Statement of Training

All Super E® House Program Members must meet and maintain training qualification for Super E®.

Each Super E® House project must have a Super E® trained staff person designated as the Super E® House project manager. This project manager shall be intimately involved in the project from the design stage through construction and to after-sales service. Dedicated Super E® trained staff must also be on-site to provide supervision on all Super E® Houses. The applicant therefore agrees to commit specific personnel who will work with qualified Canadian Super E® experts throughout the design and construction of Super E® homes.

Brand Integrity Requirements

following brand integrity requirements of the Super E® House Program:

i.  It is understood that, upon approval of this application, the applicant may be termed a Super E® Designate and, as such, may advertise the construction of a Super E® House. Upon completion and registration of three of the Designate’s Super E® Houses, the Super E® Designate becomes a full Super E® Member and may advertise himself as a Super E® Builder. NOTE: Registration of the houses is complete upon receipt of a notification from Natural Resources Canada.

ii.  While it is understood that the Super E® House Program logo may be used on our marketing and promotional materials upon acceptance as a Super E® Member, the Super E® House Program logo will not be affixed or attached to any product or service which has not been approved by the Super E® House Program; it is understood that any misuse of the Super E® Program logo may lead to suspension or expulsion as a Super E® Member.

iii.  It is understood that Canada shall retain the sole right to authorize the use of the Super E® Trademarks in connection with specific projects, houses, products, equipment and systems and shall retain all rights pertaining in any way to the Super E® Trademarks.

iv.  It is understood that Natural Resources Canada or its designated agent reserves the right to review any marketing material containing the Super E® House Program logo and request any changes it feels are necessary to comply with the image of the Super E® Program.

v.  It is understood that any house to be registered as a Super E® House meets the current Super E® House Program requirements, as set out in the Canada’s Super E® House Program Members’ Manual.

vi.  It is understood that we will supply a homeowners’ manual, completed according to the model set out by the Super E® House Program Members’ Manual, to purchasers of Super E® Houses; such manuals will include information regarding the home constructed as well as for the maintenance and operation of all components supplied within the home.

vii.  It is understood that, each year, a fully completed Annual Submission Form will be submitted to the Super E® House Program to confirm on-going commitment to the Super E® House Program, and to confirm our qualifications to participate in the Super E® House Program; it is further understood that failure to submit the Form in a timely fashion may lead to suspension as a Super E® Member.

viii.  Each Super E® House constructed must have a minimum Canadian content of 60% as defined by the Super E® Technical Requirements.

ix.  We have agreed to and set our seal and signature to the Super E® House Program Code of Ethics.

Indemnity

i.  We indemnify and save harmless Canada and its ministers, officers, employees and agents from and against any claim, demand or action, irrespective of the nature of the cause of the claim, demand or action, alleging loss, costs, expenses, damages or injuries (including injuries resulting in death) arising out of the applicant’s use of the Super E® Trademarks or in any way relating to a housing Project.

Legal Relationship

i.  We understand that nothing in this application creates the relationship of principal and agent, employer and employee, partnership or joint venture between the parties.

ii.  We agree to not hold ourselves out as an agent or representative of Canada or the Super E® House Program.
