofLawReview,includingthesummer.

Section15. EditorialBoardCreditHourPolicy. AllmembersoftheEditorialBoardingoodstandingarepermittedtotakenomorethantwo(2)hoursofacademiccreditpersemesterforatotal ofnomorethanfour(4)hoursofacademiccreditpriortotheirgraduation. LawReviewcreditswillbegradedonapass/failbasis. Inordertoreceivea“pass,”each member oftheEditorialBoardshallcompleteaminimumof thirty(30)hoursofworkforeachcredithourinfurtheranceoftheLawReviewandshallconducthimselfaccordingtothecriteriasetforthinArticleVII.

ArticleV—EditorialStaff

Section1. EditorialStaffSelection:

(a)OnceaCandidatehasfulfilledtheirCandidatesemesterrequirements,assetforthinArticleVI,aCandidateshallbecomeaStaffEditorandmemberofLawReview.

(b)EachStaffEditorshallsignaMemberAgreementasaconditionofmembershipofLaw Review.

Section2. Duties. Toremainingoodstandingwith the LawReview, Staff Editorsshall:

(a)Assistinthe preparationofeachsemester’spublication ofLawReviewastheEditorialBoard mayprescribe. All work shall be equitablyapportionedamongthememberssofaraspracticable. Howeverselected,membersshallperformroutineeditorialtasksincluding,butnotlimitedto,initialediting,proofreading,citechecking,casescreening,topicrecording,billing,andindexing. StaffEditorsshouldexpecttodevoteatleastthirty (30)hourseachsemestertothepublicationofLawReview;however,allmembersareexpectedtocontributeadditionaltimeasisnecessarytopublishahigh-qualityscholarlyjournalonschedule.

(b)AttendallLawReviewstaffmeetings. ExceptionsforstaffmeetingsmaybegrantediftheStaff EditorcontactstheManagingEditor,viae-mail,atleasttwenty-four(24)hourspriortothemeetingandshowsgoodcausefortheabsence. In the case of an emergency, the Staff Editor should contact the Managing Editor. AtthediscretionoftheManagingEditorandEditor-in-Chief,theStaff Editor mayberequiredtomeetwiththeManagingEditororEditor-in-Chieftomakeupthemissedstaffmeeting.

(c)AttendanyLawReviewarticleteammeetings that the Executive Editor(s) deem mandatory. The Executive Editor(s) may grant exceptionsforarticleteammeetingsiftheStaff EditorcontactstheExecutiveEditor(s)inchargeofthearticle,viae-mail,atleasttwenty-four (24)hourspriortothemeetingandshowsgoodcausefortheabsence. AtthediscretionoftheExecutiveEditor(s),theStaff EditormayberequiredtomeetwiththeExecutiveEditor(s)tomakeupthemissedarticleteammeeting.

(d)Satisfactorilycompletebytheprescribeddeadline allwork thattheLawReviewEditorialBoard assigns. AllStaff EditorsmustsubmitassignmentextensionrequeststotheExecutiveEditor(s)nolaterthanforty-eight(48)hoursafterreceiving notice of theassignment and show good cause for an extension or delay in an assignment—absentemergencycircumstances. AStaff Editor’sworkincludes,butisnotlimitedtothefollowing:

i.Pullingsourcesandresearchingadditionalsourceswhennecessary;

ii.CompetentcitationandBluebookingefforts;

iii.Accuratelyandproperlypinpointingsources;

iv.Shepardizingand/orKeyCitingcitationstoensureaccuracy;

v.Editingarticlesforadequatefootnotingandgrammar;

vi.Completing all requirements set forth in the Florida Coastal Law Review Editing Checklist; and

vii.Completinganyadditionaltasksthatthe Editorial Board mayassign.

(e)Complete a staff article as defined by Article V, Section 3;

(f)Attend the Florida Coastal Law ReviewSymposium; and

(g)Attendaminimumoftwo(2)LawReviewsponsored social eventspersemester.

Section3. ScholarlyWritingRequirement:

(a)EachStaffEditor,inordertoremainingoodstanding,mustsatisfactorilycompleteastaffarticle,inadditiontotheAdvancedLegalWritingRequirementofFloridaCoastalSchoolofLaw,duringhisorhersecondsemesteronLawReview(e.g.,thesemesterimmediatelyfollowingthecandidacysemester).

(b)Thestaffarticleshallconsistofascholarlyarticleofpublishablequalityofatleasteighteen(18)pagesbutnotmorethanthirty(30)pagesinlength(excludingfootnotes)onanapprovedtopic. TheNotesandCommentsEditorwillapprovetopicsandsetdeadlinesforstaffarticles. TheNotesandCommentsEditorshallhavethediscretiontoselectandapprovetopicsfor staffarticles. Atopic is also acceptable,providedthearticletopicmeets alleligibilityrequirements ofan approved writingcompetition. The Notes and Comments Editor will review staff articlesforresearch,analysis,propercitation,andothercriterianecessarytodeemtheStaffArticleof“publishablequality.” IftheNotesandCommentsEditordeterminesastaffarticleisnotofpublishablequality,theNotesandCommentsEditorshallreturnthestaffarticletothewriter,whowill haveseven(7)daystoresubmitthestaffarticleforfurtherreview.

(c)AdvancedLegalWritingRequirement(ALWR). EachmemberofLawReviewmustsatisfytheALWRassetforthintheStudentHandbookofFloridaCoastalSchoolofLaw. TheALWRmaybesatisfiedthrougha traditional course at FloridaCoastal School of Lawor through anIndependent Study. StudentswishingtousetheirstaffarticletosatisfytheALWRmustconsultwiththefacultymembersupervisingtheALWRprocess. The Notes and Comments Editor must independently approve staff articlesbasedonthecriteriainsubsection(b)above,irrespectiveoftheALWRfacultymember’sevaluationofthetopicorquality.

(d)AnyStaffEditormayappealthedecisionoftheNotesandCommentsEditortorejectastaffarticlebygiving writtennoticetotheManagingandNotesandCommentsEditorswithinfourteen(14)daysoftherejection. Atwo-thirds(2/3)voteoftheEditorialBoardisneededtooverturnanadversedecisionbytheNotesandCommentsEditor.

(e)Ifstaffarticlesaretobeconsideredforpublication,theNotesandCommentsEditorwillformacommitteecomprisedofEditorialBoardmemberstoreviewthesubmissionsanddecideonwhichstaffarticleswillbepublished.

Section4. StaffEditorCreditHourPolicy. AllStaffEditorsingoodstandingarepermittedtotakeone (1) hourofacademiccreditpersemesterforatotalofnomorethanthree(3)hoursofacademiccredit priortotheirgraduation. LawReviewcreditswillbegradedonapass/failbasis. Inordertoreceivea“pass,”eachmemberoftheEditorialStaffshallcompleteaminimumofthirty(30)hoursofworkforeachcredithourinfurtheranceofthe LawReviewandshallconducthimselfor herself according tothecriteriaset forthinArticleVII. AllStaffEditors(otherthanEditorialBoardmembers)whotakeLawReviewforacademiccreditshallkeeptrackoftheirfirstthirty(30)hoursspentonLawReviewassignments,foreachcredittaken,andshallreporttheirhourstotheManagingEditor. Staff Editors writing their staff article for ALWR credit may receive one (1) credit hour for Law Review the semester they write their article, provided they fulfill the minimum thirty (30) hours excluding the hours spent working on the article.

Article VI—Candidates

Section1. CandidateSelection:

(a)Each student, including those selected per subsection (b) of this section, wishing to be considered for membership in Law Reviewshall perform a technical and substantive edit of an excerpt from an unpublished article and complete the writing competition as outlined below.

(b)EachJuneandJanuary,theFacultyAdvisor(s)shallobtainfromtheFloridaCoastalSchoolofLawRegistraralistofstudentswhohavecompletedbetweentwenty-five(25)andthirty-nine(39)credit hours(“QualifyingStudents”). UndertheRegistrar’spolicies,thiscreditrangespanstwo(2)groups: students whohaveearned1-30 credithours (Group A) andstudentswhohaveearned31-60credithours(GroupB). TheRegistrarranksstudentsonlywithintheirgroupsandcannotrankstudentsacrossgroups. The Registrar’slistwillinclude onlythestudentname,credithours, and classrank, butwill not includeastudent’sGPAduetorestrictionsonstudents’rightsunderfederallaw. Transferstudentsarenoteligibleto grade-ontoLawReviewunderthissection.

AninvitationtobeaCandidateofLawReviewshallbeextendedtothoseQualifyingStudentswho have completed the requirements set forth in subsection (a) of this section in good faith and areinthetopfivepercent(5%)accordingtoclassrankinGroupAandthosestudentswhoareinthetopfivepercent(5%)accordingtoclassrankinGroupB,ifany. However,thetotalnumberofinvitedCandidatesfromGroupAandGroupBcombinedshallnotexceedtwenty-five(25)studentsforinvitationsextendedbasedontheJunelistandshallnotexceedfive(5)studentsforinvitationsextendedbasedupontheJanuarylist. IfthetotalnumberofQualifyingStudentswhomeetthefivepercent(5%)thresholdrequirementsexceedstwenty-five(25)orfive(5),respectively,theQualifyingStudentsshallberankedaccordingtotheirpercentilerankwithintheirgroup,bycomputingtheirpercentileranktothefourthdecimal(e.g.,0.0499,or4.99%).

Intheeventmorethanone(1)studenttiesforthetwenty-fifth(25th) orfifth (5th)invitation,respectively,byhavingthesamepercentilerankwithinhisorherrankinggroupasanotherstudenthaswithinhisorherrankinggroup,allstudentswiththatpercentilerankingshallbeextendedaninvitationtobeaCandidateofLawReview,notwithstandingthelimitationonthenumberofCandidates.

A descriptionofthegrade-onproceduresinthissubsectionisattachedasAppendixAtotheseBylaws.

IntheeventtheforegoingprocedureshallnotproducesufficientCandidatestoensurethesmoothand efficientoperationoftheLawReview(includingproducingsufficientfutureStaffEditorsandEditorial Boardmembers),theFacultyAdvisor(s)and/ortheEditorialBoardshallhavethediscretiontoexpandthegrade-oninvitationstootherQualifying Students,providedtheexpansionmethodappliesequallytoGroupsAandB.

(c)Priortothestartofthefallandspringsemesters,theEditorialBoardshallconductawritingcompetition. Thewritingcompetitionpacketshallbedisseminatedtoallstudentswhoshowinterest,butonlystudentswhohavecompleted betweentwenty-five(25)andthirty-nine(39)credithourswithacumulativegradepointaverageofatleast2.50areeligibletoreceiveaninvitationtoLawReview. Transferstudentsareeligibletoparticipateinthewritingcompetitionprovidedtheywillcompleteat leastforty-five(45)creditsatFloridaCoastalafterthecompetitionandreceivedagradepointaverageof 2.50orhigher attheirpreviousschoolandprovideappropriatecorroboratingdocumentation. The NotesandCommentsEditorisresponsibleforadministeringthewritingcompetitionandselectingacommitteefrom amongtheLaw Reviewmembership to reviewselections. Based onthe results of this competition,theEditorialBoardshallextendinvitationstothosestudentswhoseworkmeetsthestandardof“publishablequality” and who complete the technical and substantive editing assignment in good faith. TheEditorialBoardreservestherightnottoextendanyinvitationsifnosubmissionsareofpublishablequality.

(d)Students will complete an assignment that tests their diligence and proficiency with Bluebook legal citation standards and the Florida Coastal Law Review Editing Checklist. Each student is given an error-filled law journal article excerpt and is required to identify and correct the errors. TheEditorialBoardreservestherightnottoextendanyinvitationsifnosubmissionsaresatisfactorily completed.

(e)TobecomeaLawReviewCandidate,astudentmustaccepttheLawReviewinvitationinwriting. UponacceptinganinvitationtobecomeaCandidate,theCandidateshallsignaCandidateAgreement and return the Agreement to the Managing Editor.

Section2. Duties. In order to remain in good standing with Law Review, all Candidates must:

(a)EnrollinandattendaspecialsectionoftheLegalEditingcoursereservedforLawReviewCandidates. The Registrar shall offer thecourseeveryfallsemester,andsuccessfulcompletionofthecourseasa CandidateisarequirementforLawReviewmembership;provided,however,aCandidateinvitedtoLawReviewinaspringsemestermaycompletetheLegalEditingcourseinthefollowingfallsemesterandmaybecomeaStaffEditoruponcompletionofalltheothercriteriainArticleVI,withaconditionsubsequentthattheCandidatesuccessfullycompletetheLegalEditingcourseduringthefirstavailablefallsemester. IfaCandidate cannotregisterfortheLegalEditingcoursedueto schedulingissues,itisthe Candidate’sresponsibilitytonotifyandmeetwiththeFacultyAdvisor(s)assoonaspossibleto discussalternatives. Candidatesdo notreceiveacademiccreditfortheirCandidatesemester,exceptthroughtheabove-mentionedLegal Editingcourse.

(b)AttendallLawReviewstaffmeetings. ExceptionsforstaffmeetingsmaybegrantediftheCandidatecontactstheManagingEditor,viae-mail,atleasttwenty-four(24)hourspriortothemeetingandshowsgoodcausefortheabsence. In the case of an emergency, the Candidate should contact the Managing Editor. AtthediscretionoftheManagingEditorandEditor-in-Chief,theCandidate mayberequiredtomeetwiththeManagingEditororEditor-in-Chieftomakeupthemissedstaffmeeting.

(c)AttendanyLawReviewarticleteammeetings that the Executive Editors deem mandatory. ExceptionsforarticleteammeetingsmaybegrantediftheCandidatecontactstheExecutiveEditor(s)inchargeofthearticle,viae-mail,atleasttwenty-four (24)hourspriortothemeetingandshowsgoodcausefortheabsence. AtthediscretionoftheExecutiveEditor(s),theCandidatemayberequiredtomeetwiththeExecutiveEditor(s)tomakeupthemissedarticleteammeeting.

(d)Satisfactorilycompletebytheprescribeddeadline allworkthattheLawReviewEditorialBoard assigns. AllCandidatesmustsubmitassignmentextensionrequeststotheExecutiveEditor(s)nolaterthanforty-eight(48)hoursafterreceiving notice of theassignment and show good cause for an extension or delay in an assignment—absentemergencycircumstances. ACandidate’sworkincludes,butisnotlimitedto,thefollowing:

i.Pullingsourcesandresearchingadditionalsourceswhennecessary;

ii.CompetentcitationandBluebookingefforts;

iii.Accurateandproperpinpointingsources;

iv.Shepardizingand/orKeyCitingcitationstoensureaccuracy;

v.Editingarticlesforadequatefootnotingandgrammar;

vi.Completing all requirements set forth in the Florida Coastal Law Review Editing Checklist; and

vii.Completinganyadditionaltasksthatthe Editorial Board mayassign.

(e)Draftandsubmitacasenoteof“publishablequality,”asfurtherdescribedinArticle VI, Section3below;

(f)SatisfactorilycompletetheBluebookingQuiz administeredduringCandidate Orientation;

(g)AttendandcompletetheCandidateOrientationheldatthebeginningoftheCandidatesemester;

(h)Attend the Florida Coastal Law ReviewSymposium; and

(i)Attendaminimumoftwo(2)LawReviewsponsored social eventspersemester.

Section3. ScholarlyWritingRequirement:

(a)EachCandidatemustsatisfactorilycompleteastudentcasenoteofpublishablequalitybetweenten (10)andtwelve(12)pagesinlength(excludingfootnotes)inhisorherCandidatesemesteronLawReview. ThecasenoteconsistsofananalysisofarecentnoteworthyFloridaSupremeCourt,UnitedStatesSupremeCourt,orUnitedStatesCircuitCourtofAppealscase,andcertainothersignificantcasesthattheNotesandCommentsEditor may approve in advance. TheNotesandCommentsEditorwillassignandapprovecasenotetopicsandsetthedeadlineforsubmissions.

(b)TheNotesandCommentsEditorwillreviewCandidatecasenotesforresearch,analysis,citation,andothercriterianecessarytodeemthecasenoteof“publishablequality.” IftheNotesandCommentsEditordeterminesacasenoteisnotpublishablequality,theNotesandCommentsEditormay(i)returnthecasenotetothewriterwhowillhaveseven(7)daystoresubmitthecasenoteforfurtherreview,or(ii)rejectthecasenoteasunsatisfactoryandreportthisdeterminationtotheEditorialBoard. CasenotesnotmeetingthestandardssetforthinthissectionwillnotbeacceptedandmayresultintheCandidatenotreceivinganinvitationtobecomeaStaffEditor.

(c)AnyCandidatemayappealthedecisionoftheNotesandCommentsEditortorejectacasenotebygivingwrittennoticetotheManagingand Notes andCommentsEditorswithinfourteen (14)daysoftherejection. ThemembersoftheEditorialBoardshallthenreadthecasenoteandvoteonwhethertooverturn thedecisionofthe NotesandCommentsEditor. A two-thirds (2/3) vote oftheEditorialBoardisneededtooverturnanadversedecisionbytheNotesandCommentsEditor.

(d)Ifcasenotesaretobeconsideredforpublication,theNotesandCommentsEditorwillformacommittee comprised ofmembers of theEditorial Boardto reviewthesubmissions and decideonwhichcasenoteswillbepublished.

Article VII—Warning,Sanction,and Removal

Section1. Expected and Sanctionable Conduct:

(a)ExpectedConductofAllLawReviewMembersandCandidates: ThefocusofsuccessofLawReviewinvolvesacombinationofcomponentsincluding:

i.Timeliness;

ii.Presenceatmeetings;

iii.Cooperation;

iv.Teamwork;

v.Respect;and

vi.Professionalism.

(b)SanctionableConduct: The examples listedbelow are merelyillustrativeanddo notcompriseanexhaustivelistofsanctionableconduct:

i.Verbal Warning. A verbal warning may be issued for any of the following:

  1. First unexcused absence from or tardiness to mandatory meetings or training sessions;
  1. Disrespect to fellow members of the Board, Staff, or Candidates;
  1. Failure to submit a satisfactorily complete edit within twelve (12) hours of the prescribed deadline without noticemay result in a verbal warning; however, an edit submitted between twelve (12) and twenty-four (24) hours without notice shall receive a verbal warning;or
  1. FailingtoattendarequiredLawReviewsponsoredevent—becausetwo(2)LawReviewsponsoredeventsarerequired,two verbalwarningsaregivenifzero(0)eventsareattended,andone verbal warningis givenifone(1)eventisattended.

ii.Written Warning. A written warning may be issued for any of the following:

  1. Failure to submit a satisfactorily complete edit between twenty-four (24) hours and forty-eight (48) hours after the proscribed deadline without notice;
  1. Failuretoproducerequired work product;
  1. Failuretosatisfactorilycompleteassignedadministrativetasks;
  1. Multiple unexcusedabsencesfromortardinesstomandatorymeetingsortrainingsession;
  1. Failuretoconductoneselfinafairandprofessionalmanner;or
  1. ConductlikelytobringdisreputetoLawReview.

iii.Conduct Subject to Immediate Removal. Some conductissoegregiousastobringsuchdisreputetoLawReviewthatitwarrantstheimmediateinitiation oftheremovalproceedingsoutlined inArticleVII, Section3. Such egregiousconduct is subject totheimmediateinitiationoftheremovalproceedingsoutlinedinArticleVII,Section3includes,butisnotlimitedto:

  1. AnyviolationoftheFloridaCoastalSchoolofLawHonorCodeorStudentConduct Code;
  1. Plagiarism;
  1. Cheating;
  1. Stealing;
  1. Assistingcompetitorsinthewrite-oncompetition;
  1. Improperlyinfluencingtheoutcomeofthewrite-oncompetition;
  1. Sexualharassment;
  1. Failing to remain in good academic standing with Florida Coastal School of Law;
  1. Anyconductrisingtothedegreeofseverityillustratedintheaboveexamples; or
  1. Examples listed below under member-specific and Candidate-specific removable conduct.

Section2. MemberDiscipline:

(a)Verbal Warning

i.Uponreceiving notification from the Editor-in-Chief that a Staff Editor is in violation of Article VII, Section 1(b)(i),theStaff EditorshallmeetwiththeEditor-in-ChiefattheEditor-in-Chief’searliestconvenience to receive the Staff Editor’s verbal warning.

ii.Two (2) verbal warnings constitute a written warning for purposes of removal.

(b)WrittenWarning

i.AnymemberoftheLawReviewmayreceiveawrittenwarningissuedbytheEditor-in-Chief wheninviolationofanyoftheseBylaws. A warningmaybe issued bytheEditor-in-ChiefactingaloneorbyrequestofthreeEditorialBoardmembersinaccord.

ii.Beforeissuanceofawrittenwarning,theEditor-in-ChiefandanypersontheEditor-in-Chiefdeemsnecessaryshallmeetwiththeoffendingstaffmember.

iii.ThewarningshallbeissuedinwritingonLawReviewletterheadwithnotificationtotheEditorialBoardandFacultyAdvisor(s)priortoissuanceforthepurposeofdiscussion.

  1. Acopyofthewarningshallbeplacedinthemember’sfile.
  1. AnyEditorialBoardmembershall send by certifiedmailorpersonallydeliverthewrittenwarningtothemember.
  1. Whenwrittennoticeofawarningisgiventothemember,thatmembershallsignthewarning,noteanyobjections,andreturnittotheEditorialBoardwithinfive(5)businessdays. TheobjectionshallbepreservedasprimaryevidencefortheremovalandhearingprocedureasoutlinedinArticleVII,Section3.
  1. Failuretostateanyobjectionsconstitutesawaiverofanyabilitytoobject laterinaremovalandhearingprocedureasoutlinedinArticleVII,Section3.

(c)Member-Specific ConductSubjecttoImmediateRemoval. The Editorial Board may, without issuing a warning, immediately dismiss any Staff Editor who:

i.Turns in an editingassignment more thanforty-eight(48)hours aftertheassigneddeadline,withoutproviding appropriatenoticeand receiving anextensionasdescribedinArticleV, Section 2(d);

ii.Fails to submit a staff article; or

iii.Engages in any action the Editorial Board deems to be a flagrant violation of the purpose and mission of Law Review or to be unprofessional and detrimental to the organization.

Section3. MemberRemovalandHearingProcedure:

(a)An Editorial Board member shall send by certified mail or deliver in person anoticeofremovaltothemember:

i.Uponaccumulationoftwo(2)ormorewritten warnings forsuch conductoutlinedinArticle VII, Section 1(b)(ii);

ii.Upon accumulation of four (4) or more verbal warnings from such conduct outlined in Article VII, Section 1(b)(i);

iii.Upon accumulation of an equivalent combination of written and verbal warnings per Article VII, Section 2(a)(ii); or

iv.UponanysingleviolationasoutlinedinArticle VII, Section 1(b)(iii)and Section 2(c).

(b)Themembershallhaveten(10)daysfromthedateofmailingoftheremovalnoticetomakeawrittendemandforanappealshearing. ForpurposesofthisSection,ane-mailshallconstituteawriting. Everymemberisentitledtorequestanappealshearing. Removalshallbeautomaticunlessthememberrequestsanappealshearingasprovidedinthisparagraph.

(c)TheEditor-in-Chiefshallthenscheduleadatefortheappealshearing. Theappealshearingshallbeheldwithintwenty(20)daysfromthemailingoftheremovalnotice;forpurposesofArticle VII, Section 3(b)-(c), adayshallnotincludeweekends,holidays,anyschoolholiday,oranydayclassesarenotinregularsession.

i.AllmembersoftheEditorial Boardand FacultyAdvisor(s)shallbegiventheopportunitytoattendtheappealshearing.

ii.TheEditor-in-Chiefshallpresideoverthehearing.

iii.Thehearingshallbevideotapedorotherwiserecordedinavisualmedium.

iv.Themembershallhaveamaximumoffifteen(15)minutestopresenthisorherargumentandadefense.

(d)ThevotingbodyconsistsoftheEditorialBoard. Atwo-thirds(2/3)quorumofthevotingbodyisrequiredtosustainremovalofthemember.

(e)Two-thirds(2/3)majorityofthequorumisrequiredtoremoveamember.

i.Shouldadisqualifyingmajorityvotebereached,themembershallberemoved.

ii.Shouldadisqualifyingmajorityvotenotbereached,themembershallnotberemoved. However,accumulationofasubsequentwarningshallinitiatetheremovalprocessasoutlinedinArticleVII,Section3.

iii.Ineithersituation,aNoticeofActionAfterAppeal,eitheraffirmingorreversingthepriordecisiontoremove,shallbesentviacertifiedmailtothemember.

(f)Removaland AcademicCredit

i.It shallbe the solediscretion of the FacultyAdvisor(s) to determine thepass/failgrade ofanymemberregisteredforacademiccreditthatsemester.

ii.TheFacultyAdvisor(s)shall have thediscretion to notifyotherFloridaCoastal School ofLawpersonnel,includinganyfacultymemberswithsupervisoryauthorityovertheremovedCandidate,ofsuchmember’sremoval.

Section4. CandidateDiscipline:

(a)The Editorial Board will evaluate only Candidates with two (2) or fewer verbal warnings or one (1) or fewer written warningsfor membership on Law Review.

(b)Candidate-Specific Conduct Subject to Immediate Removal. TheEditorialBoardmay,withoutissuingawarning,immediatelydismissanyCandidatewho:

i.Turns in an editingassignment more thanforty-eight(48)hours aftertheassigneddeadline,withoutproviding appropriatenoticeand receiving anextensionasdescribedinArticleVI,Section2(d);

ii.Failstosatisfactorilycompletetheabove-mentionedLegalEditingcourse;

iii.Failstosatisfactorilycompletetheabove-mentionedBluebookQuiz; or

iv.EngagesinanyactiontheEditorialBoarddeemstobeaflagrantviolationofthepurposeandmissionofLawReviewortobeunprofessionalanddetrimentaltotheorganization.

(c)Uponreceivingthefirst verbal or written warning,theCandidateshallmeetwiththeEditor-in-ChiefattheEditor-in-Chief’searliestconvenience.

(d)Uponreceivinga secondverbal warning,theCandidateshallmeetwiththeEditor-in-ChiefandtheFacultyAdvisor(s)attheirearliestconvenience. Thesecondverbalwarningwillalsoresultinthe equivalent of awrittenwarning,notifyingtheCandidatethatone(1)morewrittenwarningwillresultintheautomaticremovalfromparticipationonLawReview.

(e)Uponreceiving a sanction beyond the equivalent of asecondwrittenwarning,theCandidate’sparticipationonLawReviewisautomaticallyterminated.

(f)AnyCandidatedismissedunderthisSectionmay appealunderSection5ofthis Article.

Section5. CandidateInvitations,Removal,andHearingProcedures:

(a)InformationpertainingtoaCandidate’sparticipationandconductwithintheorganizationwillbeshared,asnecessary,amongtheEditorialBoardandwiththeLawReviewFacultyAdvisor(s).

(b)AttheendoftheCandidatesemester,theEditorialBoardwillevaluatetheCandidate’spersonnelfileandconsidertheCandidate’sBluebookingQuiz,casenote,editingassignments,attendanceatLawReviewsponsoredevents,andoverallparticipationonLawReview.

(c)TheEditorial Board,inconsultationwiththeFacultyAdvisor(s),shalldeterminewhethertheCandidatewillreceiveaninvitationtobecomeamemberofLawReview.

i.A Candidate may appeal thisdecisiontotheFacultyAdvisor(s)bye-mailingorpersonallynotifying,inwriting,theFacultyAdvisor(s)oftheCandidate’sobjectionsnolaterthanfive(5)daysafterreceivingnotificationthataninvitationwasnotoffered.

ii.TheFacultyAdvisor(s), uponappropriatenotice,shallmeetwiththeCandidatetodiscusstheEditorialBoard’sdecisionandheartheCandidate’sobjections.

iii.Afterthemeeting,theFacultyAdvisor(s)shallconsiderthemeetingandallotherinformationthat theEditorialBoardprovides concerningthe Candidateandrender afinal decisionregardingtheCandidate’sinvitation.

iv.TheFaculty Advisor(s)shallnotifytheCandidate,viae-mail,ofthefinaldecisionregardingtheinvitation.

v.IftheFacultyAdvisor(s)determinesaninvitationshouldbeissued,theEditorialBoardshallpromptlyissuetheCandidateaninvitationtobecomeamemberofLawReview.

(d)DecisionsoftheEditorialBoardunderthisArticle,exceptasprovidedabove,arefinal. Thisdiscretionappliestodecisionsrelatedto:

i.Publishablequality;

ii.Satisfactorycompletionofeditingassignments;and

iii.Egregiousconduct.

Section6. EditorialBoardDisciplineandImpeachmentProcedures:

EditorialBoardmemberswillbesubjecttothefollowingDisciplinaryandImpeachmentProcess:

(a)Verbal Warning

i.AnyEditorialBoardmember mayreceiveaverbalwarningfromtheEditor-in-Chief forviolationoftheseBylaws,includingbutnotlimitedto,notperforminghisorhereditorialresponsibilitiesinasatisfactorymannerandanyconductthatreflectspoorlyontheLawReview. The Editor-in-Chief may issue awarningby acting alone orbytherequestoftwo(2)EditorialBoardmembersinaccord. TheEditor-in-ChiefshallscheduleameetingwiththeoffendingEditorial Board memberand duringthemeeting shall informtheoffendingEditorialBoardmemberofthegrounds. TheEditor-in-Chiefshalltakeminutesofthemeeting.

ii.Afterissuanceoftheverbalwarning,theentireEditorialBoardshallbenotifiedinwritingofthewarningandthegroundsthereof. TheminutesofthemeetingshallbeplacedintheoffendingEditorialBoardmember’spersonnelfile.

(b)WrittenWarning

i.Afteraverbalwarningisgiven,the Editor-in-Chief may issue a written warning to an Editorial Board member for anyadditionalviolationoftheBylaws,includingbutnotlimitedto,notperforminghisorhereditorialresponsibilitiesinasatisfactorymannerandanyotherconductthatreflectspoorlyontheLawReview.The Editor-in-Chief may issue awritten warningby acting alone orbytherequestoftwo(2)EditorialBoardmembersinaccord.

iii.TheEditor-in-Chief shall issue the written warninginconjunctionwithatleastone(1)FacultyAdvisor.

iv.The warningshallbe issuedinwritingon LawReviewletterheadwith notificationtotheEditorialBoardandFacultyAdvisor(s)priortotheissuance.

a.AcopyofthewarningshallbeplacedintheEditorialBoardmember’spersonnelfile.

b.TheEditor-in-Chief shall either send by certified mail or personally deliver the writtenwarning totheEditorialBoardmember.

c.WhentheEditorialBoardmember receives the written warning,theEditorialBoardmembershallsignthewarning,noteanyobjections,andreturnittotheEditorialBoardwithinfive(5)businessdays. TheobjectionsshallbepreservedasprimaryevidencefortheimpeachmentprocedureasoutlinedinArticleVII,Section6(c).

d.FailuretostateanyobjectionsconstitutesawaiverofanyabilitytoobjectlaterinanimpeachmentprocedureasoutlinedinArticleVII,Section6(c).

(c)ImpeachmentProceedings

i.Ifafteranverbalwarningandsubsequentwritten warning,anEditorialBoardmemberviolatestheBylaws,includingbutnotlimitedtonotperforminghisorhereditorialresponsibilitiesinasatisfactorymannerandanyotherconductthatreflectspoorlyontheLawReview,theEditorial Boardmembermaybesubjecttoimpeachmentproceedings. Four (4) Editorial Board members acting in accord may institute impeachment proceedings.

ii.TheEditor-in-Chief shall either send by certified mail or personally deliver the noticeofimpeachmentproceedingstotheoffendingEditorialBoardmember.

iii.TheEditor-in-Chiefshallthenscheduleadatefortheimpeachmentproceedings. Theimpeachmentproceedingsshallbeheldwithinten(10)businessdaysofthemailingoftheimpeachmentnotice.

a.AllmembersoftheEditorial Boardand FacultyAdvisor(s)shallbegiventheopportunitytoattendtheimpeachmentproceedings.

b.TheEditor-in-Chiefshallpresideovertheproceedings.

c.Theproceedingsshallbevideotapedorotherwiserecordedinavisualmedium.

d.TheoffendingEditorialBoardmembershallhaveamaximumoffifteen(15)minutestopresenthisorherargumentandadefense.

iv.Aftertheoffending EditorialBoardmemberhaspresentedhisorherdefense,theother membersoftheEditorialBoardshall,bysecretballot,votewhetherornottoimpeachtheoffendingmember. IfnotallEditorialBoardmembersareinattendance,theabsentmembersshallwatchtherecordingwithintwo(2)daysandshallcasthisorhervoteinthesamemanner. TheManagingEditor shall keepallballotsuntilallmembers vote. A two-thirds (2/3) majorityof theentireEditorialBoardisrequiredtoimpeachtheoffendingEditorialBoardmember. TheoffendingEditorialBoardmembershallbenotifiedinwritingonLawReviewletterheadwithnotificationtotheEditorialBoardandthe FacultyAdvisor(s). Acopyofthe lettershallbeplacedinthemember’spersonnelfileandthe Editor-in-Chief shall deliver the letter either via certified mail or personally totheoffendingEditorialBoard member.

a.Shouldadisqualifyingmajoritybereached,theEditorialBoardmembershallbeimpeachedandthereafterbecomeaStaffEditor. TheimpeachedEditorial BoardmembermaynotbeconsideredagainforapositionontheEditorialBoardfortheremainderofthatindividual’stimeasamemberoftheLawReview.

b.Assoonaspractical,thevacantEditorialBoardpositionshallbefilledpursuanttoArticleIV,Section13,unlesstheEditorial BoardmemberimpeachedwastheEditor-in-Chief. IftheEditorialBoardmemberimpeachedwastheEditor-in-Chief,theEditorialBoardshall,bymajorityvote,selectamongthemselvesthereplacementfortheEditor-in-Chiefposition.

(d)IntheeventtheEditor-in-ChiefistheoffendingEditorialBoardmember,theManagingEditorwill actinplaceoftheEditor-in-ChiefforallproceedingsinthisSection.

Article VIII—Leaveof Absence

Section1. AnymemberorCandidateoftheLawReviewwhoisgrantedaleaveofabsencebytheDeanofFloridaCoastalSchoolofLawshall,uponcommencementofhisorherleaveofabsence,beremovedfromtheLawReview. UponhisorherreturnandreenrollmentinFloridaCoastalSchoolofLaw,anysuchpersonshall bereinstatedtohisorherpreviousstatusonLawReview. AnypersonwhohasbeeninvitedtobecomeamemberorCandidatebutisunable,becauseofleaveofabsence,tobeginworkasamemberatthedesignatedtime,shallbere-invitedtobecomeamemberuponsubsequentenrollment. Any personwhowouldhavebeeneligibleformembershiporasaCandidate,butdidnottendertheappropriatenoticetotheEditor-in-ChiefbecauseheorshehadbeengrantedaleaveofabsencebytheDeanofFloridaCoastalSchoolofLaw,shallbeinvitedtoparticipateonLawReviewifheorshetendersthenoticewithintwo(2)weeksofhisorherreenrollmentinFloridaCoastalSchoolofLaw.

ArticleIX—FiscalMatters

Section1. Accounting. ThefiscalyearoftheLawReviewshallrunfromAugusttoJulyofeveryyear,orsuchotherperiodasFloridaCoastalSchoolof Law’sFinanceOffice prescribes.

Section2. FiscalControls:

(a)AnnualBudget. TheManagingEditorshallprepareand,atleastthree(3)monthspriortothecommencementofeachfiscalyear,submittotheEditorialBoard,aproposedannualbudgetoftheLawReviewforthenextfiscalyear. Theproposedbudgetshallidentifyanticipatedrevenuesourcesandlevelsandshall,totheextentpractical,identifyanticipatedmaterialexpenseitemsbylineitem.

(b)FeesandCharges. TheEditorialBoardshallsetfeesandchargesfortheservicesandbenefitsthattheLawReviewprovides withthe goalsof recoveringthereasonable costsoftheoperationoftheLawReviewandestablishingreasonable reservesfor future expensesandcontingenciesreasonablyrelatedtothelegitimateactivitiesoftheLawReview. Suchfeesandchargesshallbefairandequitable.

(c)Reimbursements. OnlytheEditorialBoard,oraneditorworkingatthedirectionoftheEditorial Board,shallhavetheauthoritytoincuradebtthatthe Law Reviewmustreimburse. Theremust beanitemizedreceiptsubmittedforreimbursement,inaccordancewiththepoliciesoftheFloridaCoastalSchoolofLawFinanceOffice.

ArticleX—Amendments

Section1. Overview:

(a)AllmembersofLawReviewshallhavethepowertoproposeanamendmenttotheBylaws.

(b)TheEditorial BoardshallsitastheBylawsCommittee.

Section2. Procedure:

(a)Amemberproposinganamendmentshallsubmittheproposalinwriting totheManagingEditor. Amemberproposinganamendmentshall,inadditiontodraftingthelanguageoftheproposedamendment,explaininwritingthereasoningbehindtheproposedamendment,alongwithanyportionoftheBylawsthatthe proposal willaffectinanyway,totheManagingEditor.

(b)TheManaging Editor shall distribute theproposal totheBylawsCommittee and thegeneral membershipwithinthirty(30)daysofreceiptinordertoconsidertheamendment.

i.AnyproponentoftheamendmentshallhavetheopportunitytobeheardbytheBylawsCommittee atthetime itconvenes toconsider theproposed amendment. Anymember ofLawReviewshallhavetheopportunitytobe heard bythe BylawsCommitteeconcerningtheproposedamendmentatthetimetheBylawsCommitteeconvenestoconsidertheproposedamendment. IftheproponentisamemberoftheBylawsCommittee,heorsheshallhavetheopportunitytobeheard, andheorsheshallretainhisorherrighttovote.

ii.Theproposedamendmentmustreceiveatwo-thirds(2/3)voteoftheBylawsCommitteetopass.

(c)UpontheBylawsCommittee’sapprovalofanamendment,theEditor-in-ChiefshallhavetheamendmentincorporatedintheBylawsandshallnotifythemembershipwithintwo(2)days.
