AN ORDINANCE AMENDING RESOLUTION 74-1445-498, AS AMENDED BY RESOLUTIONS 80-630-217 AND 81-720-334, ORDINANCE 85-932-570, RESOLUTIONS 86-1348-431, 87-1405-459, 89-776-289, 90-64-31, 96-878-318, AND 1999-876-A, AND ORDINANCES 2000-811-E, 2003-222-E, 2003-1276-E, 2004-425-E, 2004-913-E, 2007-191-E, 2009-732-E, 2010-268-E, 2011-417-E AND 2012-28-E,WHICH APPROVED A DEVELOPMENT OF REGIONAL IMPACT (DRI) FOR THE VILLAGES OF ARGYLE DRI, TO AMEND THE DRI DEVELOPMENT ORDER PURSUANT TO THE NOTIFICATION OF A PROPOSED CHANGE (NOPC) TO A PREVIOUSLY APPROVEDDRI DEVELOPMENT ORDER FILED BY AFI ASSOCIATES, INC., DATED JULY 24, 2013, AS AMENDED ON MARCH 28, 2014,TO MODIFY MASTER PLAN, MAP H, AND TO PERMIT CERTAIN MODIFICATIONS TO THE DRI DEVELOPMENT ORDER AS DESCRIBED THEREIN; FINDING THAT THESE CHANGES AND MODIFICATIONSDO NOT CONSTITUTE A SUBSTANTIAL DEVIATION FROM THE ORIGINALLY APPROVED; AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, as listed above, the Council adopted and amended a Development of Regional Impact Development Order for the development known as the Villages of Argyle DRI; and

WHEREAS, AFI Associates, Inc.,has submitted a Notification of a Proposed Change to a Previously Approved Development of Regional Impact (NOPC), dated July 24, 2013,as amended on March 28, 2014, modifying the Master Plan, Map Hand to permit certain modifications to the Villages of Argyle DRI; and

WHEREAS, the NOPC has been submitted to the appropriate state and local planning agencies and has been reviewed by the City’s Planning and Development Department; and

WHEREAS, the Planning and Development Department has submitted recommendations concerning the NOPC; and

WHEREAS, the Land Use and Zoning Committee has reviewed the NOPC and made its recommendation to Council; and

WHEREAS, the Northeast Florida Regional Council found that the proposed changes do not result in any additional adverse regional impacts and do not constitute a substantial deviation from the originally approved DRI; and

WHEREAS, a public hearing was properly noticed and held by the Council pursuant to Section 380.06, Florida Statutes; and

WHEREAS, after such public hearing and in consideration of the recommendations made and submitted to the Council, the Council has made certain findings and determinations; now therefore

BE IT ORDAINED by the Council of the City of Jacksonville:

Section 1.The DRI Development Order for the Villages of Argyle DRI is hereby amended to incorporate the proposed changes and modifications contained in the NOPC dated July 24, 2013, as amended on March 28, 2014,and revised on file in the City Council Legislative Services Division, including the revised Master Plan Map Hattached hereto as Exhibit 1.

Section 2.The Council hereby finds that the changes and modifications set forth in the NOPC dated July 24, 2013, as amended on March 28, 2014, do not constitute a substantial deviation, as defined in Section 380.06(19), Florida Statutes.

Section 3.The Legislative Services Division is hereby directed to forward a certified copy of this Ordinance to the following, immediately upon its effective date: Ana Richmond, Florida Department of Economic Opportunity, Division of Community Planning and Development, 107 East Madison Street, Tallahassee, Florida 32399; Mr. Edward Lehman, Director of Planning and Development, Northeast Florida Regional Council, 6850 Belfort Oaks Place, Jacksonville, Florida 32216; and Staci M. Rewis, Esq.,225 Water Street, Suite 1750, Jacksonville, Florida, 32202,agent for AFI Associates, Inc.

Section 4.Effective Date. The adoption of this ordinance shall be deemed to constitute a quasi-judicial action of the City Council and shall become effective upon signature by the Council President and the Council Secretary.
