APPLICATION FOR WAIVER OF PRESCRIBED REQUIREMENTS

In terms of section 31(2)(c) of the Immigration Act, as amended, upon application, the Minister of Home Affairs may, for good cause, waive any prescribed requirement or form.

The waiver request, addressed to the Minister of Home Affairs, must be submitted and approved by the Department of Home Affairs in Pretoria, before the visa application is be submitted.

The following documentation must be submitted by each applicant.

  • Must be downloaded and printed:

2 / A letter signed by the employer, citing the requirements to be waived and a comprehensive motivation for each requirement / 
3 / Background on the company / institution for record purposes / 
4 / The applicant's curriculum vitae / 
5 / Original orcertified copy of the employment contract signed by both the employer and the employee
  • If the original document is submitted, it must be accompanied by photocopies. The copies will be certified and the original document will then be given back to the applicant.

  • If the original document is submitted, it must be accompanied by photocopiesof the passport page with the applicant’s personal data / photographand of all previous visas for the Republic of South Africa in the passport. The copies will be certified and the original document will then be given back to the applicant.

7 / A self-addressed A5-size envelope with postage paid for €3,95 (per Einschreiben)
  • The envelope is required to send the waiver outcome to the applicant after it has been received from the Department of Home Affairs in the Republic of South Africa.

Please note:

-Waiver applications which are not complete shall not be taken in to be processed. It is therefore the responsibility of the applicant to ensure that his or her visa application is complete as per the checklist.

-The time frame set for finalisation of the waiver process is eight (8) weeks, however recent experience shows that it may take up to six (6) months and longer – the South African foreign office may not intervene in or obtain status / progress reports during the waiver process; applicants may however contact the Department of Home Affairs Contact Centre themselves about their application status: .

-Should the request be considered favourably, a letter will be forwarded to the applicant or his / her employer, which has to be submitted with the application and remaining requirements at the South African foreign office if the applicant is still abroad.
