156-1. Intent.

It is the intent of these regulations to prohibit the infringement of any businesses in any established residential areas and in so doing to regulate the term and frequency of a personal property sale (such as garage sales, porch sales, basement sales, yard sales, tag sales and other types of sales) so as not to disturb or disrupt the residential environment of the area. It is not the intent of this chapter to seek control of sales by individuals selling a few of their household or personal items.

§ 156-2. Permit required.Editor's Note: Amended at time of adoption of Code (see Ch. 1, General Provisions, Art. I).

Any persons desirous of holding a personal property sale (such as but not limited to garage sales, basement sales, porch sales, yard sales or tag sales), resale of used household, clothing or any personal property items, which are owned by the residents of the premises, shall obtain a permit therefore from the Village Clerk of the Village of East Rockaway, as provided in this chapter and in Ch. 187, Licenses and Permits.

§ 156-3. Term of permit.

Any such permit issued shall be for a term not exceeding two consecutive calendar days.

§ 156-4. Frequency of issuance of permit.

Permits shall be limited to two per calendar year, per residential dwelling.

§ 156-5. Application forms. Application for permit shall be made to the Village Clerk of the Village of East Rockaway.

§ 156-6. Permit fees.[Amended 7-12-1999 by L.L. No. 2-1999]

The fee to be charged under the provisions of this chapter shall be determined from time to time by resolution of the Board of Trustees.

§ 156-7. Safety and environmental requirements to be taken.

The permit will be valid only upon a proper showing and finding by the Village Clerk that property safety and environmental precautions have been taken for the public.

§ 156-8. Posting of permit.

The permit shall be posted on the premises in a conspicuous place so as to be seen by the public and Building Inspectors.

§ 156-9. Enforcement.

A police officer or any other official designated by the village to make inspections under the licensing or regulating ordinance or to enforce the same shall have the right of entry to any premises showing evidence of a personal property sale for the purpose of enforcement or inspection and may close the premises from such a sale or arrest any person who violates the provisions of this chapter.

§ 156-10. Hours of sales.[Added 8-10-1987 by L.L. No. 4-1987]

All garage sales held pursuant to these provisions shall be conducted no earlier than 9:00 a.m. and no later than 6:00 p.m.

§ 156-12. Penalties for offenses.[Amended 8-10-1987 by L.L. No. 4-1987]

Any person committing an offense against any provision of this chapter shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this chapter shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
