Conditions of North Fremantle Community Centre hire

Read these conditions carefully before completing the application form.

These conditions of hire shall form part of your approval, should approval be granted.

General conditions

  • All bookings are subject to the applicant being responsible for compliance with legislative requirements including City of Fremantle policies, local laws and regulations.
  • No city managed public spaces or venues can be booked for public events more than 12 months in advance unless otherwise agreed to by contract with the City (a process that requires Council approval).
  • The City reserves the right to decline an event application based on any of the following:
  • The event does not align with the City’s strategic objectives
  • The event does not promote Fremantle in a progressive and/or positive light
  • The City reserves the right to refuse hire to any individual, group or organisation.
  • North Fremantle Community Centre is only to be used for meeting type activities or small events up to 100 people or low-key dance classes (no tap or heals). No parties, dances and the like are permitted.
  • Bookings will not be made to catering providers who intend to use the centre to provide catering services to clients.
  • Sub-letting is not permitted under any circumstances.
  • The applicant is not permitted to extend the hire time. All participants including their caterers, bar staff, guests and any equipment associated with the booking must vacate the facilities within thirty minutes of the hire time. Failure to comply with this will result in a penalty charge being equal to double the appropriate hourly rate.
  • Bookings for events will only be considered confirmed once payment of all applicable fees and bonds have been received.
  • Hire times are to incorporate any time required for pre-event deliveries and/or set up arrangements and must be indicated on the application form.
  • The City reserves the right to refuse, cancel and/or withhold the hiring of North Fremantle Community Centre should special circumstances warrant such action. Should a confirmed booking be cancelled in such circumstances all monies paid to the City will be refunded. A minimum period of three weeks notice is to be provided.
  • The right to refuse the hiring of North Fremantle Community Centre facilities extends to the City’s interpretation of what is deemed appropriate or otherwise in each circumstance. For example, any activity which may cause anti-social behaviour or complaint from properties in the vicinity would not be supported.
  • It should be noted that the City of Fremantle does not give any warranty as to the suitability of the premises for the stated purposes of the applicant, and whilst the City takes reasonable care to present the premises in sound operational condition, the City rejects any responsibility for any event or circumstance that is beyond the City’s control which may adversely impact upon the applicant’s operation and use of the premises. Should such circumstances eventuate the applicant acknowledges and accepts that it is not entitled to any refund, partial or whole, of any monies that may have been paid to the City as part of the hire agreement. Any decision to refund any monies is to be at the sole discretion of the City.
  • North Fremantle Community Centre is a non smoking venue.
  • The entire centre must be left clean after each use of the venue and all equipment is removed from the premises. Storage at the venue is only permitted when requested in writing to the City and approved by the city’s Booking’s officer. Additional cleaning will be at the expense of the applicant.

Cancellation and payment

  • Cancellation of a confirmed booking is required in writing to the City’s bookings officer. Cancellation within seven days will forfeit total hire fees paid. Booking fees are not refundable.
  • Keys can be collected at the Service and Information Centre at the City’s Administration building.
  • All fees and charges for North Fremantle Community Centre bookings are inclusive of a 10% GST, unless legislation provides otherwise, and will be detailed on a tax invoice (if requested).
  • Credit card payments incur a 0.5% surcharge
  • Bonds are GST exempt; however, any charges taken from the bond for loss of keys or damages are subject to GST and will be detailed on a tax invoice (if required) with the return of the remainder of the bond.
  • All bookings which fall outside of the current financial year (FY) will be charged at the rates as approved by the City in that financial yearschedule of fees and charges – not at the rates at time of booking.
  • Bonds are refundable in full provided there are no damages or additional cleaning costs to be deducted therefrom. If the cost of damages and/or additional cleaning exceeds the bond paid, such additional expenses will be recovered from the applicant.
  • All bond refunds are returned via cheque, subject to submission of a bond refund form.
  • Allow 4 weeks following submission of your bond refund form for your bond refund to be processed.

Damage

  • Any person found to be damaging equipment or the building will be requested to vacate the premises.
  • All breakages, for example glass, must be cleaned up immediately. If necessary, the event should cease until broken glass is removed (this is for the safety of the public).
  • The applicant is liable for all damages.
  • Any faults or damage to North Fremantle Community Centre/facilities or equipment is to be reported to the City’s bookings officer on 9432 9712 or via email on prior to or after usage.

Display and signage

  • The use of masking tape, blue tac, nails, hooks, staples or any other fixing device is prohibited on any internal or external surface, including the walls, doors or stage. Any paint chips result in a penalty being deducted from the bond. paid

At the event

  • City officers have the authority to act on the City’s behalf during anevent and are to be allowed access at any time.
  • If a City officer is required to attend to any matter outside of normal working hours the applicant is to be charged the cost of the call out (minimum four hours). City staff is ONLY on call for emergency building maintenance issues.
  • All lights must be turned off after use.
  • The City does not provide a duty caretaker or security officer. If a security presence is required it is the responsibility of the applicant to make appropriate arrangements and cover all associated costs. Security may be a condition of hire for large events and numbers of guards should be based on two for the first 100 patrons and then one for every 50 patrons after that. A copy of your booking confirmation outlining security services must be forwarded to the City’s bookings officer prior to the event.

Protection of people and property

  • Insofar as compliance with the requirements of the hire conditions permits, the applicant is to:

provide all things and take all measures necessary to protect people and property

Prevent nuisance and unreasonable noise and disturbance.

  • The applicant must have current insurance cover for:

Public liability to the value of $10, 000, 000.00. If anapplicant does not have public liability insurancecover it may be available through Western Australia’s Community Groups Insurance Facility. Forms can be found on the Local Community Insurance Services (LCIS) website

Workers’ compensation to the full extent of liability under the Workers' Compensation and Injury Management Act 1981(if applicable).

  • A copy of the insurance certificates of currency (for the specific event and indemnifying the City as listed below), must be provided to the City’s Bookings Officer prior to your event.
  • The applicant shall indemnify the City against:

loss of or damage to property of the City, including existing property

Claims by any person against the City in respect of personal injury or death or loss of or damage to any property arising out of or as a consequence of the actions of the applicant.

Liquor consumption and sale

  • Liquor is not permitted to be consumed or sold at the centre.

Copyright and public performance of music

  • The applicant is responsible for any infringement of copyright in connection with the performance of any musical, literary or dramatic works in any City Venue.
  • If performing at the hall you may be required to obtain Australasian Performing Right Association (APRA) and Phonographic Performance Company of Australia (PPCA) live performance licenses. Contact APRA (08) 9382 8299 and PPCA on (02) 9267 7877.
  • Private and non commercial events are either covered by the license held by the City or are exempt under licensing regulations.
