  1. These notes are for general guidance only, full particulars of a ‘Regularisation’ request are contained in Regulation 18 of the Building Regulations 2010.
  1. One copy of this notice should be completed and submitted with plans and particulars showing the works carried out. Where Part B (Fire Safety) imposes a requirement in relation to building work a further two copies of the plans should be sent in.
  1. A regularisation application must be accompanied with the appropriate charge. Refer to the Building Regulation Charges Guidance Notes which are available on request or via Newcastle City Council’s website. The appropriate charge is dependent upon the type of work carried out. (VAT is not payable).
  1. Cheques should be made payable to Newcastle City Council. If you wish to pay by credit / debit card, we will contact you following receipt of your application to advise the amount due and procedure for payment.
  1. In accordance with Building Regulation 18 the Council may require an applicant to take such reasonable steps, including having the unauthorised work opened up for inspection, making tests and taking samples as the authority think appropriate, ascertain what work, if any, is required to secure compliance with the relevant regulations.
  1. If the council determines that it is unable to issue a regularisation certificate because there is insufficient evidence that the building work meets with building regulations, you will be advised in writing of the reasons for this. The applicant will not be entitled to a refund of the application charge. The applicant may choose to take further steps to demonstrate that the building work complies and at that time, the council may then issue a regularisation certificate.
  1. Persons who have carried out the building work or have made a material change of use of a building are reminded that permission may also have been required under the Town and Country Planning Act.
